9:00 a.m. The Town Board reviewed IV. For Discussion Items as follows: IV. 1. Vacancies on the
Anti -Bias Task Force. Reverend Dozier advised that he will not be seeking another term of office
on this committee. The Town Board will accept his decision with regrets and advertise for a new
member for the Anti-Bias Task Force Committee. See resolution no. 769. IV. 2. Request of Human
Resource Center for account clerk. Comptroller John Cushman has advised that there is no money
in their budget for this item. IV. 3. Scavenger Waste Facility coverage during 4-day Thanksgiving
week-end. Councilman Romanelli suggested that the plant be closed and any potential users be
directed to the Riverhead scavenger waste plant. IV. 4. Request of Human Resource Center to
place ad for CDL mini-bus driver. Comptroller Cushman advised that there is no money in their
budget for this item. IV. 5. Code Change proposal for the Town Trustees. The Trustees are asking
for a sounding expert to provide them with accurate water depths on certain applications, and
recommend that the cost of this service be borne by the applicant, not the Town. A fee structure would
have to be set-up according to what is considered "reasonable cost in the industry" or "standard
schedule cost". This proposal will be sent to the Code Committee to review the draft local law
legislation.
9:30 a.m. Appointment - Comptroller John Cushman re: budget. Mr. Cushman advised the
Town Board that the Town's general insurance will increase by 100% instead of the 30% anticipated
increase. This translates into an unbudgeted amount of $154,000.00. Further complicating the matter
is an unexpected increase in the retirement system payroll tax of 4% or $175,000.00. Together they
represent an increase of $329,000.00 in unbudgeted funds for 2002.
9:40 a.m. The Town Board reviewed resolution no.'s 746 through 767 to be voted upon at the
regular meeting.
Supervisor Cochran requested that she would like a report, in writing, from all board members on their
committees as to where they are at, and what they are working on. Time will be scheduled during the
work session at the next meeting for the reports to be received and given verbally as well.
On motion by Justice Louisa Evans, seconded by Councilman John Romanelli, it was
RESOLVED that the Town Board of the Town of Southold hereby enters into Executive Session at
10:03 a.m. for the purpose of discussing personnel - particular persons - with Planning Board
Member Richie Latham and Town Planner Valerie Scopaz.
Vote of the Town Board: Ayes: Councilman Richter, Councilman Romanelli, Councilman Murphy,
Councilman Moore, Justice Evans, Supervisor Cochran.
This resolution was declared ADOPTED.

at 10:23 a.m.

Resolution numbers 768 to advertise for the provisional position of Senior Planner; 770 to create
position of Senior Environmental Planner and establish salary scale; 787 to advertise for the
position of Senior Environmental Planner were placed on the agenda as a result of the foregoing
executive session.
On motion of Justice Louisa Evans, seconded by Councilman John Romanelli, it was
RESOLVED that the Town Board of the Town of Southold hereby enters into Executive Session at
10:24 a.m. for the purpose of discussing contracts, litigation, and personnel - particular persons.
Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli,
Councilman Moore, Justice Evans, Supervisor Cochran.
This resolution was declared duly ADOPTED.
On motion by Justice Evans, seconded by Councilman John Romanelli, it was
RESOLVED that the Town Board of the Town of Southold hereby exists from this Executive
Session at 10:57 a.m.

On motion by Justice Louisa Evans, seconded by Councilman John Romanelli, it was
RESOLVED that the Town Board of the Town of Southold hereby enters into Executive Session at
1:39 p.m. for the purpose of discussing property acquisition with Melissa Spiro, Land
Preservation Department; personnel - a particular person with Chief Carlisle Cochran, Jr.; and
contracts with Solid Waste Coordinator James Bunchuck.
Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli,
Councilman Moore, Justice Evans, Supervisor Cochran.
This resolution was declared ADOPTED.
On motion by Councilman John Romanelli, seconded by Justice Evans, it was
RESOLVED that the Town Board of the Town of Southold hereby exits from this Executive Session
at 3:15 p.m.

Councilman Moore, Justice Evans, Supervisor Cochran.
This resolution was declared ADOPTED.
As a result of this foregoing executive session, the following resolutions were placed on the
agenda: Resolution No. 781 appointing Dawn Thomas as Hearing Officer in the matter of
disciplinary proceedings against a Town employee; 782 Suspend without pay a Town employee
against whom disciplinary charges have been filed pending the hearing and determination of
charges; 784 rescind the resolution of the Town Board of May 1, 2001 authorizing Supervisor
Cochran to present a check to Greenport Village for settlement of disputed debts.
The Town Board had a visit from eight (8) Cub Scouts and their two leaders. These young boys
were working on their government, community, civic badges and had a short discussion with the
Town Board members.

