After investigation and inspection, the Board finds that the
applicant requests permission to divide property with insufficient
width and area and approval of access, north side Pine Neck Road,
Southold, New York. The findings of the Board are that the
creation of two lots on this property would be adverse to the
future of the Town, and would set a precedent for an additional
15 or 20 undersized lots in the area immediately north of Pine
Neck Road.
The Board finds that strict application of the Ordinance
would not produce practical difficulties or unnecessary hardship;
the hardship created is not unique and would be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will change the
character of the neighborhood, and will not observe the spirit
of the Ordinance.
THEREFORE IT WAS RESOLVED, Robert J. Heaney, 1400 Pine Neck
Road, Southold, New York, be DENIED permission to divide property
with insufficient width and area and approval of access, north
side Pine Neck Road, Southold, New York.

Pursuant to the requirements of Sections 1323 to 1332 of the Suffolk
County Charter, the above captioned application which has been referred
to the Suffolk County Planning Comission is considered to be a matter for
local, determination. The decision of local-determination should not be
construed.as either, an approval or a disapproval, .
'Comments: The Board of Appeals should cautiously exercise its discret-
ionary power in ~rantin~ such substandard iot area variances which only
serve to undermine the effectiveness of the'zonin~ ordinance~ alter. ~he
character of the area and establish a precedent for the continuance of
such a practice.
