On October 1, 1992, the Federal Emergency Management Agency (FEMA) began using
detailed application/certification forms for revision requests or amendments
to the National Flood Insurance Program (NFIP) maps. The forms provide step-
by-step instructions for requesters to follow, and are comprehensive, ensuring
that the requesters' submissions are complete and more logically structured.
Therefore, we can complete our review more quickly and at lower cost to the
requester. While completing the forms may seem burdensome, the advantages to
requesters outweigh any inconvenience.
We have received all of the data and initial fees that we require to begin a
detailed technical review of your request. If additional data are required,

The following action was taken by the Board of Town Trustees
during its reqular meeting held on July 27, 1995 regarding the
above matter:
WRTJ~EAS, ARTSIUR AX~ERG,JR. applied to the South/old To%al Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated May 2, 1995, and,
WB~REAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and ;
W/~2~EAS, a Public Hearing was held b~ the Town Trustees with
respect to said application on July 27, 1995, at which time ail
interested persons were given an opportunity to be heard, and,
Wu~REAS, the Board members have personally viewe~ and are
familiar with the premises in question and the surround/~g area,
and,
WHEREAS, the Board has considered all the test~mon~ and
documentation submitted concerning this application, and,
Wt{EREAS, the structure c~plies with the standard set forttl in
Chapter 37-18 of the Southold Town Code,

will not affect the health, safety and general welfare of tile

RESOLVe, that the Board of Trustees approves the application of
ARTHUR AX~ER,Jr. request a Wetland Permit to construct 60+/-'
timber bulkhead 2' 9" in front of existing bulkhead with stairs
and a 4' return on the east side tying into a I08' varied height
return and 6' return on west side as per plans dated as revised
July 27, 1995.
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

RE: NORTH SOUTH OF F. kST PROPERTY LINE
I request permission to raise and install a new bulkhead on my bay front property as
proposed with a 4' bulkhead return. Please refer to the plot plan. The plot plan showed a 6'
return but in the spirit of cooperation, I would like to suggest the use of a 4' return.
I request permission to ins~l a varied height retainer as proposed in thc plot plan. Mr.
Corwin's statements and letter to you requ/re comments as both of my nc/ghbors (Corwin and
Brendel) were advised of our plans from the very beginning.
1. The plans were Showed to both ndghbors.
Thc 6"x6" exposed retainer at the front of thc property was described. Mr.
Corwin even mentioned it in his letter, however,hise',rror was that he mentioned
Scheidler's West line not the ~ast line property line which would corre~poad to

Mr. Corwin said a 20~lhigh North South wail would be built by me for 45' or
more between our properties. This is not true, never was true, was never said
to anybody and in fact, he proves his error in his own letter to you. Pl,'~,e refer
to the plot plan.
Any soil to be used will be graded properly and I have already had quotations
from landscapin& companies Please refer to the plot plan.
Of the total Fast property line of 163'+ a retainer height of 6" or less would be 126'
or 78 ~ of the to~l.
Of the first 20'+ from the bulkhead going North 15.6' or ?8% will have a rise of 6".
One 6"x6" exposed, including the 4' return.
The second 16' headed North would be a rise of 12".
As you can see ail of this will allow any flow to continue on to d~e Axberg proper~y.
Our plan is one of gradual and logical placement of the yard top soil.

so there would be no shazp jog: I showed this to Mr..C. ol'w~_n .and .he said that that con.c? .ned
him. I then went to Steve Pawhck and we changed thc hne of tile raised bulkhead from jmmng
Br. cn.~ on the West to elinfinatc a jog and to be angled North as wc progressed l=~,t would
join in a continuous line with the neighbors' East bulkhead. That ~ angled bulkhead
placement, the short 4' return and the low first section of the retainer will allow proper and
reasonable dissipation of storm force,

