Y. 119?1 PLANNING BOARD MEMBERS Joh~ Wlckham, Chairman Henry Molsa Alfred Grebe Henry Raynor Frank Coyle MINUTES SOUTHOLD TOWN PLANNING BOARD December 6, 1972 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., Wednesday, December 6, 1972, at the Town Office, Main Road, Southold, New York. There were present: Messrs. John Wickham, Chairman; Henry Moisa, Vice Chairman; Henry Raynor, Frank Coyle; and Alfred Grebe. Also present: Howard Terry, Building Inspector; Jean Tiedke, League of Women Voters. Southold Town Planning Board - 2 - December 6, 1972 Bob Douglas appeared before the Board in regard to Major's Pond Subdivision. He_presented the map and said the irrigation ditch had been filled and taken off the map. Mr. Wickham asked how high the land was between the ordinary high water mamk of the Bay and Major's Pond and if salt comes in. Mr. Douglas said salt only comes in with extremely high tide and that lot ~8 is about 14 feet above the high tide. Mr. Wickham said there was a problem about the pond being marked reserved. It either has to have a lot number or be reserved for scenic easement. The scenic easement has the advantage of reducing the taxes. Mr. Raynor said with a scenmc easement you won't ~ive up title. Mr. Wickham said the Planning Board i~ recommending you put a scenic easement on it, There zs no. reason you should be taxed for shore front property when it ms going to-be used for scenic purposes. Mr. Moisa suggested it could be included in the Park and Playground area. Mr~ Doulgas asked if the property is totally developed, could the pond be opened ~p to the Bay/ Mr. Wickham told him if it was to be opened up it should be done now and take advantage of the increase in value of the land, Mr. Douglas also asked if the area was all park and the people decided to open it up could they do it? Mr. Raynor said there is no Southold Town regulation at the present time against it. Mr. Coyle and Mr. Wickham both stated they thought the pond should be left fresh water. Mr. Douglas said ~e would talk to Mr. Latham. were to be developed all at once it might throw an inbearable load on the school district. Mr. Donovan said it is not the intention of the developers to build. Mr. Wickham said the Town of' Southold stands to gain if you don't develop this in less tha~'five years and possibly ten Would be better and we ~would like to have an agreement that this would be done in sections. Mr. Donovan said they intended to develop it in four sections and it would take approximately four years. Southold Town Planning Board December 6, 1972 Mr. Wickham said the Planning Board was giving them some thoughts on some problems. Mr, Donovan said the homes built would probably be second homes and retirement homes and would not cause a load on the school district. Mr~ Wickham said he realizes the people who can buy these homes are not young people but there is a second generation and they come into possession of these homes qui~e soon and then immediately there are children. Mr. Wickham asked Mr. Donovan if they had considered putting houses on smaller lots. Mr. Donovan said they had thought about clustering. It would mean less roads and improvements. Mr. Wickham said another benefit is that the open space should be under restrictive easement to reduce the tax load after the development is sold out. The Town Board has suggested this to the Planning Bo~din consultation and although this would be slower because the Planning Board does not have the entire authority to approve c~ustering we have to recommend it to the Town Board. In this particular case if the Town Board were to officially recommend it to us and we recommend it to you then there is bo problem. Mr. Donovan said if they cluster they have to have dul de sacs. He asked what size lots would be feasible withOut increasing the density. Mr. Raynor said the Board has not considered clustering before and could not g~ve an answer to that. Mr. Wickham said it is obvious to us that it is unreasonable to ask some of these retired people to take care of a one acre parcel of ground and even half an acre of ground can be burdensome. We cannot answer your question directly. Mr.Donvan said in order to make up a reasonably valid s~etch ptan he would.need to know what'would be reasonab~ac~eptable in sizes of individual lots. He asked if 15,~00!~square~ feet would~be acCeptable, i"He said he~as not tieing them down ~o a figure but would n~ed a guide for a sketch plan. Mr. W~ckham said they w~ld haVe to mee~ the side yard and front yard clearances. Mr. Donovan s~id he thought the frontages would have to be r~duced by 101% to no less than 90' x 140' as a minimum. Some would be bigger. It would not increase the density. Mr. Terry said he did not think the Town BOard would want cul de sacs. Mr~ Wickham said they could have loop roads. Theyhighway specifications would remain the same. Mr. Donovan Said they Plan to restrict the ho~ses to no less than 1000square feet on the first floor fOr li~ing area. Mr. Wickham suggested the rear yards could be shortened to keep the 100 foot frontage-at the building line. Also he said there is no reason you should cluster the whole thing. Perhaps the ~ots along the Sound could be developed in the traditional manner. Southold Town Planning Board - 4 - December 6, 1972 Mr. Raynor asked if Pebble Beach Realty holds title to the property and Mr. Donovan said they did. Mr. Raynor also asked if anyone involved with Pebble Beach works, part or full time, for the Townof Southold, County of Suffolk or State of New York and Mr. Donovan said no. Mr. Wickham said the Town Attorney has told the Planning Board they can ask for a statement naming the principals of a corporation. Mr. Bruer said Pebble Beach Realty is owned entirely by the corporation. He said h~ ~ill make up a statement of ownership and send it to the Planning Board. Mr. Terry presented the sketch made by the Soil and Wa~er Conservation District for the roads and drainage. The Board and Mr. Donovan discussed this plan. Mr. Terry said he has given a copy of it to Mr. Haberman. Mr. Wickham said this would mean no curbs and gutters and the roads would be elevated. All u~i~i~ies will be going in under- ground. Mr. Wickham also told Mr. Donovan that the Planning Board is going to require planting of ~ye grass before the houses are built, and some kind of cover for the lawns b~fore the grass emerges