THIS INDENTURE, made the / (lay of August nineteen hundred and ninety-nine
BETWEEN
VICTOR ALES and MARIAN F. ALES, as Trustees of the ALES LOVING TRUST residing at
329 Forest Road, Douglaston, New York 11363
Party of the first part,and
VALERIANO AZZARA and PATRYCIA AZZARA, his wife, both residing at 38 Old Mill Road,
Merrick, New York 11566
Party of secmid part, ONE HUNDRED TWENTY SIX THOUSAND AND 00/100
WITNESSETH,that the part of the first part,in consideration of tuff, and other valuable consideration paid by the part of the
second part,does hereby grant and release unto the party of the second part,the heirs or successors and assigns of the party of the second
part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,lying and being in the
Town of Southold, County of Suffolk and State of New York, near Mattituck, bounded and described
as follows (Lot 29):
BEGINNING at a point on the westerly line of Marlene Lane, 428.36 feet southerly along said
westerly line from the Main Road (Route 25), being the southeasterly corner of land conveyed by the
parties of the first part to Angelo Coletti;
RUNNING THENCE along said westerly line of Marlene Lane, South 20 degrees 39 minutes 10
seconds East 75.0 feet to the northeasterly corner of land conveyed by the parties of the first part to
Willialn Gunther;
THENCE along said land of Gunther South 69 degrees 20 minutes 50 seconds West 145.0 feet to land
now or formerly of Mattituck Park Properties, Inc.;
THENCE along said land, North 20 degrees 39 minutes 10 seconds West 75.0 feet to said land of
Coletti;
THENCE along said land of Coletti North 69 degrees 20 minutes 50 seconds East 145.0 feet to the
point or place of BEGINNING.
BEING AND INTENDED TO BE THE same premises conveyed to the grantor herein by deed dated
April 19, 1996 and recorded in the Office of the Suffolk County Clerk on May 3, 1996 in Liber 11772
cp. 432.
TOGETIE'.R with all right,title and interest,if any,of the party of the first part in and to any streets and roads abutting the above
described premises to the center lines thereof,TOGETHER with the appurtenances and all the estate and rights of the party of the fust
part in and to said premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have
been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with.Section 13 of the Lien Law,covenants that the party of the first part will receive the
consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied fust for the purpose of
paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of
the total of the same for any other purpose.
The word`}Darty"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