Dear Mr. Corwin:
Please be advised that we concur with your concerns about the increased
potential for erosion and storm damage to occur on your property as a result of the
proposed alterations of bulkheading, placement of fill, and construction of retaining
walls on the adjacent lot.
Based on your verbal and written descriptions, we understand that the owner of
the adjacent lot to the west of your property proposes to construct new bulkheading, to
place fill, and to raise the existing house to a height several feet above its present
elevation. We understand further that the top of the new bulkheading will be
approximately 20 inches higher than the existing bulkhead and that a wood retaining
wall will be constructed on the east side of the raised structure to contain the required
fill material.
Coastal erosion processes are extremely complex and the design of marine
structures is by no means an exact science. However, the proper design of any new
marine structure must carefully consider the potential for adverse impact on
surrounding properties.
If you have any additional questions regarding this matter, please do not

property, the Trustees did not have jurisdiction on the Bays.
The Trustees obtained jurisdiction in the early 80's and any
structures prior to that time did not need a permit.

(plus (2) 15' returns) of stone revetment using 3-5 ton stone on 100-1000 core,
10-50 lb. blanket. Approx. 375 c.y. of clean sand will be trucked in for
backfill. A 12~ wide area of revetment will be made suitable for a boat
launching ramp for owner's private use.

one story residence. Existing house to be raised
B. Proposed timber bulkhead to replace existing timber bulkhead.
The CAC recommends APPROVAL OF THE RENOVATION TO HOUSE as
submitted.
The CAC recommends APPROVAL WITH PROVISIONS OF THE BULKHEAD.
The CAC approves provided the bulkhead is replaced within 18" of existing
bulkhead and if applicant wishes, it can be higher to match the neighbor to the
west.

Dear Mr. Krupski:
Thank you for submitting the above mentioned Lead Agency Coordination Request to the
Department of State (DOS). Please note that DOS does not object to Southold Town
Trustees assuming Lead Agency. However, review of the submitted information indicates
that a COE/NY permit may be required for the proposed bulkhead. Therefore, if during
the course of your review it is determined that a federal permit or federal funding is
required for any portion of the proposed proiect, please instruct the applicant to submit a
Federal Consistency Assessment Form (FCAF) and supporting information to the U.S.
ACOE/NY with a copy to Ms. Diana Boos at the Department of State. Upon receipt, we
will determine if the submitted information is adequate to commence a formal review of the
project.

DONALD FEILER: I am Don Feller. I am here to represent Mr.
Axberg, if you have any questions.
TRUSTEE KRUPSKI: The whole board inspected the site. It looked
pretty straight forward. I don't know if we want to recommend
the use of a silt barrier during construction. CAC recommends
approval of the house. What we will be requiring when the
bulkhead comes up, a 20' buffer.
TRUSTEE KRUPSKI: Do I have a motion to close the hearing?
TRUSTEE ALBERTSON: So moved.

TRUSTEE HOLZAPFEL: I inspected it and it is a bulkhead already
there. They are doing a deck on the back of it. I notice that
the CAC had a problem with it.
STEVE ANGEL: It is terminology, It was a walkway, from the deck
not a catwalk.
TRUSTEE HOLZAPFEL: It was just the wording more than anything
else?
STEVE ANGEL: The wording more than the structure, yes.
TRUSTEE HOLZAPFEL: The float was already there.

IV. RESOLUTIONS:

construction. This is basically a rerun of old Beale
application. The 50' line is basically from the driveway. So
we would be approving a no disturbance area on the west side of