A Regular Meeting of the Southold Town Board was held on November 8, 2001, at the Southold
Town Hall, Southold, New York. Supervisor Cochran opened the meeting at 4:30 P.M. with the Pledge
of Allegiance led by Town Clerk Neville.

different departments, and from the different committees. They are placed on file in the Town Clerk's
Office. They are public information, so they are certainly there for your interest or any specific thing
you might be interested in. You are more than welcome to come in, and Mrs. Neville, our Town Clerk,
will be happy to help you.

SUPERVISOR COCHRAN: There are no Public Notices this evening.
III. COMMUNICATIONS.
SUPERVISOR COCHRAN: We have had some correspondence. One is from Reverend Marvin
Dozier in reference to the Anti-Bias Task Force. Marvin has been serving as our President, our
Chairman and he finds it necessary to retire from that position. He will be sorely missed. He has done a
lot of good work for the town. Also we had a letter from the Southold Town Fire Chiefs with their
support of the position of Fire Marshall, and we have had a letter from Director Joan Marie Cortez
from the Robert L. Perry Day Care Center in relation to their thank you for what the Town does for
them.

2. Southold Town Fire Chief's Council to Supervisor Cochran in regard to Fire Marshall.

4. 7:37 P.M., on the purchase of certain parcels of property from the Peconic Land Trust as
contract vendee with owners Andrew and Bernice Lettieri, SCTM #1000-23-1-3.4 and 20, and
SCTM #1000-31-5-1.2.

V. RESOLUTIONS.
SUPERVISOR COCHRAN: As you know the Town Board has a policy that prior to the passage, or
enactment, of any of the resolutions you certainly have the opportunity to address the Board on any of
the printed resolutions. If you have other Town Board business we would be very happy to except that
at the end of the meeting. We just had our Budget hearing, the first one. We have another scheduled for
7:00 o'clock this evening. We will leave the Work Session open, as we have left the hearing for the
budget open, and they will both be closed later this evening. At this time is there anyone that would
like to address the Board in relation to any of the printed resolutions? Yes, Jim?
JAMES D1NIZIO: James Dinizio, Jr. 39 Sound Road, Greenport. First I would like to ask you, are you
going to pass the budget tonight? Do you vote on it?
SUPERVISOR COCHRAN: It depends on how much we hear tonight. If we have a lot of input, and if
we don't. It depends. We may or we may not, Jim.
JAMES D1NIZIO: It is possible that you could after you had your meetings. Okay. On resolution 784,
could ! ask what that is all about?

COUNCILMAN ROMANELLI: Jim, that goes back to when we had a special meeting with the
Village of Greenport. I think it was May 2000, 2001 actually. That goes back to when the Village of
Greenport had the arsenic laced soil stockpile on Mitchell Park, and we were going to take the soil for
landfill purposes, and in return it was basically a swap of settlement of checks. The soil never came
and then it was spread out amongst that park, and so the deal fell apart. So we are rescind the
resolution saying that we were going to pay for the soil we didn't get.
JAMES D1NIZIO: So, you didn't write a check.
SUPERVISOR COCHRAN: We were exchanging and it never came about.
JAMES DINIZIO: Thanks.
SUPERVISOR COCHRAN: On any of the resolutions? Yes, sir?
PETER HARRIS: Good afternoon everyone. Peter Harris 212 Knapp Place, Greenport. I just have one
question. I haven't had a chance to talk to Ray Jacobs yet, but I just noticed that you accepted a bid
from the International Salt Company for bulk salt for ice control for the Highway Department this
year. Could you tell me what the price is per ton, and how many tons? Was there a maximum amount
of tonnage that was proposed?
SUPERVISOR COCHRAN: What number were you on?
PETER HARRIS: 774.
COUNCILMAN ROMANELLI: It was for $8.33 per ton delivered for 500 tons more or less.
PETER HARRIS: Okay. Thank you.
SUPERVISOR COCHRAN: We will recess for the public hearings.

WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk County,
New York on the 23rd day of October, 2001, a Local Law entitled "A Local Law in Relation to
installing a four-way stop at the intersection of Oaklawn Avenue, Wells Avenue, and Jockey
Creek Drive, Southold", and
WHEREAS the Town Board of the Town of Southold held a public hearing on November 8, 2001, at

RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Cochran to execute a Master Agreement for Airport Improvement Program Grants
for Elizabeth Field on Fishers Island with the Federal DOT, all in accordance with the Town
Attorney.

