THIS INDENTURE, made the 15~ day of Oclober, Two Thousand Three BETWEEN, ELEANOR NAGY, residing at 100 Harbor Road, Orient, New York 11957, individually, as sole surviving panner of the R & E Nagy Family Partnership and as ancillary executrix and trustee of The Nagy Exemption Pan and The Nngy Marital Pan, under the last will and testament of Richard Nngy, deceased, ·. party ofthe first.part, and r/ JOHN ~ WEDGE /Katonah~ New York 10536, WEDGE and JEANNE MARKEL. aa husband and wife, residing at 9 Terrace Heights, party of the second pan, WITNESSETH, that the party of the first, individually, as sole surviving partner of the R & E Nagy Family Parmership and as ancillary executrix and trustee of The Nagy Exemption Part and The Nagy Marital Part, under the last will 'and testament of Richard Nagy, deceased, and in consideration of $1,550,000.00, paid by thc pan)' of the second part, does hereby grant and release unto the party of the second pan, thc distributees or successors and assigns of the pan), of the second part forever, All that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, at Orient, County of Suffolk and State of New York, being bounded and described as follows: BEGINNING at an iron pipe at the intersection of thc southwesterly line of Harbor Road with the notlhwesterly line of Douglass Street; THENCE from said point of beginning, along said southwesterly linc of Harbor Road, South 57 degrees 16 minutes 10 seconds Fast, 232.57 feet to a point and lands now or formerly of James Douglass; THENCE along said lands, South 49 degrees 32 minutes 00 seconds West, 211.58 feet to Orient Harbor; THENCE along thc tic lines at the mean high water line of Orient Harbor the following two courses and distances: 1) 2) North 67 degrees 12 minutes 44 seconds West, 142.11 feet; North 54 degrees 54 minutes 46 seconds West, 98.86 feet to lands now or formerly of Cephos; THENCE along said lands North 49 degrees 32 minutes 00 seconds East, 232.97 feet to the southwesterly line of Harbor Road, the point or place of BEGINNING. BEING AND INTENDED TO BE thc same premises conveyed to R & E Nagy Family Pnrmership by deeds dated 10/8/92, and recorded 7/7/93 in the Office in the Suffolk County Clerk, in Liber 11635, Page 588, made by Richard Nagy and Eleanor Nagy; Liber 11635, Page 586, made by Richard Nag.v; and Liber 11635, Page 587, made by Eleanor Nagy. TOGETHER with all right, title and interest, if any, of thc party of the first part in and to any streets and roads abutting the above described premises to the center line thereof, TOGETIIER with the appurtenances, and also the estate which thc said dcccdcnt had at the time of decedent's death in said premises, and also the estate therein, which thc party of the first part has or has the power to convey or dispose of, whether individually, or by virtue of said will or otherwise, TO HAVE AND TO HOLD the premises herein granted unto the party of the second pan, the distributces or successors and assigns of thc party of the second pan forever. AND the party ofthe first pm covenants that the patty of the first pan has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of thc Lien Law, covcuants that thc party or'the first part will receive the consideration for this conveyance and will hold thc right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and will apply same first to the paymenl of the cost of improvement before using any part of thc total of the same for any other purpose.
