2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF APRIL 3, 2003

Parcel 81-3-27.1.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if
the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 93,663.23 sq. ft. parcel has
143.67 ft. frontage along a private right-of-way along the nodherly property line, and the
premises is improved with an existing one-story +- 2365 sq. ft. dwelling and deck
addition, accessory shed, pergola, and garage structures, as shown on the survey
prepared February 18, 2002, amended June 4, 2002, by Joseph A. Ingegno, L.S.
BASIS OF APPLICATION: Building Department's August 20, 2002 Notice of
Disapproval, amended January 22, 2003, in applicant's proposal to demolish the existing
dwelling and to construct a new dwelling at less than 75 feet from the rear lot line and
bulkhead. Also requested are a new swimming pool structure at less than 75 feet from
the bulkhead, and Variances under Section 100-235A(1) and Town Law Section 280-A,
for a determination regarding improvements over an existing private right-of-way for
sufficient access by fire and emergency vehicles.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 20,
2003, at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence, the
Zoning Board finds the following facts to be true and relevant:
VARIANCE REQUESTS: Applicant proposes to construct a new dwelling, after removal
of the existing dwelling with additions. The new dwelling is shown at an improved
angled, allowing for an increased overall setback from the bulkhead and rear lines,
utilizing a portion of the existing nonconforming yard for a new porch. The closest
corner of the new porch will be 25 feet from the existing bulkhead and approximately 56
feet from the apparent high water line shown on the site plan map prepared by Charles
A. Napoli, Architect dated June 27, 2002, revised January 20, 2003.
Applicant also requests approvals under New York Town Law, Section 280-A, and
Zoning Section 100-235 (A-l) concerning sufficient egress and ingress over an existing

traveled right-of-way extending over privately owned lands now or formerly of Kaytis,
and land of McDonald, from a point starting along the east side of Paradise Point Road,
Southold, to the applicant's lot.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant of the variances requested will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The proposed
reconstruction of the dwelling is within keeping of the neighborhood setbacks, which
houses have similar sloping and pitched roofs and traditional gables, open porch design.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than variance requests.
3. The requested area variance is substantial, however this is a reconstruction of an
existing nonconforming house, and applicant has agreed to move the house to increase
the rear yard setback and decreasing the front setback, and removing the proposed
swimming pool from the plan. The code requirement is 75 feet setback from the
bulkhead.
4. The difficulty is self-created since properties are acquired with knowledge of
nonconformities and limitations of the existing building and property.
5. No evidence has been submitted to suggest that the new dwelling will have an
adverse impact on physical or environmental conditions in the neighborhood. By letter
dated August 1, 2002, the Board of Town Trustees granted approval with conditions at a
Regular Meeting held July 24, 2002 for construction of a new residence after
demolishing the existing residence.
6. Grant of the requested variances is the minimum action necessary and adequate to
enable the applicant to enjoy the benefit of a dwelling, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member
Goehringer, seconded by Chairwoman Tortora, and duly carried, to
DENY the setback relief requested for a 25.75 ft. setback at its closest point to
the bulkhead, and to

GRANT Alternative Relief, as shown on the site plan prepared by Charles A.
Napoli, Architect dated June 27, 2002, revised January 20, 2003, with a new
setback of 27.65 feet from the bulkhead, and 59.25 feet to a tie line along the
apparent high water mark, after reducing the square footage to meet this
requirement (1607 sq. ft. to 276 sq. ft.) and omitting the proposal for a swimming
pool structure in the rear yard; and to
GRANT a Variance under New York Town Law, Section 280-A, and Zoning
Section 100-235A, SUBJECT to continued maintenance of the private right-of-
way, with base improvements at a minimum width of 15 feet within the easement
area, at all times for safe and adequate ingress/egress by fire and other
emergency vehicles to the applicant's dwelling, and full unobstructed vehicular
passage.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.

