THIS INDENTURE, made the 30 day of October, two thousand
BETWEEN JAMES E. HAND, residing at No # Morse Hill Road,
Dorset, Vermont 05201, as to his one-quarter interest, part~
of the first part, and
VIRGINIA M. DURETT, residing at 705 Tuxford Turn, Westfield,
New Jersey 07090, party of the second part,
WITNESSETH, that the party of the first part,in consideration
of Ten Dollars and other valuable consideration paid by the
party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
being in the Village of Cutchogue, in the Town of Southold,
Suffolk County, and State of New York, and more particularly
described on Schedule "A" annexed hereto and made part
hereof.

BEING AND INTENDED TO BE a portion of the premises conveyed to
the party of the first part by deed from Henry J. Hand and
James R. Hand, as Co-Executors of the Last Will and TEstament
of Dorothy A. Hand a/k/a Dorothy Hand, to Richard C. Hand,
Virginia M. Durett, formerly known as Virginia M. Hand, John
R. Hand and James E. Hand, being all of the per stirpital
devisees under Article Sixth of the Last will and Testament of
Dorothy A. Hand a/k/a Dorothy Hand (by reason of the
renunciations of the devisees, Henry J. Hand and James R.
Hand, to such premises, said renunciations having been filed
in the Office of the Clerk of the Surrogate's Court of the
State of New York, County of Suffolk on September 14, 1998,
under file No. 1034P98, as tenants in common, dated October 5,
1998 and recorded in the Office of the Clerk of the County of
Suffolk on November 10, 1997, in Liber 11927, page 848.
TOGETHER with all right, title and interest, if any of the
party of the first part in and to any streets and roads
abutting the above described premises to the center lines
thereof; TOGETHER with the appurtenances and all the estate
and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
AND the party of the first part covenants that the party of
the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13
of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will

hold the right to rec8ive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total
of the same for any other purpose.
The word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly
executed this deed the day and year first above written.

undersigne , a Notary Public in and for said State, personally
appeared JAMES E. HAND, personally known to me or proved to me
on the basis of satisfactory evidence to be the individual
whose name is subscribed to the within instrument and
acknowledged to me that he executed the same in his capacity,
and that by his signature on the instrument, the individual,
or the person upon behalf of which the individual acted,
executed the instrument and that said individual made such
appearance before the undersigned in Manchester, County of
Bennington, Vermont.

SCHEDULE "A"
ALL that certain tract or parcel of land situate in the
Village of Cutchogue, Town of Southold, County of Suffolk and
State of New York with buildings and improvements thereon
bounded northerly by the Main Road, 70 feet; easterly by land
formerly of Goldsmith, 200 feet; southerly by land formerly of
Goldsmith, 70 feet; and westerly by land formerly of Goldsmith
200 feet. The easterly and westerly lines thereof being
parallel.
Parcel No. 2 All that tract or parcel of land situate in the
Village of cutchogue, Town of Southold, County of Suffolk and
State of New York bounded notherly by Main Street, a distance
of 10 feet; easterly by other land of James A. Hand; southerly
10 feet by land formerly of Goldsmith; westerly by land
formerly of Goldsmith 200 feet. The easterly and westerly
lines thereof being parallel.
Said premises commonly known as 26420 Main Road, Cutchogue,
New York.
