BETWEEN JOAN A. ROGERS, as surviving tenant by the entirety, residing at 8200 Route 25, East Marion,
NY 11939
party of the first part, and JEFFREY S. ROGERS, residing at 1280 Diedricks Road, Odent, NY 11957 and
ALAN R. ROGERS, residing at 1295 Rock Crab Way SW, Shallotte, NC 28470-5402, each as to an undivided
fifty (50%) percent interest, as tenants-in-common
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN and no/100ths ($10.00) dollars paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALI. that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at East Marion, in the Town of Southold, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at the comer formed by the intersection of the southerly line of Main Road and the easterly line of
Orchard Lane;
RUNNING THENCE North 37 degrees O0 minutes East, along the southerly line of Main Road 103.15 teet;
THENCE South 39 degrees 08 minutes 20 seconds East 264.50 feet to the northerly line of land now or
formerly of Bennett;
THENCE South 37 degrees 47 minutes West 103 feet to the easterly line of Orchard Lane;
THENCE North 39 degrees 06 minutes West along the easterly line of Orchard Lane 263.20 feet to the
southerly line of Main Road at the point or piece of BEGINNING.
SUBJECT TO a right of way over the wesleriy twelve (12) feet of premises herein described.
BEtNG AND INTENDED TO BE the same premises conveyed to JAMES ROGERS and JOAN A. ROGERS
by deed made by EVA T. UDELL dated November 26, 1954 and recorded in the Suffolk County Clerk's Office
on November 26, 1954 in Liber 3798 at Page 433.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and
improvements thereon erected in and to the party of the first pert, JOAN A. ROGERS, solely for the use and
occupancy' of said party of the first part.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
)remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anylhing
whereby the said premises have been encumbered in any way whatever, excepl as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
