THIS INDENTURE, made the i%� day of �, 1999 BETWEEN
JOHN 'V. SAWICKI, residing at 1900 Deep Hole Drive, Mattituck, New York 11952 and
BARBARA CHUDIAK, residing at 4300 Bergen Avenue, Mattituck, New York 11952, as joint
tenants with the right of survivorship
party of the first part, _

party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Mattituck in the Town of Southold, County of Suffolk, State of New York, bounded and
described as follows:
BEGINNING at a point on the northerly side of Main Road distant 75 feet easterly from the comer formed
by the intersection of the northerly side of Main Road with the easterly side of Legion Road (Avenue);
running thence North 35 degrees 31 minutes 00 seconds West 128 feet; thence South 49 degrees 02 minutes
40 seconds West 75 feet to the easterly side of Legion Road; thence North 35 degrees 11 minutes 00
seconds West along the easterly side of Legion Road 52.95 feet to the land now or formerly of Lutheran
Church; ,thence North 51 degrees 09 minutes 40 seconds East along said last mentioned land 150.86 feet to
land now or formerly of McCabe; thence South 36 degrees 27 minutes 30 seconds East along said last
mentioned land 175.10 feet to the northerly side of Main Road; thence South 49 degrees 02 minutes 40
seconds West along the northerly side of Main Road 79.20 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed dated
September 25, 1991 recorded in the Office of the Clerk of the County of Suffolk in Liber 11360 page 214.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said

TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successo-:s and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.

AlD THE party of the first part, in compliance with Section,1-1 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
