RESERVING, HOWEVER. a legal life es~e in the above-deseribed premises with the

THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during their lifetime by a properly written and acknowledged instrument,
and recorded prior to death, making specific reference to this power of appointment. The
party of the first part may not appoint themselves, their estates, their creditors or the creditors
of their estate, under any circumstances.
THIS DEED IS AN EXERCISE OF THE SPECIAL POWER OF APPOINTMENT
contained in a certain prior deed in respeet to the above-described premises dated Jub' 16,
1997, recorded in the Suffolk County Clerk's Office on August I$, 1997, in Liber 11846,
Page 794; and it is further stated that the party of the first part continues to reserve the
legal life estate as set forth in the aforementioned deed, ns well as her reservation of her
special power of appointment set forth therein.
TOGETHER with all right, tide and interest, if any, of the party of the first part in and to any
streets and roads abmting the above doscribed premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and flights of the party of the first part in and to said
premises; TO HAVE AND 'FO HOLD the premises herein granted unto thc party of the second
part, the heirs or successors and assigns of the patty of the second part forever.
AND the pa~ of thc first part covenants that the pa~, of thc first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part. in compliance with Seclion 13 of the Lien Law, covenants that
the party of the first part will receive the consid~:ration I~r this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first Ibr the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any pan of the total of the same for any other purpose.

requires.