25, 2006.
BASIS OF APPLICATION: Request for a Variance under Section 280-14 concerning a request to amend
Building Permit No. 32082-z concerning a new dwelling, under construction, with conversion of the third-floor
attic area to a finished floor area, determined to be a third story under the Building Inspector's April 2, 2007
Notice of Disapproval.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning
reply dated March 14, 2007 states that the application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: This application is exempt from the
Local Waterfront Revitalization Program Code standards because the Zoning Code relief herein concerns a
limited area within the existing roof lines (777 sq. ft. attic area) of this new dwelling under construction (see
pending inspections under Building Permit 30762-Z), which does not physically disturb or affect the land areas
of this parcel.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 31, 2007, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the
property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant wishes to convert, insulate and sheetrock a 777
square foot section of the existing attic above the existing second-floor livable floor area for use as storage
and the owner's craft room.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:

1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to
nearby properties. The variance requested would allow the conversion of a 2¼-story house to allow storage use and a
craft room of a 77'? square foot area above the second floor of this new dwelling. This alteration involves installing an
internal ceiling and finishing an attic (insulation and sheetrock).
2. The benefit sought by the applicant, conversion of a 77 ~'square foot storage space to a habitable space robe used
for storage and crafts, cannot be achieved by any method feasible for the applicant to pursue ~her than an area
variance.
3. The variance granted herein is not substantial. It involves no change to the exterior of the house. No plumbing will
be added, other than required for a sprinkler system.
4. The difficulty has been self-created. It is the result of the applicant's decision to convert attic space to finished
(habitable) space pursuant to the insurance requirement that the entire house be fitted with a sprinkler system.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of use of this 77¢ square foot area above the second floor, while preserving and protecting the
character of the neighborhooo and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Oliva, and duly
carried, to
GRANT the variance as applied for, as shown on the August 15, 2004 Attic Plan A5, revised March
11,2007 by Charles A. Napoli, Architect, subject to the following Conditions:
Sprinkler system as proposed by applicant and discussed at the public hearing on May 31, 2007.
1. This variance is limited to a 77~/,~quare foot area of the existing attic for conversion.
2.
That these ZBA conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the vadance given such as extensions, or demolitions which are not shown on the applicant's diagrams
or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This
action does not authorize or condone any current or future use, setback or other feature of the subject property that may
violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.

Dear Ms. Sanford:
Based on the information you have submitted, the New York State Depadment of Environmental
Conservation has determined that:
The portion of your propertywhich is located landward of a functional and substantial man-made
structure (a bulkhead) greater than 100' in length, constructed prior to 8/20/77 as shown on
Aerographics photograph #73-2049, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no
permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier,
or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a perrmt
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Re: Sanford Residence Fireplace System
Dear Mr. Bertani:
We are the manufacturer for the FamilyRoom fireplace control system installed at the Sanford Residence
in Southold, New York. A complete binder of technical specifications for the UL-listed equipment and
installation instructions was provided to you earlier this month, and covers all aspects of the fireplace. It is
our understanding that the components we provided meet or exceed the minimmn requirements of the New
York State anti ICC code.
Part of the system includes a motorized damper located in the UL-listed chinmey system. This damper Ls
an effectively air-tight mechanism fabricated by Security Ct~meys, and coordinated by the switch-operation
of the fireplace. As such, when closed, it is even more effective than glass doors in sealing the fireplace and
addressing enepgy code concerns. We recomanend that it be allowed as an effective alternative and more than
equivalent standard to the requirement of glass doors for this fireplace.

Duct Construction:
All joints, seams, and connections must be securely fastened with welds, gaskets, mastics
(adhesives), mastic-plus-embedded-fabric, or tapes. Duct tape is not permitted.
Exception: Continuously welded and locking-type longitudinal joints and seams on ducts
operating at less than 2 in. w.g. (500 Pa).
Ducts shall be supported every 10 feet or in accordance with the manufacturer's instructions.
Cooling ducts with exterior insulation must be covered with a vapor retarder.
Air filters are required in the return air system.
The HVAC system must provide a means for balancing air and water systems.
Temperature Controls:
Each dwelling unit has at lesat one thermostat capable of automatically adjusting the space
temperature set point of the largest zone.
Electric Systems:
Separate electric meters are required for each dwelling unit.
Fireplaces:
Fireplaces must be installed with tight fitting non-combustible fireplace doors.
Fireplaces must be provided with a source of combustion air, as required by the Fireplace construction
provisions of the Building Code of New York State, the Residential Code of New York State or
the New York City Building Code, as applicable.
