WITNESSETH, that thc party of the first pan, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and releasc unto the party of
the second part, the heirs or successors and assigns of the party oftbe second part forever,
ALL that ceftin plot, piece or parcel of land. with the buildings and improvements thereon
erected, situate, lying and being in the Village of Orient, Town of Southold, County of
Suffolk. State of New York, bounded and described as follows:
BEGINNING at a point on the southwesterly side of King Street distant 758.15 feet
northwesterly as measured along the southwesterly side of King Strut from the extreme
northwesterly end of the arc of a curve connecting the southwesterly side of King Street and
the northwesterly side of Douglas Street;
RUNNING THENCE South 73 degrees 57 minutes 30 seconds West along lands now or
formerly of John H. Holzapfel and Joyee A. Holzapfel 257.80 feet to land now or formerly of
Major Associ.~s;
THENCE North 10 degrees 23 minutes 50 seconds West along the last mentioned land and
along lend now or formerly of Sarah Jane Olmstead 85.62 feet to land now or formerly of
Burke E. Liburt and Frances M. Liburt;
THENCE North 75 degrees 17 minutes 00 seconds East along the last mentioned land 213.75
feet to the southwesterly side of King Sueetl
THENCE South 40 degrees 00 minutes 10 seconds East along the southwesterly side of King
Street 87.83 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same prunises conveyed to the party of the first ~ by
deed dated 12/2912000, and recorded 1/12/2001, in the Office of the Suffolk County Clerk in
Liher 12096, Page 635.
TOGETHER with all right, title and interest, if any, of the pa~ty of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all thc esl~te and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the pa~y of the second
Fart, the heirs or successors and assigns of the party of the second pa~ forever.
AND the party of the first pa~ covenants that the party of the first part 'has not done or suffered
anything whereby the said premises have been encumhered in any way whatever, except as
aforesaid.
AND the pa~ty of the first pa~, in compliance with Section 13 of the Lien Law, covenants that
the pm~y of the first patl will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the sam~ first to the payment of the cost of the improvement
before using any Fart of the total of the same for any other purpose.
The word "party · shall be construed ns if it rend "pa~ies" whenever the sense of this indenture so
requires.
