WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of New York,
known and designated as Lot 1 on a certain map entitled "Map of the Woods
at Cutchogue" and filed in the Office of the Clerk of the County of Suffolk
on March 23, 1989 as Map Number 8717, which said lot is more particularly
bounded and described as follows :
BEGINNING at a point on the northeasterly side of Evergreen Drive
distant 260 feet northwesterly as measured along the northeasterly side of
Evergreen Drive from the extreme northwesterly end of a curve having a
radius of 25 . 00 feet, a length of 39 .27 feet, connecting the northeasterly
side of Evergreen Drive with the northwesterly side of Vineyard Drive;
running thence from said point or place of beginning along the
northeasterly, easterly and southeasterly sides of Evergreen Drive the
following three courses, curves and distances : (1) North 370 461 00" West
105. 00 feet; (2) Northeasterly along the arc of a curve bearing to the
right having a radius of 75. 00 feet a distance of 117. 81 feet; (3) North
520 14 ' 00" East 225. 00 feet to lands now or formerly of Robert E. Bidwell
(Vineyard) ; thence along said last mentioned land (Vineyard) South 370 41'
3011 East 180. 00 feet to the division line between Lot No. 1 and 2 on the
aforementioned map; thence along said last mentioned division line South
520 14 ' 00" West 299.76 feet to the northeasterly side of Evergreen Drive
the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of
the first part by deed dated September 17, 1998 and recorded in the Suffolk
County Clerk' s Office on Oct'obe'r 8, 1998 in Liber 11921 Page 689. .

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
