Geor,qe Solomon: and be it further RESOLVED, that pursuant to Southold Town Code
§280-133 C, the Planning Board has found that requiring the entire set of site plan
application requirements for this site is not necessary to further the objectives set forth
in Town Code §280-129, and maintain public health, safety, and welfare for the
following reasons: the application is for an agricultural use, and the parcel is large in
size relative to the proposed and existing structures. The Planning Board hereby waives
the site plan application requirements, except for the following items:
§280-133A. (1), (2), (4), and(5); B. (1) (a)-(f), B. (2) (a), (b), B. (3) (a) (partial),
(b), (c) (partial); (4) (a),(c),(e),(f), and(g).
Pursuant to Southold Town Code §280-131 B. (5), the Planning Board has found that
waiving the parking requirements on this application by allowing the existing parking
area to serve the additional greenhouses will not have a detrimental effect on the public
health, safety or general welfare, and will not have the effect of nullifying the intent and
provision of the site plan requirements chapter in the Town Code. The Board has found
that this application is eligible for the waiver due to the large size of the property relative
to the size of the proposed and existing structures, the proposed structures being an
addition to an existing business where a parking area exists, and the site being not
open to the public. The Planning Board hereby waives the parking requirements for this
application.
Pursuant to Southold Town Code §280-131 H., the Planning Board has found that the
public hearing for this application may be waived for the following reasons: the
application is for an agricultural use, the parcel is large in size relative to the proposed
structures, the new structures will add 1.5 percent of lot coverage for a total of 4.6
percent; will be unheated (little noise), and will be situated in such a way as to be
unobtrusive to the public view and neighboring residence - located 42 feet from the
property line, nine feet lower in elevation, and screened by evergreen trees. The
Planning Board hereby waives the public hearing requirement for this application;
Joe Townsend: Second.

George Solomon: and be it further RESOLVED, that the Southold Town Planning
Board has reviewed the proposed action under the policies of the Town of Southold
Local Waterfront Revitalization Program and determined that the action is consistent as
outlined in the April 10, 2008 memo prepared by the LWRP Coordinator;
Ken Edwards: Second the motion.

Geor.qe Solomon: and be it further RESOLVED, that the Southold Town Planning
Board grant approval with conditions listed below, and authorizes the Chairperson to
endorse the site plan entitled "Survey of Property" prepared by David L Saskas, last
revised April 7, 2008:
1. Run-off and drainage from the new greenhouses shall be managed as described
below:
a. Construct a swale, located as shown on the site plan, to be an average of
2' deep, in the shape of an oval approximately 75' long and 35' wide.
Install a grass filter strip, at least 15 feet wide, at the southerly end of the
greenhouses, and running along the entire length of the greenhouse
operation.
2. All storm water run-off from grading, driveways and gravel areas must be
contained on site.
3. The top of the slope must be no closer than 20' to the property line, and the
slope must be no steeper than a 1:3 ratio, as depicted on the site plan.
The applicant must meet the requirements as directed in the Highway Work
Permit application process, if required by the New York State Department of
Transportation (NYSDOT) for this site plan. If a Highway Work Permit is required
by the NYSDOT, the applicant must submit a copy of the approved plan and
permit from the NYSDOT to the Planning Board for review. If the approved plan
submitted to NYSDOT varies from the site plan approved by the Planning Board,
the Planning Board reserves the right to review the changes as an amended site
plan application.

Pursuant to Southold Town Code §280-131 B. (5), the Planning Board has found that
waiving the parking requirements on this application by allowing the existing parking

that this application is eligible for the waiver due to the proposed structure being an
addition to an existing business where parking areas exist, no new employees are being
added as a result of the new greenhouse, and the new structure is not open to the
public. The Planning Board hereby waives the parking requirements for this application.
Pursuant to Southold Town Code §280-131 H., the Planning Board has found that the

WHEREAS, the Southold Town Planning Board, pursuant to §280-131 H. of Southold
Town Code, has the discretion to waive the public hearing requirement for those
applications involving uses strictly related to agriculture; be it therefore
RESOLVED, that on April 14, 2008, the Southold Town Planning Board, pursuant to
State Environmental Quality Review (SEQR) (6 NYCRR, Part 617.5 (c) (3), has
determined that the proposed action is a Type II Action, and not subject to review under
SEQR;
George Solomon: Second the motion.
Chairperson Woodhouse: All in favor?

