There was a Special Meeting of the Southold Town Planning
Board~Southold Town Board of Appeals and Southold Town Board
on December 5, 1972, at 7:30 p.m., at the Supervisor's Office,
16 SoUth Street, Greenport, New York.

The Planning Board, Board of Appeals and Town Board
discussed the following proposed amendments to the Zoning
Ordinance;
(1) Article I - Definitions - add definition of ELevation -
to be established from floor level of building.
(2)
Article III, Section 300 B-14 - Delete Section B-14
and make new Section 300 C-7 to read as follows:
"Yard sales, garage sales, attic sales, auction sales
or similar sales Of personal property, !provided not
more than one (1) such sale shall be c0nducted ~on any
lot in any one (1) c~lendar year. Such sale shall be:
(1) limited to personal property of owner or ~enant;
[2) limited to one specific date and/or one specified
rain date; (3) applicant shall provide .supervision of
parking so as to not block traffic on public street or
neighbors' driveways, etc; (4) one "on premises" sign
not larger than 3' x 4' may be displayed for one week
prior to such sale and removed immediately thereafter;
(5) a permit required from the Building Inspector for
such sale, fee for same to be $15.00, paid in advance.

'Article III, Section 300 C-5 - Change to read: "Horses
and domestic animals other th~n dogs, shall not be
housed within 50 feet of any lot line. Housing for
flocks of more than 25 fowl shall not be constructed
within 50 feet of any line."

front yard~ setback shall be the average setback of

line, the same shall'not exceed four (4) feet in

Article VI, Section 602- 7: change to read "Parking
shall be provided in offstreet paved parking areas
which shall provide for one (1) parking space, three
hundred fifty (350) square feet in area, for each
one hundred (100) square feet of sales floor area or
office f~oor area in each building."
Article XI, Section 1101- 1: change to read "Schedule
of PArking Requirements:~ Accessory.offstreet parking
spaces, open or enclosed, shall be provided in all
use Districts for any use specified~below. Any land
which is developed as a unit under single ow~ersh~
and control shall~be considered a single lot for the
purpose of these parking regulations. Reasonable
and appropriate offstreet parking~requirements for
structures and uses which do not fall within the
categories listed below shall be determined by the
Planning Board upon consideration of all factors
entering into the parkinG needs of each use. Each
parking space shall be not less than three hundred
fifty (.350) square feet and unless otherwise specified
parking area will be subject to Planning Board on site
plan approval and Board of Appeals on a use exception
requirement.
(a) Places of worship, libraries, and other
public buildings'- at least on~ parking
space for each 200 square feet of floor
area, but not less then one space for
each five seats where provided.
(b) Golf courses and other country blubs
at least one parking space for eaCh two
members or accommodations (such as lockers)
whichever is greater.

"All iotls held in single and separate ownership prior
to the adoption of this Ordinance with less than required
area and less than required width, the side yards may be
reduced 30%.

There was some dis~ssion about eliminating the "B"
category of A Resident District for lots with both public
water and public sewer on tracts of 100 acres or more. These
lots would have to be 40,000 square feet, but the houses
could be clustered.
The Planning Board, Board of Appeals and Town Board next
disCussed the proposed amendments to the Subdivision Regulations.
Supervisor Martocchia read a letter from John Wickham with his
suggestions on these proposed amendments. The amendments
discussed were:
(1)
There was discussion about eliminating minor
subdivisions from the regulations. A suggestions
was made to allow minor subdivisions only on
existing streets. On minor subdivisions with lots
of two acres or more the Planning Board will
require the recording of restrictive covenants
that the property will never be subdivided.
Mr. Tasker suggested that the covenants be for
a period of ten years with automatic extension
for ten years unless the majority of lot owners
agree to change them. He also said the property
could not be divided by applying for a variance
to the Board of Appeals.

Article III, Section 1, A - change to read: "Applicant
shall submit to the Planning Board (at least two
weeks prior to the regular meeting of the Board)
twelve copies of a Sketch Plan of the proposed
subdivision with road profiles and topographic
elevations at 5 foot contour elevation."
(3) Article III, Section 3, D.- change sixth line to
read "the requirements ~o~ the Master Plan, the
Official Map, and Zoning Ordinance."

ArticLe II!, Section 3, E - change second paragraph
tO read: "The action of the Plamning Board shall
be noted on three copies of the preliminary layout.
One copy shall be returned to the subdivider; one
copy sent to the Town Board Highway Committee,
together with the resolution of the Planning Board."

(5) Article III, Section 4, C - change first sentence to

on each stage or operation of the construction of
improvements. Said construction inspector shall-
after completion of construction, certify to the
Planning Board and Highway Superintendent that
all required zmprovements have been constructed
as required by the Board. In addition, the sub-
divider shall furnish a certified set of drawings
showing all improvements as constructed, in the
same detail as required for the approved Subdivi-
sion Plat."
Article III, Section 5, D - Add at end of last
sentence? "and method of installation."
Article III, Section 6 - Mr. Tasker will check
on adding New York State Requirements to this
Section.
Article IV, Section 2, B - Add at end of last
sentence: "with approval of the Highway Superintendent
and Town Board Highway Committee,"
Article IV, Section 2, F - There wa~s discussion on
eliminating this Section on Dead End Streets.
Article IVt Section 2, K - Change to read: "The
street plan of a ip~oposed subdivision shall bear
a logical relation~ship to the topography of the
property, and all streets shall be arranged so-as
to obtain as many of the building sites as possible
at or below the grade of the streets. Grades of
streets s~all conform as closely as possible to the
original topograPhy."
Ar~i. Section 3, B - Change line four to read:
"4 the Superintendent of Highways and

Article IV, Section 3, F - Change to read: "Where
dead end streets are designed to be so permanently,
they should in general, not exceed 800 feet in
length, and shall terminate in a circular turn-
around having a minimum right of way radius of 50
feet and full pavement six feet from all property
lines or durb to curb. At the end of temporary
dead end streets a temporary turnaround with a full
pavement of six feet from property lines or curb to
curb.~halt be provided, unless the Planning Board
approves an alternate arrangement."
Article IV, Section 3, G - After first two para-
graphs add "and Plamning Board."
Article IV, Section 6, B - Change last semtence to
read: "The Town Superintendent of Highways and
Planning Board shall approve the design and size of
facility based on anticipated run-o~f from a "six
inch rainfall per day" under conditions of total
potential development permitted by the Zoning Ordinance
in the watershed."
~rticle IV, Section 7, A - Change first sentence to
read: "The subdivider shall install sanitary sewer
facilities in a manner prescribed by the Suffolk County
Department of Health and the Suffolk County Department
of Environmental Control."
Article IV, Section 7, C - Add to first sentence: "and

Article IV, Section 8, A - Change last sentence to read:
"When recreation areas are required, the Planning Board
shall determine the number of acres to be reserved
on the basis of providing four (4) acres of recreation
area for every one hundred (100) families o~ living
units."
Article I~, Section 8, E - There was discussion about
changing the amounC of money in lieu of land per
gross acre to $5,000 or 5% of the fair market value
of the total acreage proposed for the subdivision.
Article IV, Section 8, I - There was discussion about

(24) Article IV, Section 8, J - There was discussion as
to revising the'depth at road ends at tidewater
(25) Article V, Section 4 - Mr.TTasker will check into
adding New York State requirements.
(26) Mr. Tasker said the Planning Board may require a
disclosure statement of the principals of a
corporation.
(27) Mr. Tasker said there was a recent court, decision
that states a municipality cannot require a developer
tto put drainage facilities in public roads.
The meeting was adjourned at 12:30 a.m.