TRUSTEE KRUPSKI: Is there anyone here who would like to speak
on behalf of Mr. Axberg?
DON FIELER: I'm here on behalf of Mr. Axberg.
TRUSTEE KRUPSKI: Is there anyone else here who would like to
speak on behalf of Mr. Axberg? Is there anyone here who would
like to speak against this application?
RICHMOND CORWIN: I'm the property owner east of Mr.
Axberg. On Monday I submitted to your office some written
comments and drawings expressing my concerns to that I would
like to add that the same papers that were submitted to your
office were submitted to the office of Young & Young, Mr. Thomas
Wolpert professional engineer, for his observation on the same
papers. I have copies of his response to that. My property has
been in the family for 60+ years. I have quite a bit of back
ground as to the history of construction of most of the houses
in that particular area. In particular the reason for the high
bulkhead which is just to the west of Mr. Axberg's property.
That was an undeveloped piece of land until the early '60's. In
fact the present owner purchased it in 1960, and developed it in
'60 & '61. Since it was undeveloped the bulkhead had fallen in
disrepair. He being a neophite to the area and not
understanding anything, just decided to build a wall and keep
the water out. In so doing it caused the other properties
around him to have lower bulkheads and built a returns. So we
had a bulkhead that was 2'2" higher than the surrounding
bulkheads. He built a return of about 6' on each side of his
property. That has created in each of the major tidal
floodings that we've had with the coastal storms and erosion
problem for Mr. Axberg. I do have pictures here that also
show what that erosion is like on both Mr. Axberg's property
as well as Mr. Brendell's property. What Mr. Axberg has
expressed to me verbally and not supported in the application as
I have reviewed it, is his plan to increase the height of the
bulkhead to the same height as his neighbor to the west and
build of return to retain the fill that he plans to add to his
property. He verbally told me to go view the property two

houses to the west of him, Mr. Shidlow's property, to see how
it would look. I have pictures of that as well. My concern is
up until this point and I have lived in that house, physically
in it, much to the chagrin of the fire department through 10
hurricanes. There has never been any water in the house or Mr.
Axberg's house. There has never been any serious erosion in
front any of our properties along that area where the bulkhead
is low. The damage has been primarily behind the bulkheads that
have been razed. As I stated the Brendell property was
developed in 1961. Subsequent to that time the others to the
west raised their bulkheads. This is all pre-DEC and
environmental considerations were not in question at that time.
It's my concern as expressed in the material submitted to the
office.
TRUSTEE KRUPSKI: Let me just read it. (Al read letter) (See
letter attached). I think we get the picture. What I'd like to
see on the plan, and there's two plans here.
MR. CORWIN: He had originally proposed to just move the
entire bulkhead out than 2'6 or 9". And I voiced grave concern
at that time and took him down the beach at what had happened
where that had been allowed, on the Mill's property. He
therefore went back and redrew the line to pick up my corner
bulkhead and just angle it out to the property.
TRUSTEE ~RUPSKI: That's something that we would have required.
We wouldn't have allowed him to put that strange jog out into
the Bay like that. We would require him to match up, especially
where it's doable here, physically impossible between the two
neighbors in a straight line. So you wouldn't have that jog.
TRUSTEE GARRELL: Given the problems which you all have in
common, you and Brendell, and Axberg. Have you ever gotten
together with Fieler or anybody else to discuss a common
approach which would take care of every ones needs.
MR. CORWIN: No sir, because I only been made .... I don't live
here all year round. Most of the people are summer people. I
used to be an all year round resident. I now reside in Annapolis
Md. The first we even heard about this plan was Easter. The
first that I heard about this application was reading in the
Suffolk Times. There has been no communication what so ever.
Let me add one more thing. The property has been in the family
for over 60 years. It lived through a lot of storms. Most of
the summer people who come out have never experienced a
hurricane. And in some cases, like Mr. Axberg, he has not
even seen the damage immediately afterwards. Usually by the
time that he comes out a good bit of damage has been already
cleaned up. It's been very hard. When I lived here as an all
year round resident, I served as Association President for a
nunlber of years. To try and explain to these people what
happens with the water, the flow of water and how it goes. Last
Saturday's as an example we had an Association Meeting. There
is one parcel of land that we visited the area to the west that
is the Association beach. One resident made a suggestion that
we raise some kind of a barricade to keep the water from the Bay
from going in the back and flooding his property. If he had
ever been there when we had a storm he would know that the

