DECLARATION OF COVENANTS
THIS DECLARATION made this l.~day of ~b~- , 2010, by Elliot
Bruce Heath and Ora Jean Heath, residing at 500 Hippodrome Drive, Southold,
11791, hereinafter referred to as "DECLARANTS":
WI TNES SETH :
WHEREAS, DECLARANTS are the owners of certain real property located
on Hippodrome Drive, Southold, Town of Southold, County of Suffolk, State
of New York, described in the Suffolk County Tax Map as District 1000,
Section 66, Block 02, Lot 13, which is more particularly bounded and
described as set forth in "Schedule A" annexed hereto, hereinafter referred
to as the Property;
WHEREAS, the DECLARANTS made application to the Southold Zoning Board
of Appeals (hereinafter ZBA) for relief from Section 280-124 of the
Southold Town Code for the purpose of undertaking certain additions and
alterations to an existing single-family dwelling, and the ZBA held a
public hearing on the application on February 25, 2010, at which time the
Board received written and oral evidence;
WHEREAS, in a decision dated March 29, 2010 and amended June 30,
2010, based upon all testimony, documentation, personal inspection of the
property and other evidence, the ZBA granted the requested relief pursuant
to a site plan prepared by John C. Ehlers Land Surveyor, last dated October
30, 2009, a reduced copy of which is attached hereto as "Schedule B";
WHEREAS, for and in consideration of the granting of such relief, the
ZBA has deemed it in the best interests of the Town of Southold that the
within Covenants and Restrictions be imposed on the property and filed with
the Office of the Clerk of Suffolk County; and
establishing a four-foot wide acoess path constructed of pervious material
for access to the water body."
THE FOREGOING covenants and restrictions shall run with the land and
shall be binding on the DECLARANTS, their heirs, assigns, purchasers, and
successors in interest and upon all persons or entities claiming under them
and may not be annulled, waived, changed, modified, terminated, revoked, or
amended by the DECLARANTS or their successors.
If any section, subsection, paragraph, clause, phrase, or provision
of these covenants and restrictions shall, by a court of competent
jurisdiction, be adjudged illegal, unlawful, invalid, or held to be
unconstitutional, the same shall not affect the validity of these covenants
as a whole or any other part or provision hereof other than the part so
adjudged to be illegal, unlawful, invalid, or unconstitutional.
The aforementioned covenants and restrictions are intended for the
benefit of and shall be enforceable by the Town of Southold, State of New
York, by injunctive relief or by any other remedy in equity or at law. The
failure of the Town of Southold or any of its agencies to enforce same
shall not be deemed to affect the validity of this covenant nor to impose
any liability whatsoever upon the Town of Southold or any office or
employee thereof.
The within covenants and restrictions shall run with the land and
shall be binding upon the DECLARANTS, their successors and assigns, and
upon all persons or entities claiming under them and may not be annulled,
waived, changed, modified, terminated, revoked, or amended by subsequent
owners of the Property unless and until approved by a majority plus one
vote of the Zoning Board of Appeals of the Town of Southold or its
successor following a public hearing.

WHEREAS, DECLARANTS are the owners of certain real property located
on Hippodrome Drive, Southold, Town of Southold, County of Suffolk, State
of New York, described in the Suffolk County Tax Map as District 1000,
Section 66, Block 02, Lot 13, which is more particularly bounded and
described as set forth in "Schedule A" annexed hereto, hereinafter referred
to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of
the Board of Trustees of the Town of Southold (hereinafter the "Trustees")
pursuant to Chapter 275 of the Town Code of the Town of Southold or its
successor, and various activities conducted upon the property may thus be
subject to the regulation and approval of the Trustees prior to being

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trastees adopted at the meeting held on
August 20, 2008 in consideration of application fee in the sum of $250.00 paid by Elliot Brace & Ora Jean
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to construct onto an existing two-story dwelling a northerly 9'X
13.8' two-story addition with a second-story balcony and 6.5'X 18.3' entry porch and
steps in place of the existing one-story southerly portion of dwelling; construct onto
northerly corner of dwelling a 6.5'X 8.5' patio with pergola; remove existing driveway
and masonry walk and construct new stone walkway and pervious gravel driveway;
install drainage system of drywells; and establish a 10' wide non-turf buffer, with the
condition a line of staked hay bales is installed along the landward side of the non-turf
buffer and maintained during construction, and as depicted on the survey prepared by
John C. Ehlers last dated August 27, 2008.
1N WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee, Elliot Bruce & Ora Jean Heath, residing at 500 Hippodrome Dr., Southold, NY,
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released froxn any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Perm/tree will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Penuittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.

