r© THIS INDENTURE, made the /~ day of October, in thc year, Two Thotc~.and Two BETWEEN SUSAN E. KING, residing at 99 Cayuga Street, Homer, New York 13077, as Successor Trustee of the FLOYD F. KING, JR. REVOCABLE TRUST DATED NOVEMBER 4, 1993 party oflhe first part, and SUSAN E. KING, residing at 99 Cayuga Street, Homer, New York 13077; party of the second part, WITNESSETH, that the party of the first part, duly nominated and appointed Successor Trustee under Trust Agreement dated 1 I/4/93, by virtue of the title and authority in me vested by the terms of said Trust, and in consideration of TEN ($10.00) DOLLARS paid by the party of thc second part, does hereby gmat and release unto the party of the second part, the heirs or successors and assigns of the party of the second pan forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Orient, in the Town of Southold, County of Suffolk and Slate of New York, being more pa~icularly bounded and described as follows:- BEGINNING at a poinl on the westerly line of Village Lane where same is intersected by the northerly line of lands now or formerly of William Mattessoni and Pamela Valentine, and the southerly line of lands now or formerly of Walter Millis; RUNNING THENCE North 87 degrees 46 minutes 20 seconds West, 128.95 feet to the easterly line of a certain right of way; RUNNING THENCE along the easterly line of thc said right of way, South 18 degrees 05 minutes East 35.17 feet; RUNNING THENCE South 71 degrees 55 minutes West, 42.12 feet to the ordinary high water mark of Orient Harbor; RUNNING THENCE along thc ordinary high water mark of Orient Harbor on an irregular curve to the north being described as a tie line course of North 04 degrees 06 minutes West, 85.00 feet to lands now or formerly ofD. Clayes Bahrenburg; RUNNING THENCE along said lands now or formerly of D. Clayes Bahrenburg, North 54 dagmcs 44 minutes 30 seconds East, 91.58 feet to lands now or formerly of Walter Millis; RUNNING THENCE South 42 degrees 52 minutes 30 seconds East, 131.20 feet to the westerly line of Village Lane, and the point or place of BEGINNING. Said premises being SUBJECT TO a certain 15 foot wide right of way which begins on thc westerly side of Village Lane where the easterly and westerly boundaries of lands now or formerly of William Mattessoni and Pamela Valentine intersect with the westerly linc of Village Lane, the easterly linc of which commences on a course of North 18 degrees 05 minutes West and extends on said course through the above-described property. SUBJECT TO the personal right of William A. King the gruntce in a certain deed bearing even date herewith while he is the owner of those premises contiguous and south of the subject parcel or his stepbrother, Robert Hughes Tamer, if he shall be the owner of said parcel, to have water supplied by a well on the above-described property hereby conveyed. This right is a personal right and docs not run with the land and shall expire whenever either William A. King or Robert Hughes Turner is not the owner oftha above-referred to property which is contiguous and to the south of the parcel herein conveyed. TOGETHER WITH all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above-described premises to the conter lines thereof; TOGETHER WITH the appurtenances and all the estate and rights of thc party of the firsl part in and to the said premises which the party of the second part has the power to convey or dispose of; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part and/or assigns forever. AND thc party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that thc party of thc first part will receive the consideration for this conveyance and will hold thc right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
