WITNESSETH, that lite party of the first part, to whom letters
testamentary were issued by the Surrogate's Court, Suffolk County, New York
on March 21, 1997 and by virtue of the power and authority given in and by said last will
and testmnent, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of
Two hundred ninety-five thousand ($295,000.00)
dollars,
paid by the party of the second part, does hereby grant and
release unto the party of the second part, the distributees or successors and assigns of the party of the second
part forever,

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death ill said premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
Subject to the trust fund provisions of section thirteen of the Lieu Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

PARCEL A
ALL that certain lot, piece or parcel of land
situate, lying and being at Nassau Point or Little Hog Neck,
Suffolk County, N.Y. , and known and designated as lot
numbered 316 on map entitled "Amended Map A of Nassau Point,
owned by Nassau Point Club Properties, Inc. , situate in Town
of Southold, Long Island, N.Y. " surveyed June 28, 1922 , by
Otto W. Van Tuyl, C.E. 6 Surveyor, Greenport, N.Y. , and
filed in the office of the County Clerk of Suffolk County,
N.Y. , August 16, 1922, File No. 156 . Being part of the
premises heretofore conveyed by Ralph S. Case and Mary G.
Case, his wife to Fannie B. Hard by deed dated November 10,
1926 and recorded in the office of the Clerk of Suffolk
County in Liber 1204 0£ Deeds at Page 563 on November 13th,
1926, and which is more particularly bounded and described
as follows : -
BEGINNING at the point of intersection of the
boundary line between Lots 314 and 316 with the northerly
line of Horse Shoe Road as shown on said map, and running
thence (1) in a general northeasterly direction along said
boundary line between said lots 189 feet to a monument
situated at the junction points of Lots 313, 314 , 316 and
317 as shown on said map; running thence (2) in a general
westerly direction along the boundary line between Lots 316
and 317 as shown on said map about 330 feet to high water
line of Horse Shoe Cove; running thence (3) in a general
southerly direction along the" high water line of Horse Shoe
Cove 50 feet to the west end of the North line of Horse Shoe
Road as laid out on said map; running thence (4) in a
general easterly and northeasterly direction curving to the
right along the north line of Horse Shoe Road about 250 feet
to the point and place of beginning.
TOGETHER with all right, title and interest of the
Grantors or which the Grantors have power to convey, if any,
of, in and to the lands under water in Horse Shoe Cove
adjoining the above described premises on the west and in
and to the bed of the Horse Shoe Road.
TOGETHER with a right of way and easement in
Perpetuity for all purposes of ingress and egress to said
lot numbered 316 over a triangular parcel of land bounded
and described as follows : - BEGINNING at a monument located
on the northeasterly line of Horse Shoe Road distant 40 feet

southeasterly on a curve to the right, measured along said
northeasterly line of Horse Shoe Road from the southeast
corner of the above described lot numbered 316, all as shown
on said map, running thence (1) in a general northeasterly
direction on a curve to the- left along said northeasterly
line of Horse Shoe Road 40 feet to said southeast corner of
the above described lot numbered 316; running thence (2)
along said boundary line between lots numbered 314 and 316
as shown on said map, 40 feet; running thence (3) in a
southerly direction in a straight line to the point of
beginning of said right of way and easement herein described
at said monmument lastly hereinabove referred to.
TOGETHER with a right of way and easement in
perpetuity for the purpose of keeping, maintaining,
repairing and replacing the existing telephone and electric
lines running from Vanston Road over and across the premises
heretofore granted by the Grantors herein to Mildred I.
Filardi, shown as lot number 314 on said map, to the within
lot numbered 316 at the present location of said lines or at
any location to which said lines may be moved by said
Mildred I . Filardi, her heirs and assigns, under right
heretofore granted by the grantors herein to said Mildred I .
Filardi to relocate said lines under said grant heretofore
made by the grantors herein to said Mildred I . Filardi, and
subject to the right of said Mildred I . Filardi to relocate
said lines as set forth in said grant heretofore made to
her.
SUBJECT to all restrictions and easements now of
record affecting the premises, and also subject to any state
of facts which an accurate survey might show.
