Coyae 12 17 late of Gardiners Bay Estates, East Marion, New York, who died on the 10th day of October , nineteen hundred and seventy-eight party of the first part, and PAUL W. HAYES, JR. and BARBARA E. HAYES, his wife, both residing at 5703 Dreyfus St. , Springfield, Virginia., party of the second part, WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the Surrogate's Court, Suffolk County, New York 1000 on December 27, 1978 and by virtue of the power and authority given in and by said last will DISTRICT and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of the sum of 37 THIRTY-NINE THOUSAND FIVE HUNDRED ($39,500.00)----------------------------dollars, SECTION paid by the party of the second part, does hereby grant and release unto the party of the second part, the distributees or successors and assigns of the party of the second 1 part forever, BLOCK ALL. that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, 21 lying and being in-tire at East Marion, Town of Southold, County of Suffolk and State of New LOT York, shown and designated as and by the Lot Numbered 92 on a certain map entitled, "Map of Section 2, Gardiners Bay Estates" and filed in the Suffolk County Clerk's Offic on 9/23/27 under the Map No. 275, which said lot is more particularly bounded and described as follows: BEGINNING at a point on the northeasterly side of Bayview Drive, distant 62 feet more or less easterly as measured on the northeasterly side of Bayview Drive from the extreme easterly end of a curve connecting the northeasterly side of Bayview Drive and the easterly side of Dogwood Lane, said point of beginning also being where the divi- sion line between lots 92 and 93 on the above mentioned map intersects the north- easterly side of Bayview Drive; RUNNING THENCE North 22 degrees 15 minutes 50 seconds East, along said last mentioned land, 125.97 feet; THENCE South 63 degrees 59 minutes 30 seconds East, 34.0 feet; THENCE South 7 degrees 32 minutes 50 seconds West, 155.04 feet to the northeasterly side of Bayview Drive; THENCE Northwesterly along the north- easterly side of Bayview Drive along the arc of a curve bearing to the left, the tie line of which bears North 48 degrees 04 minutes West, a distance along said tie line of 77-87 feet to the point or place of BEGINNING. TOGETHER with the right of way to pass and repass for street purposes over all streets on said map including "the paths" leading to the beach, the fee to the land in said streets and paths, however, to remain in the Gardiners Bay Company Inc- SUBJECT TO Covenants and Restrictions in Liber 3264, Page 225. TOGETHER with the right to use the beach as set forth in Liber 3264, Page 225- BEING AND INTENDED TO BE the same premises conveyed to Lawrence V. Coyne and Gertrude C= V. Coyne, his wife by deed dated 8/21/51 recorded in Lib@r 3264, Page 225. r TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and e., roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, CZ and also all the estate which the said decedent had at the time of decedent's death in said premises, and also `^ the estate therein, which the party of the fust part has or has power to conveyor dispose of, whether individ- ') ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid.