That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Herfmann:
The Board of Town Trustees took the following action during its regular meeting held on Wed.,
August 20, 2008 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of ELLIOT BRUCE & ORA JEAN HEATH applied
to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold
Town Code, the Wetland Ordinance, application dated July 30, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be found
Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent practical through the imposition of the following
Best Management Practice requirements: the installation of gutters and drywells in accordance
with Chapter 236-Stormwater Management of the Town Code, the placement of a line of staked
hay bales and silt fence prior to all construction activities and maintained until completion of the
construction project, and a 10' non-turf buffer, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
August 20, 2008, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management Practice
requirements imposed above, the Board of Trustees deems the action to be Consistent with the
Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code,
and,
RESOLVED, that the Board of Trustees approve the application of construct onto an existing
two-story dwelling a northerly 9'X 13.8' two-story addition with a second-story balcony and 6.5'X
18.3' entry porch and steps in place of the existing one-story southerly portion of dwelling;

Dear Town Trustees,
Since I'm unable to attend the August 20 Trustee meeting, I ask that this letter become a
matter of record. My home is two lots down from the Heaths and faces Hippodrome
Pond. The tributary that joins the Pond to Southold Bay flanks the Heath and Kathryn
Campbell properties. Wetlands and land preserve abuts the Pond to the south and west.
Clearly, this is one of the unique natural habitats of the North Fork.
Whatever decision is made on this permit, my request is that the Trustees make the health
of the Pond, tributary and surrounding wetlands their utmost concern. The pond can only
be cleaned by the current from the bay. Any debris or clotting of the tributary would rob
the pond of its water supply. It would thwart the spartina grass filtering system for
processing pollutants, run off and anti flooding.
Additionally, the pond and its environs are the birthing center and home of a wide
diversity offish, birdlife and wildlife. They are dependent on Nature - and on us - for
solitude and environmental cleanliness in order to live.
Under Ch. 275 of the Town wetlands code, the Town has a commitment to protect
wetlands, creeks, estuaries and ponds. My hope is that my letter will reinforce this
responsibility.

Dear Town Trustees,
I live across from Hippodrome Pond and it's tributary into Southold Bay. I am
aware that estuaries such as this are vital to the health and purity of bay waters.
My concern is that the proposed addition on the Heath property may affect the
health of the estuary and bay.
The tributary has already been compromised by human impact due to the bulk
heading that borders the tributary connecting Hippodrome Pond to the bay. This
hardening of the shoreline prevents that section of the tributary it's natural
filtering ability. At present time, the estuary supports a variety of marine life, both
fauna and flora, including a nursery for fish.
My request is that this proposal be scrutinized regarding the possible
environmental impacts. There is a cumulative effect with each manmade structure
that borders our wetlands. Therefor, each individual permit must be considered as
part of a larger scenario.

as the adjacent property owners.
I note too from thc site map that some of the additions auu proposed to be
constructed outside the j urisdictional boundary established by the NYSDBC on February
9, 1992. The application should explain why this should be permktcd.
l Easement.
Under our respective property deeds (and as indicated on the site plan), I
have a property en';itiemcnt to a 15 foot easement of right-of-way for access to and from
Hippodrome Drive over Lot $ (i.e. th.e Heath's property). The width of the existing stone
ckivc is currently less than the 15 foot legal cntitlement~ Over mc, em years this drive has
been narrowed and pushed towards the edge of the tidal wetland boundary by the trees
and shrubs planted along the edge of the drive on the Hca'.h's lawn and by the boulders
which have be~ placed on their lawn ~iong the drive. Thc grade is steeper in the
direction ef the tidal wetland boundary and less stable for whicular access. For the
protection of the tidal wetland ama, the stone drive should be set away from the edge of
the w~land boundary, and reinstated to a width of 15 fcct. This would require that the
tree and shrubs, which encroach on the easement and which would be located in the area
designated for the non tuff buffar, should be reraoved.

The site plan shows the location of the proposed non tuff buffer
encroaching on the easement which would contravene my legal property right, In
addition this w/i.l tause the drive *n be pushed cvaa clos~ to the wctiands which is not
d~simble, I therefore ~equest that ~e proposed non turf buzff'cr be located in an area
further away from thc drive so tha k does not encroach on the easement
I~, ~.&iition, the proposed siting of the non turf buffer extends beyond the
Heath's ~oper~t 2nc onto Hippotfi'~me Drive. If it ~s desirable to have a non tuff buffer,
the entirel?/ofi~ ~hould be located ~thin the boundsry line oftbe Heath property and it
should, not be p~rr'±[tted to encro~cb either on the casem~nt or on community property of
Beixdeon Estates.

