WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part does hereby grant and release unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,lying
and being in the Town of Southold, County of Suffolk,State of New York,property known as Dick's Point,a part of
Elect's Neck at east side of Wickham's Creek,known and described under Suffolk County Tax Map District and Section,
Block, Lot 110-1-10,bounded and described as follows:
BEGINNING at a concrete monument set on the westerly line of West Creek Avenue,defined by prior deed as thirty-three
(33)feet in width,said monument being about six hundred and forty(640)feet northerly from the northerly line of"West
Road" or Bay Avenue, measured along the westerly line of the thirty-three (33) fool wide road known as West Creek
Avenue on the westerly side of Fleet's Neck;running thence south 61 degrees 46 minutes 30 seconds west three hundred
and filly and ninety-five hundredths (350.95) feet passing through a concrete monument near the easterly shore of
Wickham's Creek; thence northwesterly along said easterly side of said creek approximating a line which is north 55
degrees 46 minutes 10 seconds west eighty(80)feet more or less from the last described point;thence north 61 degrees 46
minutes 30 seconds east,on a line parallel to and seventy(70)feet northerly of the first described course from the point of
beginning. one hundred and thirty-five (135) feet, more or less, through a concrete monument near the easterly side of
W ickham's Creek, to a concrete monument;thence at a 90 degree angle to the last described course,north 28 degrees 13
minutes 30 seconds west thirty(30) feet to a corner concrete monument;thence,at a 90 degree angle to the last described
course,north 61 degrees 46 minutes 30 seconds east on the line parallel to and one hundred(100)feet northerly of the first
described course from the point of beginning, two hundred and twenty-eight and forty-three hundredths(228.43)feet to a
concrete monument on the westerly line of the thirty-three(33)foot wide road known as West Creek Avenue;thence South
41 degrees 25 minutes 00 seconds east one hundred and two and seventy-one one hundredths(102.71)feet to the point of
beginning.
Together with right of way to die Bay and County Roads.
Together with any right,title or interest which the grantor may have in,and to the water or land under water of
Wickham'!;Creek adjacent to said premises.
Phis being the same property conveyed to grantor by deed recorded in the State of New York,County of Suffolk
on September 28, 1994,Deed Liber 11696,Page 074
TOGETHER with all right,title and interest, if any,of die party of the first part of, in and to any streets and roads abutting
the above-described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO
HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenant that the party of the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the sane first to the payment of the cost of
improvement before using any part of the total of the any total of the same for any other purpose.
The word"party"shall be construed as if it read"parties.'whenever the sense of this indenture so requires.
