Minutes of Meeting held

Adoption of Meeting Minutes:

Acceptance of meeting minutes from June 10, 2008.

from June 10, 2008.

SAWICKI (Estate) PROPERTY

Reviewed new PDR application.
Melissa Spiro reviewed her staff report with LPC members. LPC would like the project designed so
that house lot with house and barns remains attached as building envelope to preserved farm area.
LPC would like project designed to meet preservation of a least 80% of the property in keeping with
Conservation Subdivision regulations.
MOTION made by Eric Keil, seconded by Lillian Ball, to direct Melissa Spiro to commission an
appraisal for the value of a development rights easement on the Sawicki property subject to
landowner presenting preservation component meeting at least 80% preservation.

Reviewed Open Space application.
Melissa presented new LPC application. Landowner made application for Town to purchase lot
recently created in subdivision. LPC reviewed offer with assumption that landowner would like full fee
value for the lot. LPC reviewed whether lot would provide any significant access to Goose Creek as
lot is accessed via driveway. There is public access to the creek existing at the head of the creek by
the North Bayview Road bridge. LPC determined that purchase would eliminate residential dwelling
and would provide a nice area for bench, etc.; however, as there are other existing dwellings already
in area, LPC decided that this is not a priority purchase at full fee value. LPC asked Melissa Spiro to
discuss Bargain Sale option with landowner, clarifying that LPC would only be in favor of purchase at
a very significant Bargain Sale.

Update: re: meeting with P. Matthews and Planning Board Staff/LPC Coordinator
Melissa gave LPC update of recent meeting with Paul Matthews and went over the history of the
Matthews property. LPC decided that this was a priority agricultural property to preserve and that in
this instance, although the landowners have not filed an application, commissioning an appraisal to
have an offer to discuss with the landowners may keep the process moving toward preservation.
MOTION made by John Sepenoski, seconded by Lillian Ball, to direct Melissa Spiro to commission an
appraisal of the Matthews property for the purpose of purchasing a development rights easement.
Appraisal to value the easement under two (2) difference scenarios: Scenario 1: PDR on all but 2
acre reserve around existing house; and Scenario 2: Two 35± acre farms – each with 30 acres PDR
and one 5 acre building envelope (one building envelope on the south side of the property around the
existing house and one building envelope on the north side of the property).

Reviewed inquiry from Real Estate agent.
LPC discussed inquiry to offer full fee purchase at market value of 5± acre non-subdividable building
lot on northeast side of Brushes Creek. Access to lot is over three (3) other lots on east side of
Brushes Creek. LPC discussed lot, access issues, buildability issues and decided that it was not a
priority preservation project at full fee value. LPC would be interested in preservation if all lots on the
east side of Brushes Creek were offered for preservation (they are not all under same ownership).
LPC would be in favor of re-reviewing if property offered at very significant bargain sale or as a gift.