Ken Edwards: and be it further RESOLVED, that pursuant to Southold Town Code §280-133
C, the Planning Board has found that requiring the entire set of site plan application
requirements for this site is not necessary to further the objectives set forth in Town
Code §280-129, and maintain public health, safety, and welfare for the following
rsasons: the application is for an agricultural use, and the parcel is large in size relative
to the proposed and existing structures. The Planning Board hereby waives the site
plan application requirements, except for the following items:
§280-133 A. (1), (2), (4), and (5); B. (1) (a)-(f), (j'); B. (3) (a), (b); B. (4) (a), (c), (e-
partial), (g) and (i).
Southold Town Planning Board Page Fifteen April 14, 2008
Pursuant to Southold Town Code §280-131 B.(5), the Planning Board has found that
waiving the parking requirements on this application by allowing the existing parking
area to serve the additional greenhouses will not have a detrimental effect on the public
health, safety, or general welfare, and will not have the effect of nullifying the intent and
provision of the site plan requirements chapter in the Town Code.
Pursuant to Southold Town Code §280-131 H., the Planning Board has found that the
public hearing for this application may be waived for the following reasons: the
application is for an agricultural use, the parcel is large in size relative to the proposed
structures, the new structure will add 3.7% of lot coverage for a total of 6.5% and will be
situated in such a way as to be unobtrusive to the public view - located 85' from the
nearest property line and about 140' from the County Road 48 Scenic Corridor and
partially screened by evergreen trees and an existing barn. The Planning Board hereby
waives the public hearing requirement for this application;
George Solomon: Second.
Chairperson Woodhouse: All in favor?
Ayes.
Ken Edwards: and be it further RESOLVED, that the Southold Town Planning Board
has reviewed the proposed action under the policies of the Town of Southold Local
Waterfront Revitalization Program and determined that the action is consistent as
outlined in the March 31, 2008 memo prepared by the LWRP Coordinator;
George Solomon: Second.
Chairperson Woodhouse: All in favor?

Ken Edwards: and be it further RESOLVED, that the Southold Town Planning Board
grant conditional approval, listed below, and authorizes the Chairperson to endorse the
site plan entitled "Survey of Property" prepared by John C. Ehlers, Land Surveyor, last
revised April 10, 2002, with hand-written notations by the applicant dated 3/7/08:

Joe Townsend: and be it further RESOLVED, that pursuant to Southold Town Code
§280-133 C, the Planning Board has found that requiring the entire set of site plan
application requirements for this site is not necessary to further the objectives set forth
in Town Code §280-129, and maintain public health, safety, and welfare for the
following reasons: the application is for an agricultural use, and the parcel is large in
size relative to the proposed and existing structures. The Planning Board hereby waives
the site plan application requirements, except for the following items:
§280-133A. (1), (2), (4), and(5), B. (1) (a)-(f), 0'), B. (3) (a),(b),B.(4) (a),(c),(e-
partial), (g) and (i).
Pursuant to Southold Town Code §280-131 B.(5), the Planning Board has found that
waiving the parking requirements on this application by allowing the existing parking
area to serve the new barn will not have a detrimental effect on the public health,
safety, or general welfare, and will not have the effect of nullifying the intent and
provision of the site plan requirements chapter in the Town Code. The Board has found
that this application is eligible for the waiver due to the proposed structure being an
addition to an existing business where parking areas exist, no new employees are being
added as a result of the new barn, and it is not open to the public. The Planning Board
hereby waives the parking requirements for this application.
