rclcasc unto the party of the second park the heirs or successors and assigns of the party of thc
second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at East Marion, Town of Southold, County of Suffolk and State
of New York, bounded and deseribad ns follows;
BEGINNING at a point on the easterly side of Shipyard Lane 245.28 feet southerly along the
said easterly line from Main Road, said point of beginning being the northwesterly corner of land
conveyed to Michael Boken and Wife by deed dated Match 4, 1957 and recorded in the Suffolk
County Clerk's Office in Liber 4281, Page 154 on April 3, 1957;
RUNNING TH ENCE Northerly along the easterly side of Shipym'd Lane North 24 degrees
33 minutes 40 seconds West a distance of 100 feet;
THENCE along the land of Joseph Cherepowich and wife two courses as follows;
1. North 65 degrees 26 minutes 20 seconds East 150.00 feet-'
2. South 24 de~rees .33 minutes 40 seconds East 100 feet;
THENCE along land of Michael Boken and wife, South 65 degrees 26 minutes 20 seconds
West 150 feet to the easterly line of Shipyard Lane to the point or place of BEGINNING:
BEING AND INTENDED to be the same premises conveyed to the puny oftbe first part by
dccd dated 6/15/98 and recorded on 7/8/98 in Liber 11903, Page -341.
TOGETllER with all righ~ title and interest, if any, ofthe puny of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and fights ofthe party of the first part
in and to said promises,
TO H,4 ~'E,4ND TO HOLD the premises herein granted unto the patty of thc second part, the
heirs or successors and assigns of the party of the second part forever.
,4ND the party ofthe first pan. covenants that the party ofthe first pan has not done or
soffered anything whereby the said pzemlses here been encumbered in troy way whatever, except
as aforesaid.
,4ND the party of the first park in compliance with Section 13 of the Lien L.nw, covenants
that the party of the Iirst part will z~'eive the consideration for this conveyance and will hold thc
fight to receiw such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment ofthe cost ofthe
improvement before using any part ofthe total ofthe same t'or any other purpose.
The word "patw" shall he construed ns if it read "patties" whenever the sense of this
indenture so requires.