so that you don~t get silt erosion and blocking up of the drainage structures. Mr. Donovan said in the wooded areas they will disturb it as little as possible. In the open areas it will be seeded with rye grass, but once the ~ots are sold they lose control. Mr. Raynor said they could have a deed restriction that all wa~er must be kept on the lot during constnuction. They should not.finally grade the lots for purposes of establishing a lawn between October 1st and May 1st, except in cases where it will be sodded within six days. Mr. Donovan said the plot could be diked during construction. Mr. Donovan and Mr. Bruer said they would discuss the problem and Mr. Haberman will have the topographical map and sketch plan for the January meeting. There was discussion about Land's End Subdivision publiC hearing and it was decided to change the date Of the hearing. On motion of Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the public hearing in the matter of Land's End Subdivision be set for January 11, 1973, at 7:30 p.m. at the Town Office, Main Road, Southold, N.Y. Vote of the Board: Ayes: Messrs. Moisa, Raynor, Wickham, Coyle, Grebe. Southold Town Planning Board - 5 - December 6, 1972 The date of the regular meeting of the Planning Board will also be changed to January 11, 1973 instead of January 4, 1973. On motion of Mr. Raynor, seconded by Mr. Coyle, it was R~SOLVED that the next regular meeting of the Southold Town Planning Board will be held January 11, 1973, at 7:30 p.m~, at the Town Office, Main Road, Southold, N.Y. Vote of the Board: Ayes: Messrs. Raynor, Coyle, Wickham, Moisa, Grebe. On motion of Mr. Raynor, seconded by Mr. Grebe, it was RESOLVED that the minutes of the Planning Board meeting of November 29, 1972, be approved as corrected. Vote of the Board: A~es: Messrs. Raynor, Grebe, Wickham, Moisa, Coyle. The Secretary read the following letter dated. November 28, 1972, fro~ Robert L. Tooker, Esq., in regard to Little Neck Properties: John Wi!ckham, Chairman So~hold Town Planning Board Main Road Southold, New York 11971 Dear John: For several months, we have 'been dis~ssin~ with the suffolk County Health Department ~he ~ell ~est data recezved in connection With the subdivision known as Little Neck Properties. Nitrate levels have been found to be slightly above the acceptable level under the Suffolk County Health Department!s standards. We are ~urrently requesting a hearing before the Health Department's Review Board. Southold Town Planning Board - 6 - December 6, 1972 In the meantime, we request that your tentative approval of the subdivision be extended to give us a reasonable time to work out with the Suffolk County Health Department a satisfactory resolution of the water supply to this subdivision. Sincerely yours, Robert L. Tooker On motion of Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the Preliminary Approval for Little Neck Properties Subdivision be extended to June 1, 1973. The following letter was received from Harold Reese, dated December 4, 1972, in regard to Harbor Lights Subdivision: Gentlemen: We are in receipt of a letter from Mr. Martin Suter in connection with the roads in our Harbor Lights sub division. He goes on to say that "A review of your file shows much correspondence but no results." We are inclined to agree with him but for different reasons. Only a few weeks ago we again stopped in to see the Town Su~t. of Highways to inquire when the Town Board would contact me and make a personal visit to the area with us so that we would know exactly what should be done. Mr. Dean said that at a meeting with the Board they had declined to make a personal inspection and had merely stated that the roads should be brought up tO specification. Soutkold Town Planning Board December 6, 1972 the We then pointed out that on at least two or three occasion~, as requested, we had done exactly that with no "results". We further asked that if we now did this repair work again what guaranty could we have that the roads would now be taken over. It was then stated that because of the winter season approaching it was extremely unlikely that, even if we did meet the specification, the Town would now dedicate these roads. We hope perhaps that you can understand the dilemma we find ourselves in. We stand ready to do what has to be done but so far nobody has seen fit to tell and show us exactly what has to be done with some assurance that when this is completed the roads will be didicated. We intend contacting Mr. Suter in the near future to explore the possibility of getting some "results"' in the Spring. Yours truly, Harold Reese A letter will be sent to Mr. Reese stating that the Planning Board is in accord with their thinking that it would be better to defer any work on the roads until Spring. Hopefully by then we could get the Highway Committee of the Town Board and the Highway Superintendent to take some conserted action, but we have told you in previous correspondence the Planning Board can make no guaranty about any action of the Town Board. Copies of this letter and Mr. Reese's letter to the Planning Board will be sent to the Town Board Highway Committee and the Supt. of Highways. Mr. Coyle ~eported that he was at the Matt~tuck Shopping Center and the water was running off Factory Avenue~ The engineer claims that the leaching basiRs had not been hooked up to receive~it as yet. He-was also at Laurel Country Estates and when water was on other roads, their roads were draining correctly. Southold Town Planning Board - 8 - December 6, 1972 A request was received from George Stankevich for a certified copy of the minutes of the Planning Board meeting of November 29, 1972. The Secretary will have a copy certified by the Town Clerk and send them to him. The Planning Board received a letter from the New York State Department of Transportation stating that they have no objection to the issuance of a Certificate of Occupancy for the Mattituck Shopping Center. There was some discussion on Oregon Hills Subdivision. The map does not show an area for a sump oX connections for the propesed east-west road. Mr. Terry reported that Glenn Heidtman now has a contract for the proposed minor subdivision submitted at the last meeting. On motion of Mr. Coyle, seconded by Mr. Moisa, it was RESOLVED that the minor subdivison for Glenn Heidtman be approved and the Chairman is authorized to sign the map.
