WITNESSEFH. that the party of the first pan, in consideration of'Fen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns oftbe party of the second part forever,
ALL that cerlain plot, piece or parcel of land. with the buildings and improvements thereon
erected, situate, lying and being at Orient, Town of Southold, County of Suffolk. and State of
New York. bounded and described as follows:
BEGINNING at a point marked by an iron pipe .,et in the northerly linc of the Main Road at
the southeasterly corner of land now or formerly of Henry A. Karcher, and
RUNNING THENCE North 20 degrees :30 minutes 40 seconds West, 149.16 feet to a concrete
monument set in the southerly line of land of Tabor;
THENCE North 74 degrees 04 minutes 40 seconds E~t, 82.38 feect6 an iron pipe;
THENCE along la~d~ now or formerly of Ilarry Terry, South 20 degrees 45 minutes
149.06 feel to an iron pipe set in the northerly line of the Main Road;
THENCE along the northerly line of the Main Road, South 70 degrees 00 minutes West, 83.00
feet to the point or place of BEGINNING.
TOGETHER with all the righ£, title and interest, if any, of party of the first part in and to the
land lying in the bed of the highway in front of and adjoining said premises to the center line
thereof.
SUBJECT to the following:
(1) Covenants, restrictions, easements, agreements, and zoning regulations of rccord, if
any;
(2) The right, during the lifetime of Hart~ Terry and his wife, Lydia Terry, so long as they
or the survivor of them shall continue to be the owner of the premises immediately adjacent on
the east, to continue to use the cesspool now on the premises herein conveyed which is
connected with the resid~v.'e of Harry Terry on the premises adjoining on the east, and
(3) The restriction, effective during the lifetimes of Harry Terry or his wife, Lydia Terry,
against the use of the premises for other than residential purposes.
BEING AND INTENDED TO BE the same premises conveyed to thc party of the first part by
deed dated April 5, 1999, and recorded on April 5, 1999 in the Office of the Suffolk County
Clerk in Liber 11955, Page 331.
TOGETHER with all fight, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of thc first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first pax, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the fight
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word 'party" shall be coostmed aa if it rend "parties" whencvcr the sense of this indenture so
requires.
