Said right-of-way and easement having been hereto conveyed to Donald A. McNei]l by a certain
deed dated March 4, 2002, and recorded on May 1, 2002, in the Office of the Suffolk County
Clerk in Libor 12183, Page 556.

THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as olden as they may choose, to change their remainderman as
follows:
TO or among any one or more members ora class consisting of thc party of the party of the first
inn's descendants, in any degree, whether presently living or bom hcreaffcr, in such proportions
and amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during her lifetime by properly written and ac'knowledged instrument, and
recorded prior to death, making specific reference to this power ofappoin~raent. The party ofthe
firsl part may not appoint themselves, their estate, their creditors or the creditors of their estate,
under any circumstances.
TOGETHER with all right, titlc and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of thc party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
pan, the heirs or successors and assigns of the party ofthe second part forever.
AND th~ party of thc first part covenants that th~ party of thc first parr has not done or suffered
anything whereby the said premises have bccn encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of thc Lien Law, covenants that
the part), of the first pan will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust Fund to be applied first for the purpose ofpaying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of thc same for any other purpose.
The word "party" shall be construed as ifil read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
