Re: Certificate of Abandonment / Old Menhaden Road
Dear Ms. Dempsey:
I have received your request for endorsement of a certificate of abandonment for the
portion of Old menhaden Road that runs from Wunneweta Road to Nassau Point Road
between Lots 165 and 166 on a subdivision map known as "Amended Map A of Nassau
Point Club Properties". Unfortunately, I am declining your request for the following
reasons.
First, it is my understanding that this road is owned by the "Nassau Point Property
Owners Association" as the successor to "The Nassau Point Club Properties
Association". This association holds this and several other private roads and rights-of-
way for use by all of the property owners on Nassau Point.
Second, this road is not abandoned. It is used, and has been used, by several Nassau
Point residents for access to Nassau Point Road. Further, this road, and other properties
owned by the Nassau Point Property Owners Association have been subject to regular
discussion with various past and current association representatives and myself pertaining
to issues regarding taxes and maintenance. I have been in regular contact with the
association regarding this and other properties for the past 12 years since I took office.
Third, the road is clearly maintained. I have used this road myself, without incident, for
the 12 years I have been inspecting properties in that area. And I am aware of this roads
regular use by Nassau Point Property Owners for the past 28 years.
Perhaps you should contact a representative of the Nassau Point Property Owners
Association or its President, Neil McShane (631) 734-5044 to pursue this issue further.
