BARGAIN AND SALE DEED WITH COVENANT
AGAINST GRANTOR'S A CT
THIS INDENTURE, made as of the l~~7 day of May, 2002, between
SOL M. ISRAEL and JACLYN GOLDFARB ISRAEL, husband and wife, residing at IO
Devonshire Road, New Rochelle, New York 10804, party of the first part, and
EDWARD F. SCHILLER and DIANNA SCHILLER, husband and wife, residing at 540 Cedar
Road Cutchogue, New York 11935, party of the secondpart,
WITNESSETH. that the party of the firstpart, in consideration often Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the secondpart, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected (if any) more particularly described on Schedule A attached hereto and made a part
hereqf,
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above-described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HA VE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the secomt part forever.
AND the par~ of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement before
using anypart ~f the total of the same for any other purpose.
AND the party ~if the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
Said premises intended to be the same premises conveyed to the party of the first part by deed
dated January ]9, 1985 and recorded on February 8, 1985 in Liber 9732, Page 22Z
The word '`party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.

ALL that certain plot, piece or parcel of land, lying and being at East Marion, Town of Southold, County of
Suffolk and State of New York, known as and by Lot Number 6 as shown oo a certain Map entitled, "Highpoint
at East Marion, Section One" and flied in the Office of the Clerk of Suffolk County on January 11, 1984 as Map
Number 7680; said lot being more particularly bounded and described as follows:
BEGINNING at a point on the westerly side of Pine Terrace where same is intersected by the division line

RUNNING THENCE along the westerly and southerly side of Pine Terrace southerly, southeasterly and easterly
