Y. 11971 TELEPHONE 765-1313 PLANNING BOARD MEMBERS John Wickham, Chairman Henry Molsa Alfred Grebe Henry Raynor Frank Coyle MINUTES August 20, 1975 A speci81 meeting of the Southold Town Planning Board was held on August 20, 1975 at 12:30 p.m. at the Fishers Island School, Fishers Island, New York. Present were Vice-Chairman Moisa, Frank S. Coyle, Henry Raynor and Alfred Grebe. Absent was Mr. Wickham. Mr. Walsh (Zabahonski) had an appointment with the Planning Board to discuss a new proposal he has for one of his holdings on Fishers Island. This piece of property has been before the Planning Board in the past as a conventional subdivision but Mr. Walsh is now contemplating creating a cluster development or perhaps going for a downzoning for multiple. He wants about twenty homes on ten acres with tennis courts and so forth. Mr. Walsh indicated that he would like to sell the homes and not the land. Mr. Raynor: If you have 20 homes and the rest is open space. With a cluster you have to sell each lot and the remainder of the open space would be held jointly by the lot owners. The open area would be held in common. If you stay a half acre or above you would not need a change of zone. If you want to go more you have to go for a change of zone. Mr. Walsh wants an area for a garden and one caretaker to take care of the whole thing. He anticipates having contractors come in and build. Mr. Moisa: Whatever you do you have to leave a certain part as open space. If you have twenty homes, you can cluster on ten and leave the other ten open in perpetuity. Mr. Raynor: It goes into a Home Owners Association. A tennis court can be put in a cluster. Mr. Walsh: We can build on half an acre in community clustering? Planning Board -2- August 20, 1975 Mr. Raynor: Yes. In a change of zone you lose a year. Mr. Walsh: In other words, you need an acre for each house. Mr. Raynor: Are you within 500 feet of the water at any point? Mr. Grebe: No. Mr. Raynor: omit lots 26 presented to two years or You may create a problem with that. If you - 31 (shown on map Mr. Walsh had previously the Planning Board). You can sell one every so, as an occasional sale. Mr. Moisa: We will wait to get something from Gordon Ahlers. At this point of the meeting, Mr. Walsh wished to discuss the possibility of a lobster farm across the street from the property on the water. Mr. Walsh: On this high point we have about ten acres. We want to have a lobster farm. I have been working on it since 1928. I have already ex~perimented. I can raise a lobster in two year's time. I am trying for a lobster farm with solar heat. Mr. Moisa: Are you having auy buildings? Mr. Walsh: It has to be covered for solar heat. Mr. Raynor: You have a couple of steps here. One, to dredge the channel you need a permit from the Army Corp~ of Engineers. Before you can put any building up, you have to have a change of zone. In order to do any dredging you have to go to the State DEC and probably the Town Trustees. Have you talked to anyone in the State? Mr. Walsh: Somebody from the State came in and said they are going to give another area somewhere else. This was planned to be dredged out for a lagoon. We have more than enough boa~s and I would like to experiment on this thing and see if I can raise lobsters in a short period of time. Mr. Coyle: Are there one foot elevations on most of it? Mr. Walsh: Yes, and some are a half a foot. Mr. Raynor: Why don't you have your attorney contact the State DEC and see what they say. Whatever their decision is we have to abide by it. Mr. Walsh: I applied in 1973 and at t~at time they were not organized. It came in September or October of 1973. This was in the office at this time but I never got a reply and I didn't follow it through. Planning Board -3- August 20, 1975 Mr. Raynor: I think it would be good to keep us in touch on what the State says. Mr. Walsh: Is the man's name Haje? Mr. Raynor: Yes. Mr. Coyle: How many acres is it? Mr. Walsh: Nine. Mr. Grebe: How much does Nitze have? Mr. Walsh: Eight acres. Mr. Walsh complained that part of one acrea has been used for a cump. He brought in about fifteen yards to cover it over and got a letter to pull it out. He said he spent about $100 on D-con because there were so many rats. Mr. Walsh thanked the Planning Board for the time they had given him. The Board then went over the site plan of Norkus as presented by Gordon Ahlers and found the following not yet complied with. ~100-134 A (9) A complete outline of existing deed restrictions or covenants applying to the property. 1oo-134 B (1) Existing contours at intervals of five (5) feet or less, referred to a datum satisfactory to the Board. 100-134 C (3) ~100-134 C (4) ~100-134 D (3) ~100-134 O (4) Locations, dimensions, grades and flow direction of existing sewers, culverts and water lines as well as other underground and aboveground utilities within and adjacent to the property.. Other existing development, including fences, landscaping and screening. (The Planning Board will require shrubs and a planting schedule.) The location, direction, power and time of use of any proposed outdoor lighting or public- address systems. The location of and plans for any outdoor signs. Are parking areas calculated? Mr. Raynor suggested the purchase of the "American Land Planning Law". This will be discussed at the next meeting. Planning Board -4- August 20, 1975 The Planning Board reviewed the amendments to the Code of the Town of Souhold as it refers to firewells. It was decided that the pumping capacity be changed from 400 gsllons per minute to 350 gallons per~inute. It should also be added that the depth of water should be at least 40 feet. After revision the proposal should be ~gain sent to Mr. Tasker for his approval or comments. Mr. Coyle made a motion, seconded by Mr. Grebe and carried that the meeting be adjourned.