majority of the water comes form James Creek in the back before
it ever comes over the front. But this is the mentality that
we've had to live with. My brother-in-law and I are practically
the only beacons in the night. In spite of the fact that Mr.
Brendell has owned this property for over 30 years, he still
doesn't have a clue as to what's happening as far as erosion,
the water, the wind and the storms.
TRUSTEE KRUPSKI: Well to address the problem of the bulkhead we
might be better to take a second look. We didn't notice the
height. One of the things that we've been doing throughout the
Town as a matter of course, is letting people raise the height
.of their houses because there has been a lot of flooding
throughout the T%own. Many people do it. Without the addition
of fill because it's not necessarily necessary in addition it
could cause a problem to a neighbor like yourself or maybe the
other side. There is no mention of a long retaining wall in his
application. Mr. Fieler can you answer that?
MR. FIELER: There's nothing in the application. What he's
doing as far as this application is concerned is, he also
applied to the DEC for a permit for the bulkhead change. Under
their guidelines which allows him to raise the bulkhead up and
I'm not sure how much filling in on the property he's doing and
I'm not sure on this bulkhead that he's talking about on the
side lines. I guess he has two choices if he's gonna put a
lot of fill in there. One is to taper down to the neighbors
property or to put up some bulkheads on the neighbors property.
TRUSTEE KRUPSKI: One thing that passed our clerical staff is we
need an updated survey within a year. And this is the last
update here, 1970. The other thing is it says "project plan".
It shows 50' from Corwin's property to the end of the proposed
return. We were out there on a pretty bad day but it didn't
look like 60' feet me. It's 60' between your property and the
end of his bulkhead?
MR. FIELER: Yes.
TRUSTEE KRUPSKI: So he owns 60' passed where he wants to build
a bulkhead?
MR. FIELER: No. The property width is 60'
TRUSTEE F~RUPSKI: No, doesn't that show that there's 60' between
there?
TRUSTEE HOLZAPFEL: It appears as if the edge of his bulkhead
and there's 60' to your property line.
TRUSTEE KRUPSKI: It looks like that.
MR. FIELER: No.
TRUSTEE KRUPSKI: We're gonna have to table this public
hearing because we need more information. We're gonna need an
updated survey that's gonna show the placement of the fill and
the grade and if there is gonna be a proposed wall which the
neighbor has expressed will have the effect of eroding his
property during a strong east storm.
MR. FIELER: If there is no bulkheaded wall between the
property and he installed fill, and even if he had no
application for a bulkhead change that could all be done without
any prudence.
TRUSTEE KRUPSKI: Just installing the fill?

MR. FIELER: Yes.
TRUSTEE KRUPSKI: It's still an activity. Any activity within
75'.
MR. FIELER: Then a previous application would be become a
waiver for the changes in the ....
TRUSTEE KRUPSKI: To raise the house. But that was not...we
didn't grant any approval for fill. So for fill placement we
would have to have that put on an updated survey and the survey
would also have to show in scale any proposed returns.
TRUSTEE GARRELL: Could you keep Mr. Corwin appraised of this
so that he gets it crossed off while the planning goes on.
MR. FIELER: Wel~, I'll talk to Mr. Axberg.
TRUSTEE KRUPSKI: I'll make a motion to table the public hearing
until we get all the information we need to make a decision.

foot and a half. There's a shallow bank that goes way out to
the channel.
TRUSTEE KRUPSKI: But once you get out into the harbor there, I
don't know far you could approve anything.
TRUSTEE HOLZAPFEL: They know that and that's what they wanted.

property line as per plans dated 7/22/95. Located Camp Mineola

TAPE INAUDIBLE AT BEGINNING OF PUBLIC HEARING.
Mr. Axberg spoke to say he is there if there are any questions.
Mr. Lynch spoke in favor of the project.
Mr. Corwin spoke to say that he feels if the project where to be
constructed it would cause erosion on his property and that he
had submitted letters stating same, one from him and one from an
Engineer from Young and Young. Also has pictures.
MR. AXBERG: There is presently a jog. Do you see right
there? I think Mike (Mr. Corwin) was saying that that causes
erosion because there is a jog corner. That water comes in there
and running down. If you go around my house where I have a
foundation and around my chimney there has never been on bit of
erosion, i have erosion back here because the back part of my
house is only on piles and the water just goes under it. But all
around this house there has never been any erosion. I defy with
me trying to give him the.ability to have the water roll across
my property, which I agree to. I have agreed to curb and grade,
to grade up here towards the back, put the pebbles in here. I
don't know what more I can do. The letter that he is referring
to, if it is the man from Young and Young, The gentlemen from
Young & Young makes no...matter of fact I don't think he even
came down to the property. I think they did this with a visit in
their office. They charged Mr. Corwin nothing and I don't think
they work for nothing to do a real study. They couldn't have
done a study. I would like to stop this. I don't know what more
I can do. Mr. Schiedler, who is here, has done this and there
is not runoff over Mr. Brendel's property. There is nothing
causing them a problem.
TRUSTEE KRUPSKI: Would anyone else like to comment?
MR. CORWIN: Regarding the Schiedler property to the Brendel
property, you have the high bulkhead starting with Mr. Brendel's
property, it runs to the west. The low bulkheads run from Mr.
Axberg's property to the east. I have pictures to show the low
bulkheads all the way to the east. With the exception of a
bulkhead failure, back in 85', there has been basically no
erosion, no problems, behind the lower bulkheads. For almost
each and every storm we have had with high winds and high tides,
where the wind blows out of the east, behind the bulkheads that

