Y. 11971 TELEPHONE 765-1313 PLANNING BOARD MEMBERS John Wickham, Chairman Henry Molsa Alfred Grebe Henry Raynor Frank Coyle M I N U T E S Southold Town Planning Board August 18, 1975 A regular meeting of the $outhold Town Planning Board was held on August 18, 1975 at 7:30 p.m. Present were Chairman John Wickham, Vice-Chairman Henry Moisa, Henry Raynor and Alfred Grebe. Absent was Frank S. Coyle. Peconic Knolls. On motion made by Mr. was Moisa, seconded by Mr. Grebe, it RESOLVED to approve the final map of the subdivision known as wPeconic Knolls" subject to the following conditions: ~ 1. Right-of-way be shown on the map as per Article IV §A106-43 C (ll) requiring location, width and purpose of all easements, said right-of-way to be extinguished upon the signing of the contract for exchange and construction of the road is completed and approved by the Town of $outhold. 2. Acceptance of the bond for improvements in the subdivision by the Southold Town Board. 3. Receipt of the inspection fee. Vote of the Board: Ayes: Wickham, Moisa, Grebe, Raynor. Simicich minor subdivision. On motion made by Mr. Grebe, seconded by Mr. Raynor, it ~ras RESOLVED that the recommendations of the Suffolk County Department of Planning be incorporated in the covenants and restrictions to be filed in the Suffolk County Clerk's Office for the minor subdivision of land of John Simicich, Jr. and John Spicejaric as follows: Planning Boarm -2- August 18, 1975 1. That vehicular access to Lot #1 shall be restricted to the right-of-way thereby creating only a single driveway access point on Main Road for all three lots; 2. That the 25 foot wide portion of the right-of-way be restricted so as to provide access only for the three pro- posed lots; and 3. That the 25 foot wide portion of the right-of-way shall not be expanded to provide access to the rear of the lots fronting on Main Road in the event that they are subdivided or are developed in the future. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. On motion made by Mr. Raynor, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board agrees with Mr. Hindermann's recommendation that the present sign regulations, Zoning Chapter 100, Town of Southold, be amended to include the two sections taken from the Town of Southampton's sign regulation, as follows: "No sign other than a sign erected by a governmental agency shall be erected or placed within the right- of-way lines of a public street and any such sign may be removed by the Building Inspector without notice to the owner." "Temporary or permanent signs resting on, or attached to vehicles, shall not be used as a means to circumvent the provisions of this Ordinance." Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. Mr. Moisa made a motion, seconded by Mr. Grebe and carried to approve the minutes of the regular meeting of July 21, 1975. On motion made by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED to amend the minutes of the meeting of July 7, 1975 to correct the name of Mr. Latham from Irving to Roy. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. Planning Board -3- August 18, 1975 On motion made by Mr. Raynor, seconded by Mr. Grebe, it was RESOLVED that approval be given the final map of the subdivision known as "Eli~ah's Lane Estatesf Section 2" subject to the following conditions: 1. Completion of recharge basin in Section I. 2. Bond accepted by the Southold Town Board for improve- ments in the subdivision. 3. Receipt of inspection fee. 4. Recommendations of the Suffolk County Planning Commission. 5. The map of the subdivision will not be signed until all conditions are met. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. On motion made by Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED to request a thirty-day extension on action by the Southold Town Planning Board for the subdivision of William Schriever in Orient for further study of the traffic report. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. Luglio. Mr. Luglio, two contractors and Mr. Sherwood appeared. The following recommendations from Lawrence M. Tuthill, P.E. under date of June 2, 1975 were read. 1. That one entrance be made onto Route 25 from either the East Road or the West Road and such to be part of the sub- division. 2. That the connection to Harbor Lane be made at the extension of Pierce Drive or the property of Lademann and Dobek. 3. That a recharge basin be placed on the North Road. 4. That the drainage water from Station 0-00 on the East Road be piped to the above recharge basin. 5. That the drainage water at the entrance to Stillwater Avenue on the South Road be piped to the recharge basin between lots 34 and 35. Planning Boara -4- August 18, 1975 Comments: 1. There appears to be insufficient drainage as presently shown. 2. That the park 8nd playground is largely wetlands and would provide a poor playground. Mr. Luglio said he had had test holes done and that they were satisfactory to the County Board of Health, but he hadn't gotten a written report yet. He will get one and present it to the Planning Board. Mr. Luglio said he had attempted to contact Chef Orlowski about acquiring some of his property for a means of egress on Harbor Lane. Mr. Cron had contacted them and the price was too high. Mr. Wickham directed that a letter be written to Chef 0rlowski with a copy to the Board of Appeals and Mr. Cron to inform him that the Planning Board will require him to build a town road to town specifications if he plans on selling any of his interior lots. It would appear to the Planning Board that it would be to Mr. Orlowski's advantage to make some sort of agreement with Mr. Luglio and let Mr. Luglio construct the road. Mr. Sherwood requested a copy of Mr. Tuthill's recommendations. They will attend the next meeting of the Planning Board which will be held on September 15, 1975. On motion made by Mr. Grebe, seconded by Mr. Raynor, it was RESOLVED to hold a public hearing on the map of the minor subdivision of property owned by Errol W. Doebler located at Southold, New York. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. All conditions having been met and covenants and restrictions having been filed, Mr. Wickham signed the map of the minor subdivision of property of Garelle. Babcock & Rimmler. Mr. Olsen appeared. Mr. Olsen presented six copies of map amended to show drainage provisions. He stated that Mr. Babcock is willing to put in the extension of Mechanic Street as far as lot 7. He would be willing to cut it, put in bankrun and a culvert so the Town can surface it. Permission from the Town Board is necessary to put in that part of the road. Planning Boara -5- August 18, 1975 Ted Dowd. Gary Olsen, Esq. appeared. Mr. Olsen presented six copies of map. There was some question about the grade being raised on the roads on the latest map. Mr. Olsen left the maps for study by the Planning Board. Macari. Gary Olsen, Esq. appeared. Mr. Olsen presented five copies of the redesigned map. They will be sent to the Planning Board for their study. *** Laurelwood Estates~ Section 2. Gary Olsen, Esq. appeared. Mr. 01sen presented five copies of revised map redesigned in accordance with the recommendations of the Planning Board. Mr. Wickham suggested that the leg of Eagle Nest Road be widened to fifty feet with a note "reserved for possible future dedication to the Town of Southold". *** Hodor. Gary Olsen, Esq. appeared. Mr. Olsen presented six copies of the sketch map. *** Soundview Acres at Orient. Richard Cron, Esq. appeared. Mr. Cron made the official presentation of the final map of this subdivision. On motion made by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that public hearing be held on the final map of the subdivision known as "Soundview Acres at Orient". Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. Greenbriar Acres. Mr. Cron appeared. Mr. Cron presented twelve copies of amended map with profiles to be distributed to the property agencies. *** Orient Point~ Mr. Cron and Mr. Ernest Wilsberg appeared. Planning Board -6- August 18, 1975 Mr. Cron said they would redesign the road so that the lots on the bay will have a 100 foot setback. DeVoe. On motion made by Mr. was Raynor, seconded by Mr. Grebe, it RESOLVED to approve the sketch map of the subdivision known as "Beaujolais Acres" owned by Charles DeVoe. Vote of the Board: Ayes: Wickham, Raynor, Moisa, Grebe. Rod 'N' Reel Estates. The recommendations of the Seil Conservation Service were read and the secretary was directed to send a copy of these recommendations to Mr. Weinstein, attorney for the developer. On motion made by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED to approve the preliminary map of the subdivision known as "Rod 'N' Reel Estates" dated May 22, 1974 and amended March 24, 1975 subject to the following conditions: 1. Connecting up with municipal water. 2. Study and report by developer so as to preclude any excess water caused by the subdivision going beyond the proposed drainage area within the subdivision. 3. Erosion control be agreed upon prior to construction. 4. In view of the fact of the lowness of the land and the highness of the water table there are very real problems which must be solved in regard to sewage disposal. This problem will have to be solved because the Planning Board will not allow cesspools higher than the surrounding area. Plans must be presented for approval. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. Mr. Wickham wished it put in the record the the Planning Board is expecting to go and the secretary is expected to go and take the minutes of the meeting at Fishers Island on August 20, 1975. Time has been allocated to the Highway Committee and Mr. ZabahoZski has an appointment at l:O0 p.m. regarding his proposed subdivision. Planning Board -7- August 18, 1975 Crown Land Lane. On motion made by Mr. Grebe, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board ~ea£firm its action approving the final map of the subdivision known as "Crown Land Lane". The Southold Town Planning Board con- curs with recommendation #1 that vehicular access to Lot 1 shall be restricted to Crown Land Lane. We also agree with recommendation #2 that access to the Main Road be coordinated with the State of New York requirements. The cross-street (Crown Land Lane and Spur Road) will connect with the proposed Spur Road in the subdivision immediately to the east. "Highland Estates", which is not yet in its final stage. Were the entrance road on the Main Road to be eliminated, the only access to this subdivision would be through "Highland Estates" which would make a potentially dangerous intersection by the Cutchogue Presbyterian Church should this be the only access. Vote of t~a Board: Ayes: Wickham, Moisa, Raynor, Grebe. It is the opinion of the Planning Board that the letter from the Suffolk County Department of Planning is not con- sistent within itself. On motion made by Mr. Grebe, seconded by Mr. Moisa, it was RESOLVED that the request to name roads in Camp Mineola, Mattituck, as presented by Syrena H. Stackpole, Esq. and verified by George Fisher, Building Inspector, as not being in conflict nor a duplication be granted. The proposed road names are Allen Drive, Camp Mineola Road, Terry Path, Howell Avenue and Fay Court. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. On motion made by Mr. Raynor, seconded by Mr. Raynor, it was RESOLVED to authorize the Chairman to sign the map of the subdivision known as "Crown Land Lane" upon receipt of maps with the notation 'access to lot I will be on Crown Land Lane only'. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. On motion made by Mr. Moisa, seconded by Mr. Raynor, it was Planning Board -8- August 18, 1975 RESOLVED that the Southold Town Planning Board approves the site plan of the cluster development of "Pebble Beach Farms" subject to: 1. Certification of the Building Inspector as to whether or not the plan meets the requirements of all Zoning Ordinance provisions. 2. Receipt of statement that open space "D" may also be used by the Village of Greenport for the purpose of install- ing wells therein and pumping facilities thereon for its public water supply system. 3. A statement that the zoning provisions of the bulk and parking schedule will be reduced by a maximum of fifty percent as authorized by Section 100-136 A (2) of the Code of the Town of Southold. Wooded area be shown on the site plan. 5. Recommend a setback of thirty-five feet on the lots that are not on the Long Island Sound or on a corner. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Grebe. Mr. Grebe made a motion, seconded by Mr. Raynor that the meeting be adjourned.
