August Lane, Greenport, New York 11944, party of the second
part,
WITNESEETH, that the party of the first part, pursuant to
Resolution Number 797-2004 adopted by the Suffolk county
Legislature on August 10, 2004 and, thereafter, approved by the
County Executive on August 18, 2004, in consideration of Two
Hundred Eighty Thousand dollars and other valuable
consideration paid by the party of the second part, does hereby
grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part
forever,
ALL, that certain plot, piece or parcel of land with any
buildings and improvements thereop erected, situate, lying and
being in the Town of Southold, County of Suffolk and State'of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000, Section 038.00,
Block 01.00, Lot 028.000, and acquired by Tax Deed on May 2,
2000, from John C. Cochrane, the County Treasurer of Suffolk
County, New York and recorded on May 4, 2000, in Liber 12039,
CP 996, and otherwise known as and by Town of Southold, being
bounded and described as follows:
BEGINNING'at an iron pipe on the Southerly line of a 50 foot
private road, 620.0 feet Easterly along said Southerly line
from Shipyard Lane, said point of beginning being the
Northeasterly corner of land now or formerly of Geoghegan; from
said point of beginning running thence along said Southerly
line of said 50 foot private road, North 64 degrees 51 minutes
10 seconds East 120.0 feet;
RUNNING Tk~4CE along other land of the parties of the first
part, South 25 degrees 08 minutes 50 seconds East 134.85 feet
to land now or formerly of Northern Oyster Company;
RUNNING THENCE along land last mentioned, South 68 degrees
09 minutes West 120.19 feet to an iron pipe and said land of
Geoghegan;
RUNNING THENCE along said land last mentioned, North 25
degrees 08 minutes 50 seconds West 128.04 feet to the point or
place of BEGINNINg.
TO~ETHER with a right of way, 50 feet width, from the
Northeasterly corner of the premises Westerly about 740 feet to
Shipyard Lane.
TOGETHER with all right, title and interest, if any, of the
party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns
of the party of the second part forever.
SUBJECT to all covenants, restrictions and easements of
record, if any.
AND the party of the first party, in compliance with Section
13 of the Lien Law, hereby covenants that the party of the
first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of
the total of the same for any other purpose.
FURTHER PEOVIDED that this parcel shall be occupied by the
Grantee or Grantee's natural children or Grantee's natural
parents for a period of five years from date of conveyance
herein.- In tne event it is nou so occupie~ t~ls'parcel°shaii
revert to Grantor by operation of law.
THE WORD "PARTY" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
