WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the
SEE SCHEDULE A ATTACHED HERETO AND MADE A PART HEREOF.
BEING AND INTENDED TO BE the same premises conveyed to the grantors
herein by deed dated 11/3/88, recorded in the Suffolk County Clerk's
Office on 12/6/88 in Liber 10750 Page 22 .
Regulated tidal wetlands associated with Mattituck Halls Creek are
located at Meadow Beach Lane, County Tax Map Number: Dist. 1000,
Dist. 1000 Section 116, Block 7, Lot - 8, otherwise known as the properties of
Sect. 116.00 James Eckert and Linda Eckert, :their heirs, assigns, or successors.
Blk. 07.00 This property is subject .to the provisions of New York State
Lot 008.000 Environmental Conservation Law (ECL) Article 25 or its successor,
and the conduct of regulated activities may occur only pursuant to
ECL Article 25 if prior approval is given by the New York State
Department of Environmental Conservation (NYSDEC) or its successor.
Regulated activities include, but are not limited to the erection of
any structure(s) ; excavation; dredging, grading and filling; cleaping
of vegetation; and applications of chemicals.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to anv streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck,
Town of Southold, County of Suffolk and State of New York, known and
designated as lot number 22 on map entitled "Map of Harbor View at Mattituck",
filed in the Office of Clerk of the County of Suffolk on August 21, 1987 as Map
No. 8377, being more particularly bounded an described as follows:
BEGINNING at a point on the northeasterly side of Meadow Beach Lane, where
the dividing line between lots 22 and 23 on the above mentioned map intersects
the said northeasterly side of Meadow Beach Lane;
RUNNING THENCE along the said dividing line, South 87 degrees 07 minutes
50 seconds East, a distance of 363.86 feet to the westerly side of Halls Creek
(Mud Creek);
THENCE along the westerly side of Halls Creek (Mud Creek) as it curves, the
chords of said curves having the following three (3) bearings and distances:
1. South 8 degrees 05 minutes 33 seconds East, 57.17 feet;

THENCE along the northeasterly side of Meadow Beach Lane, the following
three (3) courses and distances:

2. Northerly along the arc of a curve to the right having a radius of 25.00 feet,
a distance of 30.77 feet;
3. Northerly along the arc of a curve to the left having a radius of 50.00 feet, a