have been raised. I have pictures showinq the erosion that takes
place with the high water, the winds, the high waves. The land
that Mr. schiedler filled in to the west of Mr. Brendel's
property. The land with the way it is presently configured with
the low bulkhead, the water runs across my property, runs across
Mr. Axberg's property, runs across Mr. Brendel's property then
on down into the back. The high bulkhead starts with Mr.
Brendel's property. The water that is coming across this way
flows to the back. If Mr. Axberg gets approval to build this
return and then this wall, that is not going to happen any more.
That is going to skew the water down my property. It is going to
make it quite a force. There is only 10'5" between his property
line and the corner of my house. That is not the same situation
that exist between Mr. Brendel and Mr. Schied!er's property. So
there is no comparison to that at all.
TRUSTEE KRUPSKI: Thank you.
MR. AXBERG: I don't understand. That is his old bulkhead. It was
the same level as mine. Here is his new bulkhead and it is now
6" higher. He put a new bulkhead in, but he raised his. How does
he get the right to raise and then he can tell everybody else
now what to do. He raised his bulkhead 6". This is getting...
TRUSTEE KRUPSKI: Thanks. Do we have CAC comments? Recommend a
approval to the renovation of the house. Recommend approval with
previsions of the bulkhead to be replaced within 18". It can be
higher to match the neighbor to the west. That is the comments
from the Conservation Advisory Council. The letter from Young &
Young states: Dear Mr. Corwin: Please be advised that we concur
with your concerns about the increased potential for erosion and
storm damaged to occur on your property as a result of proposed
alterations of bulkheading and placement of fill and
construction of retaining walls on the adjacent lot. Based on
your verbal and written descriptions, we understand that the
owner of the adjacent lot to the west of your property proposed
to construct new bulkheading, place fill and raise the existing
house. We understand further that the top of the new bulkheading
will be approximately 20" higher than the existing bulkhead and
that a wood retaining wall will be constructed on the east side
of the raised structure to contain the required filled material.
Coastal erosion processes are extremely complex and the design
of the marine structures are by no means an exact science.
However the proper design of any new marine structure must
carefully consider the potential for adverse impact on
surrounding properties. If you have any additional questions
regarding this matter, please do not hesitate to call me. Yours

MR. AY_BERG: I just want to raise to the height of my neighbor. I
am the lowest bulkhead there.

TRUSTEE KRUPSK!: He is the lowest bulkhead there. His bulkhead
is in need of replacement. This bulkhead takes out the jog that
has been causing some erosion of the corner of the property
also. Any other comment from the Board.
TRUSTEE GARRELL: It really sounds like a case of your engineer
vs. my engineer?
TRUSTEE KRUPSKi: No, what it comes down to is the fact that the
Board has been down there at least twice, I have been down there
three times. We held it up originally the plans weren't
complete. We didn't know about the retaining wall or the fill
placement. So we held it up for that material to be submitted.
We met on the site we had a DEC representative there. We
incorporated what we do on any new bulkhead or retaining wall
replacement. The gravel buffer area between the lawn and the
bulkhead. We tried to address the concerns of Mr. Corwin. Does
anyone have any other comment. If not I will move to close the
hearing.

for approval of the plan because I don't agree with Mr. Corwin's
concerns about water eroding his house in a storm event. From
our experience, we looked at this very carefully with that in
mind, we did not see, the DEC representative did not see, the
CAC did not see that any additional erosion can take place
because of the structure and because of the structure and
because of his activity. That was one of our main concerns. I
will make a motion to approve this as amended.

