A regular meeting of the Southold Town Planning Board was held
on Monday, November 27, 1978 at the Town Hall, Main Road, Southold,
New York at 7:30 p.m. Present were:
Henry E. Raynor, Jr., Vice-Chairman

Absent were:
John Wickham (out of town)
James Wall (inclement weather)
7:30 p.m. Public Hearing on the question of the approval of the
final map of the minor subdivision of property of Margaret V. Braatz
located at Cutchogue, New York. Mr. Raynor read the legal not'ice of
hearing and presented proofs of publication in the two local papers.
Mr. Raynor: There is notification from the Suffolk County Planning
Commission with regard to waivering of drainage provisions. We have
on file application for approval, legal description and declaration
of protective covenants and restrictions. There is notification from
the attorney that the subdivision is on an existing highway that is
town property and maintained by the town. There will be no submission
from the Superintendent of Highways with regard to bonding. As is
the Board's custom, we would like to hear from anyone present that
has anything to say in opposition to the minor subdivision of Margaret
V. Braatz.
Mrs. Tiedke: What is the water situation down there now?
Mr. Raynor: In the particular area where the subdivision is there
is potable water.
Mrs. Tiedke: Is there enough?

Mr. Raynor: There are only three lots involved and they are over-
sized.
Ms. Wickham: They have very good water down there.
Mrs. Tiedke: I know it is good but it is the quantity I am concerned
with.
Mr. Raynor: Is the question in regard to this subdivision? There are
problems on Nassau Point.
Mrs. Tiedke: What will more building lots do to that?
Mr. Raynor: In regard to this particular subdivision? The problem
exists in old subdivision lots where there are one-sixth and one-
quarter acre lots.
Mrs. Tiedke: You say the problem exists. What is their source of
water?
Mr. Raynor: It is the same as the mainland gets,~our to six~inches
a year, the same as in the township. This Nassau ~oin ~nly a
small version of the Town of Southold. If you turn it around ninety
degrees you will see it resembles the town.
Ms. Wickham: She has taken one of the tiny Nassau Point lots and
eliminated it.
Mrs. Tiedke: There must be an end some place and do you know what
it is in the terms of water supply?
Mr. Raynor: We have the Malcolm Pirnie report.
Mrs. Tiedke: In terms of Nassau Point by itself.
Mr. Raynor: I don't think there has been one complete eneugh to
give you the answer to the question.
Mrs. Tiedke: Shouldn't there be one made?
Mr. Raynor: At somebody's expense. This is the problem. Are we
going to go out and spend $100,000 in public funds for 150 families.
Nassau Point is almost totally sold out. The Health Department says
one acre is enough property for sewage treatment and water supply.
Mrs. Tiedke: That is pretty much a generalization. Are the buyers
aware of this problem.
Mr. Raynor: I can't answer you. I have no idea of what knowledge
the buyer has or if there are any buyers. Is there anyone else that
would like to be heard in opposition to this minor subdivision. Is
there anyone present that would like to speak in favor.
Ms. Wickham: We would like to request that the Plarn~ing Board
approve the application in final form tonight if there are no further
problems with it.

Mr. Coyle: Make sure the size of the lots is taken care of by
restrictions.
Mr. Raynor: Is there anyone here that has any specific information
with regard to the subdivision either for or against which will be
of some use to the Board. Hearing none, we will declare the hearing
closed.
Felix Deerkoski minor subdivision. Mr. Deerkoski met with Mr.
Raynor at the office in the afternoon. He will locate the house on
the map. He will make the minor subdivision Section i and will sign
a provision that there will be no further subdivision unless it comes
before the Board.
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED to approve the sketch map of the minor subdivision of
Felix and Peter Deerkoski dated October 17, 1978.
Vote of the Board: Ayes: Raynor, Coyle, Gordon
Motion was made by Mr. Gordon, seconded by Mr. Coyle and carried
to approve the minutes of the regular meeting of October 30, 1978.
On motion made by Mr. Gordon, seconded by Mr. Coyle, it was
RESOLVED to grant approval to the map of the minor subdivision
of Dr. Meyer Rosenberg located at Peconic, New York, and authorize
the vice-chairman to sign the map.
Vote of the Board: Ayes: Raynor, Coyle, Gordon
On motion made by Mr. Gordon, seconded by Mr. Coyle, it was
RESOLVED to hold a public hearing on the final map of the
subdivision known as "Horton Farm Estates" located at Cutchogue,
New York and owned by Richard E. Young and others, at 8:00 p.m.,
December 18th, 1978 at the Town Hall, Main Road, Southold, New
York.
Vote of the Board: Ayes: Raynor, Coyle, Gordon
Rave and Tloczkowski site plan. The Board reviewed Mr. Olsen's
letter in which Mr. 01sen expressed the opinion that the Board does
not have the right to ask for complete building plans in conjunction
with the site plan approval.

