WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid
by the party of the second part, does hereby grant and release unto the party of the second part,the heirs or successors
and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,lying and being in
the Town of Southold,on Lupton's Point in Mattituck,County of Suffolk and State of New York,and bounded and described as
follows:
BEGINNING at a point on the northerly side of Lupton Point Road a 20 foot right of way distant the following courses
and distances from the corner formed by the intersection of the northerly side of Lupton Point Road a 20 foot right of way and
easterly side of Marratooka Lane,all as measured along the northerly side of Lupton Point Road,a 20 foot right of way;
1. South 71 degrees 39 minutes 20 seconds east,268.32 feet;
2. South 73 degrees 28 minutes 50 seconds east,462.99 feet;
3. North 79 degrees 45 minutes 10 seconds east, 195.24 feet;
Said point being also at the southeast comer of land now pr,formerly of George W.Krieling and the southwest corner of the land
about to be described,from said point of beginning; .
THENCE north 10 degrees 14 minutes 50 seconds west-along land now or formerly of George W.Krieling, 162.02 feet to Deep
Hole Creek;
THENCE easterly along Deep Hole Creek to a point located along a tie line south 77 degrees 34 minutes 30 seconds east, 151.19
feet and land now or formerly of John Winters;
THENCE along said land south 10 degrees 30 minutes 50 seconds east, 103.74 feet to the northerly side of Lupton Road Point
a 20 foot right of way;
THENCE south 79 degrees 45 minutes 10 seconds west along the northerly side of Lupton Road Point a 20 feet right of way,
140.00 feet to the point or place of BEGINNING.
Being and intended to be the same premises conveyed by Beed from Bernhard Peper and Lisa Peper,his wife,dated December
20, 1995, and recorded January 2, 1996, in Liber 11756 at Page 547.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any street and roads
abutting the above-described premises to the center lines thereof;TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost to the improvement before using any part of the total of the same for any other purpose.The word"party"
shall be construed as if it read"parties"whenever the sense of this indenture so requires.
