Proposed local law to amend the zoning map of the Town of Southold
for SCTM # 1000-117-4-33
The Planning Board reviewed the subject for an amendment to the Town of
Southold Zoning Map and recommends the amendment to the zoning map as
proposed.
It appears when the 1989 zoning map was first adopted, the business HB, hamlet
zone designation was placed on the wrong parcel SCTM 1000-117-4-32, as it
contains a residence. The adjacent pamel SCTM 1000-117-4-33 contains a
business but was designated R-40, residential. Research on this suggests that a
mistake was made when the zoning map was created. Amending the map as
per this local law would remove the current non-conformity with the Town's
original intentions.

WHEREAS the Southold Town Board intends to correct an error on the present zoning map, as
the incorrect zoning designation was attached to parcel SCTMg 1000-117-4-33 when the current
zoning map was adopted in 1989 pursuant to the master plan; and
WHEREAS, the Town Board of the Town of Southold moves to amend the Zoning Map of the
Town of Southold by changing the Zoning District designation of SCTM# 1000-117-4-33 from
Low-Density Residential (R-40) to Hamlet Business (HB); and
WHEREAS, the Local Law is entitled, "A LOCAL LAW TO AMEND THE ZONING MAP
OF THE TOWN OF SOUTHOLD BY CHANGING THE ZONING DISTRICT
DESIGNATION OF SCTM# 1000-117-4-33 FROM LOW-DENSITY RESIDENTIAL (R-40) to
HAMLET BUSINESS (I-lB)"; now therefore be it
RESOLVED that pursuant to Section 265 of the Town Law and requiremems of the Code of the
Town of Southold, Suffolk County, New York, the Town Board of the Town of Southold will
hold a public hearing on the aforesaid local law at the Southold Town Ilall~ 53095 Main
Road~ Southold~ New York at $:05 p.m,_ ~----'-~,'~'7~ -'--.., ~ ~-~2~_-:; The purpose of this
Local Law is to ratify the change of Zoning District Designation of SCTM# 1000-117-4-33 from

Suffolk, New York.

We have to come up with a better system for setting hearings at TB level. The Suffolk County Planning Agenda is
set about two weeks in advance of their meetings. So, if TB wanted in time for December 16th hearing it should
have sent out request to SC Planning and Town Planning in early to mid-November. It is impossible for the TB to
set a hearing at a meeting on Dec. 2nd and expect the PB and the County to act by the next day. They (the
County) just had a meeting. On December 5th. This will have to wait for the January 7th County meeting. I have
instructed Bruno to poll the PB by phone and resend the 10.8 memo to the County.

Status: Concept site plan application to build and alter an existing commercial
structure. The owner is talking with the building department about a building
permit and will require a use variance. At issue is the correct zone for this parcel.
As we discussed on October 7, 2003, below is the information for the master plan
zoning map correction.
In reference to the parcel above, attached you will find information from research
of this zoning map error.
It appears the parcel known, as SCTM 1000-117-4-33 was zoned "B-I" on two
zoning maps in laser fiche and the parcel to the south known as SCTM 1000-
117-4-32 and zoned residential. The first map labeled 1971 ZM5 and the second
map labeled prior to 1989 ZM1 detailed this zoning. ( see the copy of attached
maps). Attached is a copy of the most current zoning map of the master plan
dated 1/10/89 from the laser fiche file. This shows the parcel SCTM 1000-117-4-
33 zoned as R-40 and the property on the south known as SCTM 1000-117-4-32
as zoned "HB". Please refer to parcel SCTM 1000-117-4-28 on the maps for
correlation and alignment between zoning maps. From assessment records
SCTM 1000-117-4-32 is currently an old single family residence dating prior to
1962 and SCTM 1000-117-4-33 is a business and has been since 3/21/1962
It appears when the master plan zoning map was adopted that the business "HB"
zone was placed around the wrong parcel.
As requested by Mr. Moore & Mr. Wickham, please prepare a resolution and any
required paper work.
Please keep us informed on this matter. Let us know if we need to provide you
with any additional information.
