WITNESSETtt, that the party of the first part, in consideration ofTen Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Orient, in the Town of Southold, County of Suffolk and State of New York, known and designated as Lot 12 on a certain map entitled, "Map of Pebble Beach Farms", filed in the Suffolk County Clerk's Office on June 11, 1975 as Map No. 6266, said lot being more particularly bounded and described as follows: BEGINNING at a monument on the westerly side of The Long Way distant 29.16 feet southerly from the westerly end of an arc of a curve which coimects the southerly side of The Cross Way with the westerly side of The Long Way; RUNNING THENCE South 13 degrees 00 minutes 20 seconds East along said westerly side of The Long Way, 250.85 feet to a monument; THENCE South 83 degrees 27 minutes 45 seconds West along the northerly side of Lot No. 11, 91.33 feet to a monument; THENCE North 21 degrees 46 minutes 00 seconds West along the easterly side of Lot No. 13, 276.72 feet to a monument and the southerly side of The Cross Way; THENCE North 83 degrees 27 minutes 45 seconds East along said southerly side of The Cross Way, 115.89 feet to a monument; THENCE easterly along an arc of a curve bearing to the right having a radius of 20.00 feet a distance of 29.16 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Michael J. Heaney, Jr. and Sheila Heaney, dated May 2, 2000, and recorded May 8, 2000, in the Office of the Suffolk County Clerk in Liber 12040, Page 695. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part wilt receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