Moved by Justice Evans, seconded by Councilman Romanelli,
Authorizing design and construction of a Drainage Enhancement Project on the north side of
State Route 25 on the State Highway System, the performance and funding in the first instance
100% of the costs of design and construction or reconstruction thereof, to be reimbursed by the
State and appropriating funds therefor.
WHEREAS, the State of New York has requested the Town of Southold to incorporate improvements
(the "State Betterment") to the Stormwater detention facility on Route 25 in the Town of Southold
combined with a Town improvements project to adjacent Town highways;
NOW, THEREFORE, the Town Board of the Town of Southold, duly convened does hereby;
RESOLVED, that the Town Board of the Town of Southold hereby approves such proiect inclusive
of the State Betterment (collectively the "Proiect"); and it is hereby further
RESOLVED, that the Town Board of the Town of Southold hereby authorizes the Town Comptroller
to pay in the first instance 100% of the costs of the Project or portions thereof; and it is further
RESOLVED, that the sum of one hundred fifty thousand ($150,000.00) dollars is hereby appropriated
and made available to cover the cost of participation in the above phase of the Project; and it is further
RESOLVED, that the Town Supervisor be and is hereby authorized to execute all necessary
Agreements, certifications or reimbursement requests on behalf of the Town with NYSDOT in
connection with the implementation of the Project, and reimbursement of the approved costs associated
with the State Betterment, and it is further
RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner
of Transportation by attaching it to any necessary Agreement in connection with the Project, and it is
further
RESOLVED, this Resolution shall take effect immediately.

RESOLVED that the Town Board of the Town of Southold hereby grants permission for Detective
Beth Dzenkowski to attend the New York Police Juvenile Officers Association in her capacity as
Secretary, commencing Thursday, December 6 and Friday, December 7, 2001, in Ithaca, New York.
The New York Police Juvenile Officers Association covers all expenses for meals and
accommodations. Expenses would be approximately $45.00 for transportation costs (gas and tolls).
These costs will be a legal charge to the Juvenile Aid Bureau budget line.

Constable Donald Dzenkowski to attend the Using Pesticides Legally and Safely program held on
Tuesday, December 4, 2001, at the Ramada East End, Riverhead, NY.
The course fee is $100.00, which includes training material, morning/afternoon breaks and lunch.
Travel will be by Town vehicle. Ail expenses will be a legal charge to the Police Department Bay
Constable Training budget line - A.3130.4.600.200.

WHEREAS, the Town Board of the Town of Southold held a public hearing on the question of fee
title acquisition of property from the Peconic Land Trust as contract vendee with owners Andrew and
Bernice Lettieri on the 8th day of November 2001, pursuant to the provisions of Chapter 6 (Community
Preservation Fund) of the Town Code, at which time all interested parties were given the opportunity
to be heard; and
WHEREAS, the approximately 15.55 acre property includes three (3) separate tax parcels:
SCTM# 1000-31-5-1.2 is approximately 14.995 acres in area and is located on the north side of
Main Road, approximately 1900' east of the intersection of Stars Road and Main Road, and
SCTM# 1000-23-1-3.4 and 23-1-20, are beach parcels, each approximately 0.26 acres in area,
located between Dam Pond and Long Island Sound; and
WHEREAS, SCTM# 1000-31-5-1.2 includes an approved subdivision of two lots, one
approximately 2.66 acres in area and the other approximately 12.32 acres in area including the
area of a 50' right-of-way; and
WHEREAS, the 50' right-of-way provides access to the adjacent 21 acre Dam Pond property
purchased under joint partnership by the Town and County in 1999; and
WHEREAS, in addition to being adjacent to the preserved Dam Pond property, the subject
property is adjacent to nearly 100 acres of property to the west on which there is a conservation
easement to the Peconic Land Trust; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase the subject property together with the County of Suffolk, for open space preservation
purposes in conjunction with the existing Town/County owned land, which may include the
establishment of a nature preserve or passive recreational area, including limited parking for
access purposes; and

and Bernice Lettieri and the Town and County will then purchase the property from the Peconic

PETER HARRIS: Good evening. ! have a question pertaining to the Landfill. It was brought to my
attention earlier since the capping of the Landfill started that having worked with the Department of
Transportation that the Landfill is no longer accepting sweepings from the road. The fact that the way
the material they are using for the capping purposes are being mined, and ! know Ray Jacobs has been
stockpiling the sweepings for town in the Town Highway facility. My question is, why can't the
sweepings be used for capping material when you came down and excavated the park area for the

proposed fish pond, that is going to finished some time next year. I am just curious. The question I
have is because ! am going to be coming into this position.

