33432, as Trustee of the MURRAY KLAPPER CREDIT SHELTER TRUST UNDER
AGREEMENT DATED FEBRUARY 13, 1997,
party of the second part,
WITNESSETH, that the party of the first part, duly nominated and appointed Successor Trustee
under Trust Agreement dated February 13, 1997, by virtue of the title and authority in me vested
by the terms of said Trust, and in consideration of TEN($10.00) DOLLARS paid by the party of
the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever, one-half of the 50% interest in
and to
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being at Southold, in the
Town of Southold, County of Suffolk and State of New York, bounded and described as
follows:-
BEGINNING at a point on the southerly line of Soundview Avenue, which point is northerly the
following two (2) courses and distances from the intersection of the southeasterly side of
Soundview Avenue and the northeasterly line of Hickory Road;
(1) North 27 degrees 12 minutes 10 seconds East, 134.99 feet; thence
(2) North 36 degrees 52 minutes 10 seconds East, 185.01 feet;
RUNNING THENCE from said point of beginning, along land now or formerly of Macchiarolli
and land now or formerly of Gendron, the following two (2) courses and distances:
(1) South 47 degrees 56 minutes 10 seconds East, 200.84 feet; thence
(2) South 42 degrees 51 minutes 50 seconds East, 310.00 feet to a point;
THENCE from said point along the arc of a curve to the left having a radius of 55.00 feet, a
distance of 46.26 feet;
THENCE along the arc of a curve to the right having a radius of 200.00 feet, a distance of 168.21
feet to a point;

THENCE at right angles, North 42 degrees 51 minutes 50 seconds West, 85.00 feet to a point;
THENCE from said point along the arc of a curve to the left having a radius of 170.00 feet, a
distance of 142.98 feet;
THENCE along a reverse arc of a curve having a radius of 85.00 feet, a distance of 71.49 feet;
THENCE North 42 degrees 51 minutes 50 seconds West, 308.67 feet to a point;
THENCE North 47 degrees 56 minutes 10 seconds West, 196.78 feet to the southeasterly side of
Soundview Avenue;
THENCE along the southeasterly side of Soundview Avenue, North 36 degrees 52 minutes 10
seconds East, 30.12 feet to the point or place of BEGINNING.
Said premises being a vacant private road.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Connie Klapper as Executor of the last will and testament of Murray Klapper, bearing
even date herewith.
TOGETHER WITH all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above-described premises to the center lines thereof,
TOGETHER WITH the appurtenances and all the estate and rights of the party of the first part
in and to the said premises which the party of the second part has the power to convey or dispose
of, TO HAVE AND TO HOLD the premises herein granted unto the party of the second part
and/or assigns forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been incumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the

cost of improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