The Flood Insurance Rate Map (FIRM) for the Town of Southold, New York has been
revised by this Letter of Map Revision (LOMR) to reflect more detailed
topographic information for Great Peconic Bay than that used to prepare the
town's August 16, 1993, Flood Insurance Study. The subject area is the property
at 3705 Camp Mineola Road, Mattituck, New York, which is located approximately
700 feet south of the intersection of Camp Mineola Road and Reeve Avenue along
Great Peconic Bay. This revision was initiated by Mr. Arthur H. Axberg, Jr., in
a letter dated April 26, 1996.
We received the following technical data, prepared by Mr. Axberg, in support of
this revision:
Federal Emergency Management Agency (FEMA) Form 81-92, MT-EZ Form
for a single residential lot revision to a National Flood Insurance
Program (NFIP) map;
a copy of a portion of the deed for Mr. Axberg's property from the
Town of Southold;
a copy of a portion of a survey, dated December 15, 1967, prepared
by Robert D. Kart, P.L.S., at a scale of 1"=40', entitled, "Survey
for Arthur H. Axberg, Jr., Mattituck, Tow-n of Southold, Suffolk
County, New York";
a FEMA Elevation Certificate, dated June 20, 1995, prepared by
Mr. Roderick Van Tuyl, P.L.S., for the property at 3705 Camp Mineola
Read,
an undated copy of a map entitled Town of Southold, NY, Property
Map, for section no. 123, annotated to show the property location;
an annotated portion of the Town of Southold FIRM number 360813,
panel 0116 D, dated August 16, 1993, showing the location of the
property and proposed revisions to the coastal flood hazard
boundary;
miscellaneous photographs of the property and adjacent areas; and
a letter, dated April 23, 1996, from Mr. Thomas J. Fisher, Senior
Building Inspector for the Town of Southold, acknowledging this LOMR
request.
We received all data necessary to process this revision by May 14, 1996.
Based on our review of the submitted data, we are issuing this LOMR to reflect a
change in the coastal flood hazard designation. Specifically, an area
designated as Zone V4 with an elevation of 8 feet National Geodetic Vertical
Datum of 1929 (NGVD) is now designated as Zone A4 with an elevation of 8 feet
NGVD. The inland limit of Zone V4 was originally proposed by Mr. Axberg to be
coincident with the existing timber bulkhead on the subject property. However,
due to excessive overtopping expected to accompany the 1% annual chance flood,
the inland limit of the Zone V4 boundary has been located approximately 20 feet
landward of the crest of this bulkhead. Furthermore, the existing dwelling at
3705 Camp Mineola Road, as shown on the submitted topographic map, is now found
to lie entirely within the revised Zone A4, with a base (1% annual chance) flood
elevation of 8 feet NGVD. This LOMR revises FIRM number 360813, panel 0116 D,
dated August 16, 1993, as shown on the enclosed annotated portion of FIRM panel
0116 D.
This revision is effective as of the date of this letter. Any requests to
review or alter this determination should be made within 30 days, and must be
based on scientific or technical data.
Your community must approve all proposed floodplain development and ensure that
permits required by Federal and/or State law have been obtained. State or
community officials, based on knowledge of local conditions and in the interest
of safety, may set higher standards for construction or may limit development in
floodplain areas. If the State of New York or the Town of Southold has adopted
more restrictive or comprehensive floodplain management criteria, those criteria
take precedence over the minimum NFIP requirements.
We will not republish the Flood Insurance Study (FIS) for the Town of Southold
to reflect this determination. We are preparing a countywide FIS for Suffolk
County and incorporated areas, which will include all flood hazard data for the
county, including the Town of Southold, on one FI~. We were unable to
incorporate this LOMR into the preliminary version of the countywide FIS due to
time constraints; however, we will incorporate this LOMR into the countywide FIS
before final printing. Neither will we print and distribute this LOMR to
primary users, such as local insurance agents or mortgage lenders. The
community will serve as a repository for the new data. We encourage you to
disseminate the information in this LOMR so that interested persons, such as
property owners, insurance agents, and mortgage lenders, can benefit from it.
For instance, prepare a news release for publication in your community's
newspaper, describing the revision and how your community will provide the data
and help interpret the NFIP maps.

