consideration paid by the party of the second part, docs hereby granl and release unto the party
of the second part, the heirs or successors and assigns of the party of thc second part forever, her
one-halfintcrest in and to
ALL that certain ~'lot. piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at East Marion, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at the southeasterly corner of land now or formerly of Flora Raymond, said
point being on the northerly line of a certain 24 foot right of way and 100 feet easterly along
said right of way from the easterly line of Bay Avenue;
RUNNING THENCE northerly along said land now or formerly of Flora Raymond, 100 feet
to land now or formerly of Virginia Lemley;
THENCE easterly along said land now or formerly of Lemlcy, 90 feet to the westerly line of a
certain 20 foot right of way;
THENCE southerly along the westerly line of said right of way, 100 fi~et to the northerly line
of said 24 foot right of way;
THENCE westerly along the northerly line of said 24 foot right of way, 90 feet to the point or
palce of BF-.GINNING.
TOGETHER with a right of way 20 feet in width along the above described easterly line and a
right of way 24 feet in width along the above described southerly line and its extension
westerly to Bay Avenue.
BEING ~ND iNTENDED TO BE the same premises conveyed co the party of the first part by
deed dated 1/25/93 and recorded 3/17/93 in the Office of the Suffolk County Clerk in Liber
11622, Page 054.
TOGETHER with all righL title and interest, if any, of the party of thc flint pan in and to any
streets and roads abutting the above described premises to the center lines thereot~ TOGETHER
with thc appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party ofthe first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of Ihe first par~, in compliance with Section 13 of the Lien Law, covenants that
the party of thc first part will receive the consideration for this conveyance and will hold thc
right to receive such consideration as a trust fund to be applied first for thc purpose of paying the
cost of thc improvement and will apply the saree first to the payment of the cost of thc
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
