WITNF-.SSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party oi the second part ~orever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying andbeing~at East Marion in the Town of Southold, County of Suffolk
and State of New York, known as and by Lot #7 on a certain Map entitled
"Map of Section #1 Gardiner's Bay Estates situated at East Marion,
Long Island", which Map was filed in the Office of the Clerk of the
County of Suffolk on 9/23/27 as Map Number 255, said Lot being more
particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Old Orchard Lane (Private
Road) said point being where the division line of Lots 6 and 7 on
the above mentioned Map intersects the said easterly side of Old
Orchard Lane;
RUNNING THENCE South 31 degrees 01 minutes 30 seconds East along
said division line 164.60 feet to a point;
THENCE South 49 degrees 26 minutes 30 seconds East still along said
division line 72 feet more or less or that distance necessary to
reach the ordinary high water mark of Gardiner's Bay;
THENCE Southwesterly along Gardiner's Bay 41 feet more or less to
a point being land now or formerly of Gardiner's Bay Company Inc.
Beach; Said point being the following (2) courses and distances from
the point or place of being:
(1) South 14 degrees 47 minutes 40~ seconds East 161.12 feet;
(2) South 49 degrees 26 minutes 30 seconds East 103.00 feet more
or less;
RUNNING THENCE North 49 degrees 26 minutes 30 seconds West along
the last mentioned land 103 feet more or less to a point set on the
easterly side of Old Orchard Lane (Private Road);
THENCE North 14 degrees 47 minutes 40 seconds West along the easterly
side of Old Orchard Lane (Private Road) 161.12 feet to the point
or place of BEGINNING.
BEING AND INTENDED TO BE the same premises as conveyed to Robert
Lustgarten, deceased, and Josephine Kirby Lustgarten, as tenants
in common, by deed dated September 19, 1984 recorded in the Office
of the Cierk of the County_of Suffolk on September 26, 1984 in Liber

TOGETHER with ali right, title ~d ~terest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center ~nes thereof; TOGETHER with the appurtenances and all the
estate and rights of ~e pa~y of the first part in and to said premises; TO HAVE AND TO HOLD the premis~
herein granted unto the party of the second pa~ the heirs or succ~sors and assi~s of the party of the second pa~
forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement betore using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