The following will be necessary for review of the site plan.
1. Loading area shown (100-13lB)
2. Detailed planting schedule, type of trees, height, whether
conifers or desiduous trees (100-13lC)
3. Outdoor lighting schedule
Public address system, if any
5. Location and plans of any outdoor signs
These above elements are for preliminary submission of a site plan.
The Board would determine at this time that a supplementary site
plan will be necessary at the time of application for a building
permit so that the Board may determine conformity of building with
the site plan already submitted.
Site plan shows what appears to be sidewalks. Please indicate if
this is such and what they consist of.
Profiles will be necessary indicating grading and cross-sections of
widths of roadways (100-134D(5)
There is no provision in the plan for drainage in the parking lot,
which would be subject to the approval of the Town Engineer and
Building Inspector.
The above information is to be submitted to Gary Olsen, attorney
for the applicant.
Zanieski. By letter from the attorney, Marcia Z. Hefter, this
is a sale within the family from father to son of an existing house.
This is considered a casual sale and it is not necessary that it
come before the Planning Board as a minor subdivision. The
information is to be given to Ms. Hefter and the building inspector,
George Fisher.
8:00 p.m. Public Hearing on the question of the approval of the
final map of the subdivision known as "Peconic Bay Cove" located
at Peconic and owned by Zaino and Sardelli. Mr. Raynor read the
legal notice of hearing and presented proof of publication.
The following letter to the Planning Board ~uder date of April 10,
1978 was read.
Gentlemen:
In reply to the March 27th meeting on drainage for Indian
Neck Lane, I suggest the Town acquire some land at this location and
construct a recharge basin. I do not believe that basins along this
road will take care of the amount of water and silt that flows onto
the road.

The following letter to Mr. Raymond C. Dean under date of November
21, 1978 was read.
Dear Mr. Dean:
On Monday, November 27, 1978, the Southold Town Planning Board
will hold a public hearing on the final map of the subdivision known
as "Peconic Bay Cove" owned by Zaino and Sardelli and located at
Peconic, New York.
I have not received the recommendations of Mr. Tuthill on the
drainage in this subdivision. At the public hearing on the
preliminary map there was comment from the audience about a problem.
I received a letter from you about the Town possibly purchasing
some property in the area.
I would appreciate something in writing for the public hearing.

Mr. Raynor: As this particular subdivision is situated on highways
on two sides, there is no bond estimate. In going through the file,
this subdivision received sketch plan approval in April of 1977. The
application and fee has been paid to the Town Clerk and the
appropriate number of prints have been forwarded. As is the
procedure at a public hearing, is there anyone that would like to
speak in opposition to the subdivision map of "Peconic Bay Cove"?
Hearing none, is there anyone present this evening that would like
to speak in favor of the subdivision map of "Peconic Bay Cove"?
Rudolph Bruer, Esq.: I am speaking on behalf of the owners. I
would like to basically restate all the arguments that were stated
to this Board at the earlier hearing and if there is no change I
ask that the Board approve the map.
Mr. Raynor: Is there anyone else that would like to speak in favor
of this subdivision? Hearing none, is there anyone this evening who
has any information in regard to this subdivision that they feel the
Board should have knowledge of.
Mr. Bear: Is the Town buying that land for the drainage?
Mr. Raynor: I can't answer that question. You would have to take
it up with Mr. Dean. I take it his department has taken the
action necessary. At this time, we have no information from him.
Mrs. Tiedke: What water does it face on?
Mr. Raynor: None.
Mrs. Tiedke: Why is it called "Peconic Bay Cove"?
Mr. Raynor: You would have to take that up with the applicant.
Mrs. Tiedke: Wouldn't you be concerned with that also?

