ROBERT FRENTZEL, residing at 1900 Old Orchard Lane, East Marion, New York, 11939
party of the first part,
ROBERT FRENTZEL and MELANIA M. FRENTZEL, husband and wife, both residing at 1900
Old Orchard Lane, East Marion, New York, 11939
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, East Marion, County of Suffolk and State of New York,
known and designated as Lots Nos. 61, 62 and 63 on a certain Map entitled, "Map of Section 2 Gardiner's
Bay Estates", and filed in the Office of the Clerk of the County of Suffolk on September 23, 1927 as Map
No. 275, being more particularly bounded and described as follows:
BEGINNING at a point on the southwesterly side of Old Orchard Lane, where the same is intersected by
the division line between lots 60 and 61 on the aforesaid map;
RUNNING THENCE along said division line South 58 degrees 58 minutes 30 seconds West 150 feet to the
division line between lots 61 and 72;
THENCE along said division line and along the division line between lots 62 and 63 and lots 73 and 74,
North 31 degrees 01 minutes 30 seconds West 150 feet to the division line between lots 63 and 75;
THENCE along said division line and along the division line between lots 63 and 64 North 58 degrees 58
minutes 30 seconds East 150 feet to the southwesterly side of Old Orchard Lane; and
THENCE along the southwesterly side of Old Orchard Lane South 31 degrees 01 minutes 30 seconds East
150 feet to the point or place of BEGINNING.
TOGETHER WITH the right of way to pass and repass for street purposes over all streets on said map
including "the paths" leading to the beach, the fee to the land in said streets and paths, however, to remain
in Gardiner's Bay Company, Inc.
TOGETHER WITH the right to the use of the beach in common with others.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
February 11, 1989 recorded in the office of the Clerk of the County of Suffolk on March 2, 1989 in Liber
10809 page 55.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the san~e first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