We have enclosed an updated version of a document entitled "List of Current
Flood Insurance Study Data," which new includes this letter, to help your
community maintain all information for floodplain management and flood
insurance. If any of the items in this document are not filed in your
community°s map repository, please contact our Regional Office at the number
listed below for information on how to obtain those items.
Use the map panel listed above and revised by this letter for all flood
insurance policies and renewals issued in your community.
We have made this determination pursuant to Section 206 of the Flood Disaster
Protection Act of 1973 (P.L. 93-234) and in accordance with the National Flood
Insurance Act of 1968, as amended (Title XIII of the Housing and Urban
Development Act of 1968, P.L. 90-448), 42 U.S.C. 4001-4128, and 44 CFR Part 65.
Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as
amended, cemmunities participating in the MFIP are required to adopt and enforce
floodplain management regulations that meet or exceed NFIP criteria. These
criteria, including adoption of the FIRM, and modifications made by this LOMR,
are the minimum requirements and do not supersede more stringent State or local
requirements to which the regulations apply.

RE: NORTH SOUTH OF EAST PROPERTY LINE,
I request permission to raise and install a new bulkhead on my bay front property as
proposed with a 4' bulkhead return. Please refer to the plot plan. The plot plan showed a 6'
return but in the spirit of cooperation, I would like to suggest the use of a 4' return.
I request permission to install a varied height retainer as proposed in the plot plan. Mr.
Corwin's statements and letter to you require comments as both of my neighbors (Corwin and
Brendel) were advised of our plans from the very beginning.
1. The plans were showed to both neighbors.
A. The 6"x6" exposed retainer at the front of the property was described. Mr.
Corwin even mentioned it in his letter, however, his error was that he mentioned
Scheidler's West line not the East line property line which would correspond to
ours.
Mr. Corwm smd a'2OM~gh North South wall would be built by me for 45' or
more between our properties. This is not true, never was true, was never said
to anybody and in fact, he proves his error in his own letter to you. Please refer
to the plot plan.
Any soil to be used will be graded properly and I have already had quotations
from landscaping companies. Please refer to the plot plan.
Of the total East property line of 163'_+ a retainer height of 6" or less would be 126'
or 78 % of the total.
Of the first 20'+ from the bulkhead going North 15.6' or 78% will have a rise of 6".
One 6"x6" exposed, including the 4' return.
The second 16' headed North would be a rise of 12".
As you can see all of this will allow any flow to continue on to the Axberg property.
Our plan is one of gradual and logical placement of the yard top soil.

Mr. Corwin has said a 20" high North South wall could probably harm2h0i,,s property.
He states in his letter that this is the real problem. As I have stated, there is no wall, thus
there could be no problem.
It has been noted how people have increased the height of their properties on all sides
of me and yet I am being questioned with a gradual and logical placing of top soil on my
property.
Again, the plot plan describes it all.
In the very beginning I made a first bulkhead plan with an angle towards his property
so there would be no sharp jog. I showed this to Mr. Corwin and he said that that concerned
him. I then went to Steve Pawlick and we changed the line of the raised bulkhead from joining
Bmndel on the West to eliminate a jog and to be angled North as we progressed East would
join in a continuous line with the neighbors' East bulkhead. That final angled bulkhead
placement, the short 4' return and the low first section of the retainer will allow proper and
reasonable dissipation of storm force.

The Board of Trustees of the Town of Southold and New York State Department of
Environmental Conservation are the agencies with jurisdiction over bulkheads, returns and
retaining walls, and therefore any application for permits should be made to them and not to the
Southold Town Building Department.
