BEING AND INTENDED TO BE the same premises conveyed to the Grantors by deed from Veto
Nicholas Fuecillo and Joan Bollman Fuccillo, his wife, dated May 6, 1997 recorded in the Office of
the Clerk of the County of Suffolk on June 5, 1997 in Liber 11834 cp 215.
TOGETHER with all fight, title and interest, if any, oftbe party of thc first part in and to any streets and
roads abutting the above described premises to thc center lines thereof.
TOGETHER with thc appurtenances and all the estate and rights of the party of thc first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto thc party of the second part, the heirs or
successors and assigns of the party of thc second part forever.
AND thc party of the first part covenants that the party of thc first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of thc Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold thc right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment ofthe cost ofthe improvement before using any part oftbe total of
the same for any other purpose. The word "parly" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.

ALL THAT CERTAIN PLOT, piece or parcel of land, situate, lying and being in the Hamlet of East
Marion, Town of Southold, County of Suffolk and State of New York, being more particularly bounded and
described as follows:
BEGINNING at a monument set on the southerly side of a 25 foot right of way; said monument
being about 208 feet more or less northerly from Gardiners Bay and 100 feet southwesterly along said right
of way from a stake at land formerly of F. Ilton Welch; said point being the northwesterly comer of land
conveyed by F..dna A. Brown to Earle H. Vail by deed dated May 18, 1946 and recorded in Suffolk County
Clerk's Offiec on May 21, I946 in Liber 2667 of deeds at page 292;
RUNNING THENCE along the last described land, South 29 degrees 46 minutes 20 seconds East
192.65 feet to the mean high water mark of Gardiners Bay;
RUNNING THENCE along the high water mark of Gardiners Bay on a tie line course bearing South
34 degrees 23 minutes 40 seconds West, 53.15 feet to land now or formerly of bollman;
RUNNING THENCE along said land, North 29 degrees 46 minutes 20 seconds West 201.28 feet to
a monument scl at the northwesterly comer of said land of Bollman and the southerly side of said right of
way.
RUNNING THENCE along the southerly side of said right of way, North 43 degrees 19 minutes 40
seconds Easl 50 feet to the point or place of BEGINNING.
TOGETHER WITH a right of way over said twenty-five (25) foot right of way running from the
northwesterly comer of the premises herein described to said land formerly of F. Milton Welch, and thence
northerly, twenty-five (25) feet in width, along said land formerly ofF. Milton Welch about eleven hundred
(1100) feet to land now or formerly of Florence Tuthill and continuing northerly along said land formerly of
F. Milton Welch sixteen (16) feet in width, over said land now or formerly of Florence Tuthill and land of
Griffing to the Main Road; said right of way to run with the premises herein conveyed.
