party of the first part, and RICHARD AMMON HAUPT, residing at P.~. Do;. 212, Eeo[ Quvyue, i,iY 11942, and
STEPHEN AMMON HAUPT, residing at 995 Washington Boulevard, Plainview, NY 11803, each as to an
undivided one-half interest, as tenants in common
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN and no/100ths ($10.00) dollars paid by
th~ party of the second part, does hereby grant and release unto the party of the second part. the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at East Marion, in the Town of Southold, County of Suffolk, State of New York, which plot is
know as and by the lots numbers seventy-three (73) and seventy-four (74) as shown on a map entitled "Map of
Section Two, Gardners Bay Estates, situate at East Marion, Long Island", which map was flied in the Suffolk
County Clerk's Office on September 23, 1927, under the number 275
Parties of the second p~irt are to have a right of way to pass and repass for street purposes over all streets on
said map including "the paths" leading to the beach, the fee to the land in said streets and paths, however, to
remain with the Gardners Bay Company, thc., its successors and assigns.
Parties of the second part are to have the right to use the beach lying between Spdng Pond and the bay end
Old Orchard Lane and the Channel marked upon said map as :Beach for use of lot owners" for bathing and
similar purposes, and are to have a dght of way over Old Orchard Lane and over the beach to the said waters,
such use to be subject to such reasonable restrictions as may be imposed by the Gardiners Bay Company,
Inc., its successors and assigns and said use to be in common with other persons to whom such rights may be
granted by the said Gardners Bay Company, Inc., its successors and assigns.
BEING AND INTENDED TO BE the same premises conveyed to ROBERT C. HAUPT and SALLIE A. HAUPT,
his wife, by deed from Gardners Bay Company, Inc. by deed dated March 31, 1953 and recorded in the
Suffolk County Clerk's Office on April 14, 1953 in Liber 3500 at Page 151.
RESERVING, HOWEVER, a legal life estate in the above-described premises with.~tl~ buildings and
improvements thereon erected in and to the party of the first part, SALLIE A. HAUPT, solely ~r the use and
occupancy of said party of the first part. ..~.~/
TOGETHER with all dght, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and dghts of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
)remises herein granted unto the party of the second part, the heirs or successom and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the dght to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
