(631) 765-1809 · Fax (631) 765-9064 FINDINGS, DELIBERATIONS, AND DETERMINATION MEETING DATE: FEBRUARY 2, 2006 ZBA Application No. 5814 - GEORGE and ELIZABETH IRELAND Property Location: East End Road, Fishers Island CTM 4-7-3.3 (part of Lot 3) SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review fails under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 2.40+- acre parcel is improved with a single-family dwelling and accessory garage with living quarters, as shown on the 9/18/2004 survey prepared by CME Associates Engineering, LandSurveying and Architecture, PLLC. BASIS OF APPLICATION:. A variance is requested under Sections 100-31A and 100- 242A, based on the Building Inspector's September 26, 2005 Notice of Disapproval concerning a request for a building permit to construct an addition and as-built alterations to an existing accessory building with living space. The reasons for disapproving the building permit are that the addition will change the intensity of use, increasing the degree of nonconformity, and the as-built additions and alterations are not permitted in an accessory building, and only one, single-family dwelling is permitted on a lot. A Certificate of Preexisting Use was issued 7/5/2001 for a single-family dwelling and "accessory garage" with living space above, FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 26, 2006 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTED: Applicant/owners wish to undertake as built renovations to their accessory garage with living space that exists on the first and second floors, to enclose an existing porch and construct a new screen porch. Ireland CTM 4-7-3.3 (part of 3) REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Board has determined that the immediate area around the subject property and on Fishers Island in general, typically includes many pre-existing non-conforming accessory buildings with living quarters on single-family lots that are also improved with a single-family dwelling. There is on record an updated pre-existing Certificate of Occupancy from the Town of Southold Building Department signed by Gary Fish and dated January 25, 2006 which states that the accessory structure on the Ireland's property has a lawful pre-existing use as a garage with living quarters on both stories. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than the relief requested. The proposed as built renovations and new construction are necessary to address a health hazard caused by extensive mold, to make code-compliant several features of the pre-existing structure that do not comply with applicable building codes, install an energy efficient heating system, and to correct structural deterioration cased by water seepage. 3. The variance granted herein is not substantial. The renovated structure will occupy the same building footprint and will be used for the same purposes as the pre-existing structure, i.e. as a garage with living quarters on the first and second floors. While the proposed enclosure of a pre-existing porch and the construction of a new unheated seasonal screen porch might be construed as increasing the intensity of the non- conforming use, they are offset by the proposed reduction in intensity from a four- bedroom to a three-bedroom structure. 4. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 5. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of renovations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Dinizio, and duly carried to GRANT the variance as applied for, as shown on the 3/25/04 diagrams prepared by AIlie Raridon Associates and the 9/18/2004 survey prepared by CME Associates Engineering, Land Surveying and Architecture, PLLC, SUBJECT to the Condition that the accessory garage with living quarters not be rented as a separate dwelling unit, or for purposes of creating an additional lot.
