and beinget East Marion, Town of Southhold, County of Suffolk and State of New York, bounded and described as

BEGINNING at a stake on the southerly line of a 16 feet roadway, said stake being North 69° 17' 30" East 125.5
feet from a concrete monument set at the intersection of the southerly line of said 16 foot roadway with the easterly
line of Bay Avenue and about 208.8 feet northerly from the shore of the Bay; running thence from said stake at said
point of beginning, along the southerly line of said roadway North 56° 57' 50" East 37.515 feet to a stake at the
northwest corner of land conveyed to George B. Cabeen and Dorothea C. Cabeen; thence along land conveyed
by East Marion Lan~ Improvement Company, Inc., to George B. Cabeen and Dorothea C. Cabeen his wife and
parallel with the easterly line of said Bay Avenue South 34° 12' 40" East to ordinary high water mark of the Bay;
thence along said ordinary high water mark South 50 ° 17' 30" West 37.69 feet; thence along other land of said East
Marion Land improvement Company, Inc., and parallel with said Bay Avenue North 34° 12' 40" West 167.04 feet
more or less to the point of BEGINNING.
PARCEL TVVO:
ALL that certain plot, piece or parcel of land, situate, lying and being at East Marion, Town of Southold, County
of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a stake marking the northwesterly corner of land herein described being the northeasterly corner
of land conveyed by East Marion Land Improvement Company, Inc., to Agnes A. Cording and being on the
southerly line of a 16 feet roadway leading easterly from the easterly line of Bay Avenue; running thence along said
southerly line of 16 foot roadway North 56 ° 57' 50" East 37.515 feet to a stake; thence along other land of said East
Marion Land Improvement Company, Inc., and parallel with the easterly line of Bay Avenue, South 34° 12' 40" East
158.43 feet more or less to ordinary high water mark of the Bay; thence along said ordinary high water mark South
50" 07' 30" West 37.69 feet to the southeasterly comer of land designated as parcel one herein; thence along last
mentioned land and parallel with said Bay Avenue North 34° 12' 40" West to the point or place of BEGINNING.
PARCEL THREE:
ALL that certain plot, piece or parcel of land, situate, lying and being at East Marion, Town of Southold, County
of Suffolk and State of New York, bounded and described as follows:
BEGINNING at the northeasterly corner of land of George B. Cabeen and Dorothea C. Cabeen, his wife, whose
east line is 158.43 feet and west line is 161.42 feet, which deed is duly recorded in the Suffolk County Clerk's
Office; running thence along the southerly line of a 16 foot roadway, North 56° 57' 50" East 9.76 feet to a concrete
monument; thence parallel to the easterly line of said land of George B. Cabeen and Dorothea C. Cabeen, his wife,
South 34° 12' 40" East 157 feet more or less to ordinary high water mark; thence running westerly along high water
mark 9.8 feet, more or less, to said land of George B. Cabeen and Dorothea C. Cabeen, his wife; thence along said
land of said Cabeens, North 34° 12' 40" West 158 feet, more or less, to the point or place of BEGINNING.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the par[y of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "parties" when ever the sense of this indenture so requires.
