This Indenture, made the 27th day of
February, Two Thousand & Three,

Avenue, Manozville, New York 11949

residing at 5,68 Armstrong Avenue, Staten Island,
New York 10308, as Co-Trustees of T~E JOHI~ J.
GORGA, SR. I~/~'gOCABLE TRUST AGREE~ENT, dated
February 27, 2003
party of the second l~art,
Witnesseth, that the~arty of the first Dart,
in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part,
does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of
the party of the second Dart forever, in
SEE SCHEDULE "A" ATTACHED
Being and Intended to be the same
premises conveyed to the Grantor herein by Deed
dated Nove~be,r 19, 1993 and recorded in the Office
of the Clerk of Suffolk County on Deceeber 3, 1993
in Liber 11654 at Page 424.
Together with all right, title and interest,
if any, of the party of the first part in and to
any streets and roads abutting the above described
premises to the center.lines thereof;
Together with the appurtenances and al~ the
estate and rights of the ~rty of the first part in
and to said premises;
TO have and to hold the'premises herein
granted unto the party of the second part, the
heirs or successors and assigns of the ~rty of the
second,art forever.
and the party of the first ~art covenants that
the Derty of the first Dart has not done or
suffered anything whereby the said premises have
been encurabered in any way whatever, except as
aforesaid.

and the party of the first part, in compliance
with Section 13 of the Lien Law, covenants that the
party of the first part will receive the
consideration for this conveyance and will hold the
right to receive such consideration as a trust fund
to be applied first for the purpose of ~aying the
cost of improvement end will apply the same first
to the payment of the cost of the improvement
before using' any ~art of the total of the same for
any other purpose. The word 'party" shall be
construed as if it read 'parties' whenever the
sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
b~ing at East Marion, Town of Southold, Suffolk County, State of
New York, bounded and described as follows:
BEGINNING at a monument at the intersection of the westerly line
of a strip of land 25 feet in width along the easterly line of
premises herein described with the northerly line of a second
strip of land 24 feet in width, running about parallel to and
at,ut 250 feet northerly from Gardiners Bay;
RUNNING THENCE along the northerly line of the second above
mentioned strip of land South 43 degrees 19 minutes 40 seconds
West 333.51 feet to a monument and land formerly of Schiavoni
and otheres;
THENCe. along said land North 20 degrees. 13 minutes 10 seconds
West 22 feet to the shore line of Marion Lake;
THENCE along the shore line of Marion Lake (having a tie line of
North 1'.1 degrees 06 minutes 20 seconds West 151.38 feet) to land
now or formerly of Edna A. Brown;
THENCE along said land North 6~ degrees 05 minutes 40 seconds
East through a monument 271 feet to a monument on the westerly
side of the first mentions strip of land;
THENCE along said line South,25 degrees 54 minutes 20 seconds
East 50 feet to the point or place of BEGINNING.
TOGETHER also with a :non-exclusive right of way over a 25 ft.
wide strip of land from Marion Lake along the southeasterly line
of the above mentioned premises to land now or formerly of F.
Milton Welch and thence northerly along said land formerly of F.
Milton Welch about 1100 ft. to land now or formerly of Florence
T~[thill and continuing northerly, 16 ft. in width over said land
now or formerly of Florence Tuthill and land now or formerly of
Griffing to the Main Road, ~long said land now or formerly of f.
Milton Welch.
TOGETHER also with a non-exclusive right of way along the
westerly line of land now or formerly of Edna A. Brown, from the
westerly end of the above mentioned 25 ft. strip of land
southerly about 250 ft.. to the Bay, said right of way being 10
ft.. in width at the northerly and about 20 ft. in width at the
