TO HAVE AND TO HOLD the premises herein granted unto the party of the second parl, the heirs or

whereby the said premises have been incumhered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of thc Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the fight to receive such
consideration as a trust fund to be applied first for thc purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall he construed as if it read "parties" whenever thc
sense of this indenture so requires.

of New York, County of Suffolk, Town of Southold, Hamlet of Orient, bounded
and described as follows:
BEGINNING at a point on the easterly side of Youngs Road at the northwesterly
comer of land now or formerly of Edward W. Lathan, and being distant northerly
980.0'/' feet from the intersection of the northerly side of Main Road and the
easterly side of Youngs Road;
RUNNING THENCE North 09 degrees 16 minutes 00 seconds West along said
esstedy side of Youngs Road, 120.87 feet to land now or formedy of Edward W.
Latham;
THENCE North 77 degrees 59 minutes 50 seconds East along said last
mentioned land, 150.00 feet to a monument and land now or formerly of Edward
W. Latham;
THENCE along said land now or formerly of Edward W. Latham the following
three (3) courses and distances:

(2) South 50 degrees 48 minutes 40 seconds West, 10.03 feet; and