Mr. Raynor: There is no provision in any of the ordinances with
regard to naming subdivisions.
Mrs. Tiedke: You could suggest it.
Mr. Raynor: We have sent about thirty changes to the ordinance to
the appropriate place.
Mrs. Tiedke: Let the buyer beware.
Mr. Raynor: Is there anyone else who wishes to be heard. Hearing
none, I will declare the hearing closed.
Southold Savings Bank site plan. Raymond Terry and Richard Lark, Esq.
appeared before the Board. A letter from George Fisher, Building
Inspector, which accompanied the site plan was read. Also the
report of John W. Davis, inspector, was read. Mr. Terry presented
as-built drawings. As far as the site plan goes, they still have to
use the southerly exit. The second sheet shows the plantings. Some
modifications have been made. The azaleas were changed to yews.
The blue spruce were moved to shield the back of the garage. They
have written approval from the Supt. of Highways for the curb cut.
It was determined that they still need the lighting schedule.
Thornton Smithcluster development. Mr. Smith appeared along with
his attorney, Richard Lark. Two proposals for a cluster concept
subdivision were reviewed. Mr. Smith has offered this for farmland
acquisition and was turned down presumably because of the small size
of the property and the adjoining farmers had not offered their
property. The Board will make a field survey of the property.
Regens Internation (Eric Schmitt). William B. Smith appeared before
the Board in regard to this possible subdivision of property. At
least half the property is filled land. There is Village water but
no Village sewage. It will be necessary to have contours placed on
the property and the Board will make a physical inspection of the
property.
On motion made by Mr. Gordon, seconded by Mr. Coyle, it was
RESOLVED to hold a public hearing on the maps of the minor
subdivisions of Peter Kreh~ Jr. and C. Edmonds Allen located at
Mattituck, New York, at 8:30 p.m., Monday, December 18, 1978 at the
Town Hall, Main Road, Southold, New York.
Vote of the Board: Ayes: Raynor, Coyle, Gordon

Vineyard Estates. This matter was tabled until the next meeting
that Mr. Wickham can state his opinion on the roads.

On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED to grant approval to the sketch map dated October 27,
1978 for the subdivision known as "Bayview Woods Corporation"
located at Southold, New York.
Vote of the Board: Ayes: Raynor, Coyle, Gordon
There were several people in the audience in answer to a
letter in the Suffolk Times from Richard Winters questioning the
proposed apartment complex on Youngs Avenue, Southold. Mr. Raynor
explained that it was a change of zone granted by the Town Board
about six years ago in answer to a question regarding the subversion
of the one-acre zoning in the ordinance. There were many other
questions regard£ng HUD funding and regulations regarding same which
could not be answered by the Planning Board members present. Mr.
Raynor suggested that if the people present had any suggestions
about the complex, they should write letters to the Town Board and
the Planning Board.
On motion made by Mr. Gordon, seconded by Mr. Coyle, it was
RESOLVED to hold a public hearing on the map of the minor
subdivision of property of Lawrence and Martha Stojan located at
Cutchogue, New York, at 7:30 p.m., Monday, December 18, 1978 at
the Town Hall, Main Road, Southold, New York.
Vote of the Board: Ayes: Raynor, Coyle, Gordon
Reese application to Dept. of Environmental Conservation for
permission to dredge channel at development "Southold Shores".
This matter falls under the New York State and Southold Town
Environmental Quality Review Act. The Planning Board has accepted
lead agency in the matter, i, The secretary was directed to send Mr.
Reese an Environmental Assessment Form to complete and return to
the Board. A request is also to be made to the Town Trustees and
the Conservation Advisory Council for imput.
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
~ESOLVED to grant approval to the map of the minor subdivision
of Margaret V. Braatz, said map dated July 27, 1978.

Motion was made by Mr. Coyle, seconded by Mr. Gordon and
carried to adjourn the meeting. Meeting adjourned at 9:45 p.m.
The next meeting of the Planning Board will be held December 18,
1978.
