The Planning Board ~eviewed the above referenced file at the worksession on December
/ .
15, 2003. The fol[owing comments were issued:
Parcel 2 is currently 39,937 square feet. The proposed action will reduce the
parcel size to 35,377 square feet. The parcel is located within the R~40 zoning
district and requires a minimum lot size of 40,000 square feet. However, parcel
2 is pre-existing and nonconforming. Regardless, the Planning Board cannot
approve the further reduction in area of Parcel 2 and recommends that you seek a
determination from the Zoning Board of Appeals.
2. The proposed side-yard setbacks and lot width may also require a variance from
the Zoning Board of Appeals.

To Whom It may Concern:
We own the four parcels of property listed above, all
purchased at different times. We wish to add 15 feet to
Parcel ~1, most recently purchased in 2002, because the
line is so close to the house and garage.
At the same time, we would like to rectify the zig zag
that occurred in the center of the four properties
as they were divided by different people at different
times.
A survey prepared for this lot line change is enclosed.
Also is enclosed is a full survey of the four parcels
that we own as they are now.

After investigation and inspection the Board finds that
the applicant requests permission to set off a lot, CR27,
Southold, New York. The findings of the Board are %_hat the
applicant's property is surrounded by undersized lots and this
division Will not affect the character of the area.
The Board finds that strict application of the Ordinance
would pro~uce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and-will observe the spirit of
the Ordinance.
THEREFORE IT WASRESOLVED, Mary L~ Mulvaney, North Roadi'
Southold~ New York, be GP~ANTED permission to set off a lot,
CR27, Southold, New York, as applied for, subject to the fol-
lowing conditions:
1. The applicant will clear an area with a 30' radius
from the northeast' corner of the intersection of
