party of the first part, and
STEVE DI VITO and SUZANNE DI VITO residing at 139 Plainview Road,
Woodbury, New York 11797, as husband and wife
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALI. that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being 1,r~hreXx at East Marion in the Town of Southold, County of Suffolk, and State of New York, being
known and designated as and by Lot No. 5 on a certain map entitled, "Map of Summit Estates, Section 1,"
and filed in the Suffolk County Clerk's Office on November 22, 1993 as Map No. 9426, and being
bounded and described as follows:
BEGiNNING at a point on the southerly side of Marina Lane distant 158.36 feet westerly from the
northerly end of the arc of a curve connecting the westerly side of Shipyard Lane with the southerly side of
Marina Lane;
Running thence South 37 degrees 06 minutes 12 seconds East 215.01 feet;
Thence South 52 degrees 14 minutes 08 seconds West 138.29 feet;
Thence North 37 degrees 45 minutes 52 seconds West 215.00 feet;
Thence along the southerly side of Marina Lane North 52 degrees 14 minutes 08 seconds East 140.78 feet
to the point or place or BEGINNiNG.
BEiNG AND iNTENDED to be same premises conveyed to the Grantor by deed made by Zena Kaplan
and Rhoda Kaplan and recorded February 10, 1986 in Liber 9976 cp 456 (premises and more).
THIS CONVEYANCE has been made with the unanimous consent in writing
of all the stockholders of the party of the first part.
FOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abuttiug the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
,:state and rights of the party of the! first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second phrt, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
.AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose. ~
The word "party" shall be ;as if it read "parties" whenever the sense of this indenture so requires.