I also note that the site plan d~es not indicate what type of %alive
vegetation" will be planted in the non turf buffer. I submit that such planting should be
limited to the types of grasses which are currently growing in the wetlands area and
restricted in potential size when mature (i.e., one-two feet in height) so as not to cause an
obstruction to the right-of-way or visibility.
4. Tidal wetlar~ boundary_
i note that recently along a portion of the tidal wetland boundary shown on
the site plan, some of the planting which protects the crock has been cut away opening up
arem of access over mud banks to the creek and pond. I do not know why this was done
or whether all appropriate permissions were granted. I submit that these recently created
cut-aways expose the bartok to eros,4on and consequen~y expose the creek and pond to
env/ronmental damage. Therefore the Trustees should require that thee areas be
replanted ~4th entire plantings consistent with the existing vegetation along the creek.
5. Grawl suqfaces.
Rzc~rtly 'the stone drive was resurfaeed with large stones thuat are round,
rather than crushed. Consequently the material is not compacting as it should and I
believe this .;.s leading to mad wa'ce;- run-offinto the creek and erosion of the bank along
the tidal wetland boundary. In addition, the surface of the drive is slippery and unstable.
Small vehicles have difficult3, driving on this surface and bicycles cannot be ridden at all.
I submit that the drive should be msurfaced ming crashed stones that mill compact better
(as I have done vn my pm-t of the drive). I also request that the Tm~ees stipulate that no
hear?- cons~raczien or g~_ods vehicles be pertained to use 'this drive as they are likely to
came severe de.mase to the bank a.nd the creek.
2'he site plan does not show the area of mad, Hippodrome Drive, in front
of the Heath' s ~ c-~me wt:~re rece~*ly they have put down gravel over the asphalt mad. I
do not know ~: re*son for this but I submit that the gravel should be removed and the
road rev~,'ned to ::~ orig~n~I state. Tr.e map line clearly shows that Hippodrome Drive is
not part of Lot ~ l:ut is in fact comm~'~ity property of Beixedon Estates.
In addition I note that the fencing which marks the entrance to the right-
of-w%v ~s c-ar~mJ.~.y Iccc~t~xl on Hippc, drome Drive rather teen on Lot g. Bemuse of this,
during r~torm& road -eater ~om Hippodrome Drive flew3 rapidly down [he road and is
channele~ ~rcugh these fences and ir[to thc creek causing erosion and damage to the
creek and pond. Consequently the Trustees should requir~ that the entrance to thc riE. ht-

existing two-story dwelling a northerly 9'X 13.8' two-story addition with a second-story balcony and 6.5'X 18.3' entry porch and
steps in place of the existing one-story southerly portion of dwelling; construct onto northerly corner of dwelling a 6.5'X 8.5' patio
with pergola; remove existing driveway and masonry walk and construct new stone walkway and pervious gravel driveway; install
drainage system of drywells; and establish a 10' wide non-turf buffer on landward side of existing stone driveway located in

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and
the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it is our recommendation that
the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRE.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros
Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permil conditions.
The distance from the tidal wetland to the proposed action is approximately 58 feet; a minimum setback distance of 100
feet from the wetland boundary is required pursuant to Chapter 275-3. Findings; purpose; iurisdiction~ setbacks.
§ 275-3 Findings; purpose; jurisdiction; setbacks.
D. Setbacks. [Amended 10-11-2005 by L.L. No. 17-2005]
(1) The following minimum setbacks' apply to any and all operations proposed on residential property within the jurisdiction
of the Board of Trustees:
(a) Wetland boundary.
[1] Residence: l OO feet.
If the action is approved the following best management practice (BMP) is recommended:
1. Require the applicant to maximize a 20 foot perpetual non-turf pervious buffer.
The BMP will further Policy 5, Protect and improve water quality in the Town of Southold and 6.3 Protect and restore tidal and
freshwater wetlands.
6.3 Protect and restore tidal and freshwater wetlands.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the
wetland's character, quality, values, and functions.
If the Agency, (Board of Trustees) makes a contrary determination of consistency~ the A~ency shall elaborate in writing the
basis for its disagreement with their recommendations Pursuant to Chapter 268 Waterfront Consistency Review.
§ 268-5. Review of actions.
H. In the event the LWRP Coordinator's recommendation is that the action is inconsistent with the LWRP, and the agency
makes a contrary determination of consistency, the agency shall elaborate in writing the basis for its disagreement with
the recommendation and state the manner and extent to which the action is consistent with the L WRP policy standards.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination
regarding the consistency of the proposed action.
