Tuthill and Others, Section One, Filed 1/15/1929 CTM Parcel it 1000-126-10-9.5 SEQRA Determination: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. Property Facts/Description: The applicants' property contains 20,086 square feet and is improved by a single-family dwelling and the deck addition (as built), as shown on the survey prepared by Nathan Taft Corwin III dated May 16, 2008. Area Variance Relief Requested: The as-built deck addition to the dwelling on this 20,086 square foot nonconforming lot is not permitted at 37 feet, pursuant to Article XXIII, Section 280-124 which states that non conforming lots, measuring between 20,000 and 39,000 square feet, require a minimum of 50 feet on the setback from the rear yard lot line. Findings of Fact Reasons For Board Action: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. New York Town Law Section 267b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a Page 2 -August 21, ZBA# 6183 -V. and M. Papa CTM 126-10-9.5 detriment to nearby properties. This is an odd-shaped lot of 20,086 square feet, improved with a dwelling and the as-built deck addition without steps, set back at 37 feet from the rear property line. The applicant placed his dwelling near center on the lot and built the deck almost centered at the rear wall of the house, which cannot be seen from the right-of-way or road. The deck will remain as built measuring 30 feet by 13 feet and is 37 feet from the rear property line, screened by a white fence. The deck was built +/- 16.5 inches off grade, and there are no steps from the deck to the ground. The entire back yard is screened with a 6 ft. high fence and mature evergreens, providing privacy for the homeowner and neighbors. 2. New York Town Law Section 267b(3)(b)(3)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house is centered on the lot and there are two front yards, and rear yard that is opposite from Bray Avenue. 3. New York Town Law Section 267b(3)(b)(3)(3). The variance requested is not substantial. 4. New York Town Law Section 267b(3)(b)(3)(5). The difficulty has been self created inasmuch as the applicant should have applied for a variance before the house was being constructed. 5. New York Town Law Section 267b(3)(b)(3)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. New York Town Law Section 267b(3). Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of his property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT AS APPLIED FOR, ACCORDING TO THE SITE PLAN DRAWN BY Nathan Taft Corwin III, Land Surveyor dated May 16, 2008, and Elevation Drawings 1, 2 and 3 dated April 13, 2008 as Page 3 - August 21, ZBA# 6183 -V. and M. Papa CTM 126-10-9.5 certified by James Deerkoski, P.E, and subject to the following Condition: The deck area shall not be expanded for oversized steps or other extension. That the above condition be included in the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
