The plan dated August 5, 1990, and labeled Fuel Tank Upgrade, and prepared by N.D. Eryou, PHD, PE, meets the code requirements for a non-conforming side yard set back as reviewed and agreed to by Mr. Victor Lessard, Principal Building Inspector. All footings shall bear on undisturbed soil having a ~inimum bearing capacity of 3000 lbs per square foot. The containments (or enclosures) shall not exceed three feet around the existing concrete base or existing tanks, whichever is larger; and 2. The landowner must apply for and submit sufficient plans to show the existing tanks and new proposed construction, and of course receive an approved building permit; and 3. The proposed containments and construction shall not protrude over property lines. In the event there is a question of clarification or further determination which is not clear in the zoning code, or which is questioned by an involved agency concerning the zoning aspects of the project, these questions must be directed to the Board of Appeals for consideration before permits are issued or actions taken.
