This Indenture , made the30th day of September
November, Nineteen Hundred and Ninety-Nine
between
DOROTHY C . GERHARDT, as surviving spouse, residing I�PZsw��f�r
at Cutchogue, Suffolk County, New York
party of the first part, and
DOROTHY C. GERHARDT, residing at Cutchogue, New
York, and MORGAN STANLEY DEAN WITTER TRUST, F. S.B. , as
Trustees of THE DOROTHY C. GERHARDT REVOCABLE TRUST,
dated September 30, 1999
party of the second part,
Witnesseth , that the party of the first part, in
consideration of Ten Dollars and other valuable
consideration paid by the party of the second part,
does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever,
All that certain plot, piece or parcel of land,
situate, lying and being at Fleet ' s Neck, Cutchogue,
Town of Southold, County of Suffolk and State of New
York, bounded and described as follows :
BEGINNING at a concrete monument set on the easterly
side of West Creek Avenue, said monument being the
southwesterly corner of land; running thence along last
described land, N. 86 ° 03 ' 40" E. 171 . 15 feet to a nail
driven into a certain oak tree; thence along other land
of said parties of the first part, two courses, as
follows :
First: S. 3 ' 56 ' 20" E. 75 feet to a concrete monument;
thence,
Second: S. 86 ° 03 ' 40" W. 178 .72 feet to a concrete
monument on said easterly line of West Creek Avenue;
thence along said easterly line of West Creek Avenue,
N. 1 °49 ' 20" E. 75 . 38 feet to the point of beginning.
Together with the use of a right of way, 35 feet in
width, as now marked out at a point about 500 feet
southerly from the premises hereby conveyed, and
extending from the westerly line of said West Creek
Avenue, at right angles thereto, about 50 feet to West
Creek.
Subject, however, to the following restrictions : That
only one house or bungalow shall be erected or
maintained on said lot, and any such house or bungalow
erected or maintained shall cost not less than
$2 , 000 . 00 and shall be at least 35 feet back from the
front boundary line of the lot, including the porch or
piazza;

That. no outbuildings shall be erected other than the
usual garage, and said garage shall be in connection
with or joined to the house or bungalow, or so erected
that it shall be at least 90 feet back from the front
boundary line of the lot;
That the premises shall be used for dwelling purposes
only, and nothing which shall be a nuisance,
unwholesome or offensive to the neighborhood shall be
permitted on said lot;
That no fowl or pigs shall be kept on said premises .
BEING AND INTENDED TO BE the same premises conveyed to
the Grantors herein by deed dated November 16, 1939 and
recorded in the Suffolk County Clerk' s Office on
November 29, 1939 at Liber 2075, Page 595 .
Together with all right, title and interest, if
any, of the party of the first part in and to any
streets and roads abutting the above described
premises to the center lines thereof;
Together with the appurtenances and all the estate
and rights of the party of the first part in and to
said premises;
To have and to hold the premises herein
granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part
forever.
and the party of the first part covenants that the
party of the first part has not done or suffered
anything whereby the said premises have been encumbered
in any way whatever, except as aforesaid.
and the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for
the purpose of paying the cost of improvement and will

apply the same first to the payment of the cost of the
improvement before using any part of the total of the
same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of
this indenture so requires .