approved by the DEC even if we are mining from the land next door. They have to take samples of it. !
think it is a sample of every ten yards. It needs to be tested and approved before it goes on that cap, so
that is why we can't just take the street sweepings.
PETER HARRIS: My question is then, what are we going to do with the street sweepings in the
future, because we can't very well, ! mean ! am going to be coming in and taking over the position of
Superintendent of Highways in January, and we are going to find a home for this material.
COUNCILMAN ROMANELLI: Where it is going to go from this point forward ! don't know. It is
something we haven't really talked about. Jim Bunchuck might have an answer, and it might be sand
that we have to give away to local contractors. ! really don't have the answer. ! just know, we can't not
put it strictly on the cap without DEC approval.
PETER HARRIS: Okay. That was basically my question. Also the question earlier this afternoon when
! asked a question as far as the price of rock salt, how much you are paying a ton, and how much you
were buying, only for the simple fact that ! know the Town doesn't particularly use large amounts of
rock salt, because they say sand is cheaper, but in the long run it may not be cheaper for the simple fact
you have to pick the sand back up, and now you are going to have to dispose of it. So it may come to
pass when ! take over ! may have to take a look at this, and we may have to do some changing around
of what we do for applications.
SUPERVISOR COCHRAN: I am sure it is your prerogative. You are the elected official, and once
you begin to serve the community if you see a need for these kinds of discussions just come in, and the
Board is available. Same thing with deer, we have a problem with deer. We can no longer put them in
the landfill.
PETER HARRIS: Madam Supervisor, I understand. I had discussions with Jim Bunchuck, and he
informed me that the fact that due to the DEC, and they were hoping the contractor, that the Town
contracts with taking away the solid waste, that they were going to be able to come up with a plan
where they would take the deer, but that hasn't come to past yet. It is a big problem.
SUPERVISOR COCHRAN: There are several things like this that we were always able to take in. We
are not anymore. You are going to have to solve the problem, you people.
PETER HARRIS: ! was just here tonight asking questions. That is all.
COUNCILMAN MURPHY: Pete, the only thing ! would like to say about it, talking about the salt and
the rest on the roads. Remember we have a severe road runoff problem in this town, and salt is one of
the big things, where sand it may be a situation of expense on picking up.
PETER HARRIS: Environmentally, Brian, it all depends on the amount that you put out. Too much of
any one thing is no good. Salt going into the waterways is just as bad as you know. ! am not here to
debate the question. ! was just here to ask a couple of questions. Thank you.
JODY ADAMS: ! am Jody Adams, and if this were my ideal situation Cablevision would be here. !
would be speaking to the public, not to the Board, because the Board and ! are beyond speaking. They
are not here however. So, ! am Jody Adams. Thirteen days ago my belongings were, literally my
entire, just about my entire worldly goods, were put out of a self-storage unit 1040 Horton's Lane, and
put on the side of the road at roughly 2:30. My understanding is about 2:31 twenty of Southold's best
citizens arrived, and began ripping into my belongings. My understanding is a girl at that storage place
tried to stop them, but being Southolders they were unstoppable. The Police apparently had little
interest in this situation. The Police continue to have little interest in this situation. It is an interesting
situation. A good portion of my salable belongings are floating around Southold Town. You know in
somebody's car, somebody's truck, and somebody's house, somebody's wife, somebody's kids, your
kids, who knows. ! don't like it. There are many issues that require discussion. This is not a town that
discusses things. ! am pleased, Mrs. Cochran, that you will not be our Supervisor.
SUPERVISOR COCHRAN: Thank you.

JODY ADAMS: ! am delighted. We will lose the conflict of interest between the Chief of Police and
Supervisor.
SUPERVISOR COCHRAN: Thank you, Jody. Do you have anything else to say? ! agree. ! think it
was pitiful. ! went passed, and ! saw your goods out on the road. ! do have compassion for that. ! saw
that you had been evicted, and ! had to go to a meeting at Riverhead, and when ! came back like
vultures.
JODY ADAMS: When ! came back, my dear, your belongings were all ... ! am Town Supervisor, but
had to go to a meeting in Riverhead. Thank you, Mrs. Cochran.
SUPERVISOR COCHRAN: It is not my job to take care of your personal things.
JODY ADAMS: My dear, it is indeed. It is precisely your job.
SUPERVISOR COCHRAN: Okay, ! called for a motion to adjourn.
Moved by Councilman Romanelli, seconded by Councilman Moore, it was
RESOLVED that this Town Board meeting be and hereby is adjourned at 7:31 P.M.
Vote of the Town Board: Aye: Councilman Murphy, Councilman Romanelli, Councilman Moore,
Justice Evans, Supervisor Cochran.
