WITNESSETH, that the party of the first part, in consideration of TEN and no/100ths ($10.00) dollars paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in East Marion, Town of Southold, County of Suffolk, State of New York, bounded and
described as follows:
BEGINNING at a concrete monument set on the southeasterly line of a certain 24 foot private road, 140.0 feet
northeasterly along said southeasterly line from its intersection with the northeasterly line of Bay Avenue;
being the northwesterly corner of land now or formerly of Edith Moore and the northeasterly corner of the
premises herein described; from said point of beginning running along said land of Edith Moore and passing
through a concrete monument, South 43 degrees 19 minutes 40 seconds East 195 feet, more or less, to the
shore of Marion Lake; thence southwesterly along said shore of Marion Lake, 57 feet, more or less to land now
or formerly of Kenneth Dimon; thence along said land of Dimon on a line parallel with the northeasterly
boundary line as hereinabove described, and passing through a concrete monument, North 43 degrees 19
minutes 40 seconds West 200 feet, more or less, to a concrete monument set on said southeasterly line of
said 24 foot private road; thence along said southeasterly line of said 24 foot private road, North 55 degrees
47 minutes 20 seconds East 57.0 feet to the point of beginning.
TOGETHER with a dght of way over said 24 foot private road from the northeasterly comer of the premises
southwesterly to Bay Avenue.
TOGETHER with all the right, title and interest of the party of the first part, in and to land under the waters of
Marion Lake, abutting said premises.
BEING AND INTENDED TO BE the same premises conveyed to KENNETH RAAB and OLBA RAAB, his wife,
by deed from FREDERICK L. ESKHOLME dated February 15, 1958 and recorded in the Suffolk County
Clerk's Office on February 25, 1958 Jn Liber 4431 at Page 334.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and
improvements thereon erected in and to the party of the first part, OLGA RAAB, a/ida OLGA L. RAAB, solely
for the use and occupancy of said party of the first part.
TOGETHER with all dght, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word ~party~ shall be construed as if it read aparties" when ever the sense of this indenture so
requires.
